Bella Vista, Arkansas Building Permit Guide

Inside Bella Vista city limits, building and trade permits come from the Fire Department’s Building Division at 101 Town Center, with applications emailed in or filed through the City’s iWorQ portal.

Authority: Bella Vista Fire Department, Building DivisionCode: 2021 Arkansas Fire Prevention CodePhone: 479-268-4980

The Building Division of the Bella Vista Fire Department reviews plans and issues building, electrical, plumbing, gas and mechanical permits for work inside the city, from its office at 101 Town Center (479-268-4980). The ICC Building Valuation Data table sets a project’s value and the City’s fee table prices it: a project valued at $250,000 pays a $910 building permit, and each new house also pays a $2,255 development impact fee adopted in March 2026.

What needs a permit in Bella Vista?

The City’s code and the Building Division’s own guides go further than the model code on small projects. Bella Vista requires a permit for:

Permit required

  • New homes, additions, remodels and restorations
  • Every deck and dock, and driveways
  • Sheds, shops and storage buildings over 120 sq ft, and pergolas
  • Fences of any height
  • Retaining walls over 30 inches tall
  • Storm shelters, pools and spas
  • Demolition and moving a building
  • Electrical, plumbing, gas, mechanical, irrigation and septic work

No permit

  • One-story detached sheds, playhouses and similar buildings of 120 sq ft or less
  • Retaining walls 30 inches tall or less that carry no surcharge
  • Minor plumbing repairs to faucets, valves, supply lines and appliances, and clearing stoppages

The Bella Vista Property Owners Association runs an Architecture Control Committee (ACC) that reviews projects for size, location, design, materials and colors. The City’s permit process sheet says a project may need both a City permit and an ACC permit, and gives the ACC’s number as 479-855-8080.

Who issues building permits in Bella Vista?

Permitting and inspections are run by the Building Division of the Bella Vista Fire Department. It enforces the Arkansas Fire Prevention Code (building, residential and fire volumes) together with the plumbing, mechanical, electrical and energy codes, reviews plans, issues permits, inspects work and keeps permit records. Under City Code Sec. 103-43 the fire chief, or the chief’s designee, acts as the building official. Roger Gier is the Chief Building Official.

Planning, development and permitting moved into 101 Town Center on August 26, 2026. Parking there is limited by ongoing construction and there is no room to turn a trailer in the lot, so the City asks applicants to do as much as possible online. Contractors get a contractor ID by emailing the Division.

Bella Vista applications and forms

Completed applications and their submittal items are emailed to building@bellavistaar.gov for intake. Subcontractor permits, new homes and accessory structures can also be filed in the iWorQ portal. Grading, erosion control, drainage and large scale development applications belong to the Planning Department; applications that go to the Planning Commission or the Board of Zoning Adjustment need a pre-application conference with a City planner first.

Forms on the Building Applications page (most revised August 2026):

  • Residential Building Permit Application for new homes, with a box to elect third-party plan review.
  • Remodel Permit Application and Deck and Dock Permit Application, with a deck reference guide and detail sheet.
  • Deferred Submittal Application, used for items such as truss calculations, which can follow up to the framing inspection.
  • Owner-Builder Affidavit: notarized; you must own and occupy the home, oversee all of the work, and not offer the house for sale for one year after the permit is completed. A licensed contractor you hire must take out a separate permit.
  • Authorization for Temporary Power, the Septic System Deed Restriction and the Lot Clearing Burn Permit (with a neighbor consent form) if you burn after clearing.
  • Construction Appeals Application for the Board of Construction Appeals.

When an application is accepted, half of the permit fee, up to $250, is due and is not refundable. City Code Sec. 103-47 bars residential builders and home improvement contractors from working in the city without the state residential licence unless state law exempts them.

Bella Vista permit fees

The Building Division prices permits by valuation, using the International Code Council’s Building Valuation Data table (the February 2026 table is posted on the Fees page). The same valuation method covers new homes and commercial buildings, additions and accessory work such as workshops, decks, carports, pergolas, docks and boathouses. The Permit Fee Schedule posted on the Fees page (file dated 4-01-26) sets these amounts:

Bella Vista building permit fee by valuation
Project valuationFee
$3,000 or less$25
$3,001–$15,000$25 for the first $3,000 plus $5 per additional $1,000
$15,001–$50,000$85 for the first $15,000 plus $5 per additional $1,000

Development impact fees. On March 23, 2026 the City Council amended Ordinance 2021-23 and set new impact fees, with an emergency clause. A single-family home pays $2,255 ($1,500 fire/EMS, $484 police, $64 library and $207 paved trails) and each multifamily unit $1,696. Nonresidential buildings pay per 1,000 sq ft: retail $3,722, office $1,962, institutional $1,916 and industrial $891.

A permit that expires is renewed at 100% of the original fee if no inspection has passed, 80% after the footing inspection, 70% after slab or foundation, 50% after framing and 20% after insulation.

Electrical, plumbing, gas and mechanical permits in Bella Vista

New homes and commercial buildings, and any job that alters these systems, need separate system permits. City Code limits who can hold them: electrical permits go to Arkansas master electricians (industrial maintenance electricians inside industrial plants), plumbing and irrigation permits to master plumbers, gas permits to supervising gasfitters or master plumbers, and mechanical permits to state licensees. Stand-alone septic permits go to designated representatives and licensed septic installers.

Before a plumbing permit is issued the City needs any Arkansas Department of Health plumbing permit and approved plans that the job requires, and, where no sewer is available, the Health Department’s (or its designated representative’s) approval of the septic system. Water providers may not set meters for work that has not been permitted and inspected.

