Arkansas Building Permit Guides

The governing document is the Arkansas Fire Prevention Code (AFPC), 2021 Edition, effective 1 January 2023. It is a three-volume set adopted by the State Fire Marshal — Volume I the fire code (2021 International Fire Code), Volume II the building code (2021 International Building Code) and Volume III the residential code (2021 International Residential Code) — each with Arkansas amendments, and it applies statewide, including rural and unincorporated land. Building permits are issued locally, by the cities and counties that run a permit program, which add their own zoning and development standards; the state issues no building permits for ordinary private construction.

Volume III governs detached one- and two-family dwellings and townhouses not more than three stories above grade; other buildings fall under Volume II. The trade codes are Arkansas editions of model codes, adopted by different agencies: the 2018 Arkansas Plumbing Code and 2018 Arkansas Fuel Gas Code (Department of Health), the 2021 International Mechanical Code (HVACR Licensing Board), the 2014 Arkansas Energy Code (based on the 2009 IECC) and the National Electrical Code set by the Board of Electrical Examiners — the 2020 edition, with the 2026 edition being adopted (Fayetteville applies it to electrical permits applied for after 1 November 2026). Contractor licensing runs through the Arkansas Contractors Licensing Board, part of the Department of Labor and Licensing. A commercial licence is required for work other than single-family residences when the cost, labour and materials included, is $50,000 or more (Ark. Code §17-25-101). A residential licence — Residential Building Contractor, Residential Remodeler or a residential specialty such as home improvement — is required for residential work costing more than $2,000 (§17-25-513), and splitting a job into smaller contracts does not avoid it. A “single family residence” means a project of one to four units (§17-25-502); five or more units is commercial.

Trade permits are generally separate from the building permit and are issued to the licensed installer. Electricians are licensed by the Board of Electrical Examiners and HVACR contractors by the HVACR Licensing Board, both in the Department of Labor and Licensing; plumbers and natural-gas fitters by the Department of Health, which also regulates on-site wastewater (septic) systems; and water-well contractors by the Water Well Construction Committee of the Natural Resources Commission. Fire sprinkler and alarm work has its own state licensing board. Many jurisdictions also require local registration before a permit will issue in a firm’s name.