What to submit for a Bella Vista house permit

The Residential Submittal Requirements (August 2026) list what a new-home or addition package must contain. Files must be labeled (floor plan, foundation plan and so on), incomplete or mislabeled applications are rejected, and an application left abandoned expires 180 days after filing.

Plans

  • Cover sheet: index, location, codes used, designer, all square footage, construction type
  • Foundation plan with all footings and sections, Ufer location, crawlspace framing
  • Floor plans with room labels, ceiling and header heights, brace wall lines and any deed-restricted rooms
  • Framing plans and wall sections; truss layouts (may be deferred to framing)
  • Four elevations with grade, building height and roof slopes
  • Engineering for trusses, I-joists, steel, ICF and fire-rated assemblies

Compliance documents

  • 11×17 plot plan to scale with a surveyor’s stamp, the Bella Vista Water stamp or sewer connection, and two trees at the front of the lot
  • Arkansas Department of Health septic permit or the sewer approval
  • Septic deed restriction, if needed, notarized and recorded in Benton County
  • Notice of structural encroachment letter, if needed, also recorded
  • Owner-Builder Affidavit for owner-built homes

On septic lots the Health Department fixes the number of bedrooms. Any extra room that could serve as a bedroom must carry a plan note that renting or advertising it as a sleeping room violates City Ordinance 2021-32, and the owner records a deed restriction with Benton County.

How to get a Bella Vista building permit: 6 steps

1. Check the lot and the ACC

The City cannot tell you whether a lot is buildable; utilities, septic or sewer, setbacks and elevation all matter. Ask the POA’s Architecture Control Committee whether your project needs an ACC permit as well.

2. Secure septic or sewer approval

Get the Health Department septic permit or the sewer connection approval and a surveyor-stamped plot plan before you apply.

3. Pick the right application

Use the residential, remodel, deck and dock or accessory application that matches the work, and add the Owner-Builder Affidavit if you are building your own home.

4. File and pay the deposit

Email the package to building@bellavistaar.gov or file it in iWorQ; half the permit fee, up to $250, is due on acceptance.

5. Answer review comments

Minor corrections can go on the original plans; major changes mean revised plan sets, which are rechecked more quickly than the first review.

6. Pay the balance and build

The permit issues once the plans comply and the remaining fees, including the impact fee, are paid. Post the permit board and request each inspection.

Bella Vista inspections

Request each inspection at least 24 hours ahead by calling 479-268-4980, emailing permits@bellavistaar.gov or using the iWorQ portal; the inspector emails the result. Every phase must pass before the next one starts. The footing inspection happens before concrete is placed and checks dimensions, depth, bearing soil, reinforcement and the Ufer ground. Electrical work is inspected at temporary meter, underground, in or under concrete, rough-in, meter and final.

During construction the site needs a permit board readable from the street, the address visible from the road, contractor signage, a toilet, a trash container and a concrete washout, with erosion control kept up. Work must start within 180 days of issue; after that the permit runs for 180 days from the last inspection.

No building may be occupied before the certificate of occupancy, and the City will not issue it until every permit and inspection fee is paid. Occupying early can cost the contractor and the owner up to $250 each per day. Homes are certified to the 2014 Arkansas Energy Code, and the City may inspect within two years of completion; the owner then has 60 days to fix any failure.

Local rules that matter in Bella Vista

Floodplain: City Code Chapter 105 makes the Planning & Development director the floodplain administrator. In AE zones the lowest floor of a new house must sit at least 2 feet above the base flood elevation, shown on an elevation certificate by an Arkansas engineer, surveyor or architect. Nonresidential buildings are elevated at or above the base flood level or floodproofed watertight to 3 feet above it, and manufactured homes go 2 feet above. Appeals go to the Planning Commission. FEMA lists Bella Vista as a participating community in the National Flood Insurance Program.

Accessory buildings: the Building Division’s shed guide requires a permit from 121 sq ft and a pier-and-beam or continuous foundation from 200 sq ft. One extra structure is allowed on the house lot (720 sq ft maximum) and one on an adjoining lot (1,200 sq ft maximum), up to 25 feet at the peak, and only where a house exists or is being built.

Fences: 3 feet maximum in front of the front plane of the house or garage and 8 feet behind it; electric, barbed and razor wire are not allowed, and pools and spas must be fenced.

Appeals: a Board of Construction Appeals hears building code appeals; its application package is on the Building Applications page.

Arkansas building code

Arkansas’s building code is the 2021 Arkansas Fire Prevention Code, adopted by the State Fire Marshal and in force statewide since 1 January 2023; building permits are issued locally where a city or county runs a permit program, and the plumbing, gas, mechanical, energy and electrical codes are adopted by separate state agencies. How much does a building permit cost in Bella Vista?

The ICC table sets the valuation and the City’s fee table prices it: $460 for the first $100,000 plus $3 per additional $1,000, so $910 at a $250,000 valuation. Trade permits are extra, and a new house also owes the $2,255 impact fee.

Do I need a permit for a shed or a fence?

A shed over 120 sq ft needs a permit, and so does a fence of any height. Decks always need one.

Can I build my own house?

Yes, if you will own and live in it. File the notarized Owner-Builder Affidavit and agree not to offer the house for sale for one year after the permit is completed.

How do I book an inspection?

At least 24 hours ahead, by phone at 479-268-4980, by email to permits@bellavistaar.gov or through the iWorQ portal.

Do I also need approval from the POA?

Often. The City’s process sheet warns that projects may need an Architecture Control Committee permit as well as a City permit; the ACC number is 479-855-8080.
