Inside the City of Oneida, the Code Enforcement Office at City Hall, under the Director of Planning & Development/Codes, reviews building applications, inspects construction and enforces housing standards. You file a paper application signed by the property owner; the city’s schedule prices most work by square foot, such as 40 cents for a new one-story home and 35 cents for a two-story home, and a home job without stamped plans is normally reviewed in 7 to 10 days.

What requires a building permit in Oneida?

Chapter 33 of the City Code, adopted in December 2022, requires a permit for any work covered by the Uniform Code or Energy Code, including building, enlarging, altering, moving or demolishing a structure and installing a wood stove, chimney or flue. The city’s fee schedule and permit checklist show what that covers for a typical property.

Permit needed

  • New homes, garages, storage buildings and additions
  • Interior renovations, kitchens and bathrooms
  • Open decks, roofed and enclosed porches, and porch rebuilds
  • In-ground and above-ground pools holding 24 inches of water or more
  • Sheds over 144 sq ft (every shed still needs a zoning permit)
  • Roofing, facades, solar and wind projects
  • Plumbing repairs and residential electrical work
  • Demolition, signs and private septic systems

No building permit

  • Building permit for sheds up to 144 sq ft (zoning permit still required)
  • Playground equipment
  • Painting, flooring and similar finish work
  • Like-for-like equipment replacement
  • Repairs that do not touch structure, exits or building systems

Sheds fall under two chapters. Chapter 33 exempts one-story sheds and playhouses of up to 144 sq ft at a house from the building permit, and the fee schedule charges sheds only above that size; the Zoning & Construction Division page still puts the line at 120 sq ft, but the adopted code is the rule. Zoning section 190-14, however, requires a zoning permit and a certificate of compliance for every accessory building, so even a small shed is filed with the office. A lot may have no more than two accessory buildings besides a private garage, each outside the required front yard, at least 10 feet from side and rear lot lines and from other buildings, and no taller than 1½ stories or 18 feet or the house itself. Pools follow the same 10-foot rule and side- or rear-yard placement.

What the city decides and what the state holds

The construction standards are the state’s Uniform Code and Energy Code, and Oneida cannot make them stricter without Code Council approval. The Common Council adopts the permit fee schedule, designates the electrical inspection agencies by resolution (ch. 45), and writes the zoning chapter, the swimming pool chapter and the city’s sewer use rules.

Oneida building department: who handles permitting

Code Enforcement sits inside the Planning & Development/Codes department, headed by Director Steve Vonderweidt. Two code enforcement officers review applications, inspect work and handle housing and rental inspections, with an account clerk for codes and planning. Zoning variances, special uses and site plans go to the city’s Joint Zoning Board of Appeals/Planning Commission. Oneida is a city in Madison County; the surrounding towns are separate jurisdictions, and Oneida County lies across the county line.

Oneida permit types and filing

Oneida files on paper. Its Forms & Applications page carries the building permit application, the sign permit, the private waste disposal (septic) application, the sewer permit application, the state’s unified solar permit, a sawmill identification form, the deck construction guide, insurance and CE-200 instructions, asbestos removal information and a list of local engineers, architects and asbestos survey firms. A self-serve form station stands just inside the City Hall entrance for anyone without a printer. Applications that are incomplete are not processed and are mailed back.

Residential permits

The owner, a lessee, an agent or a design professional may apply, but the property owner must always sign. Every project needs detailed drawings covering structure, electrical, plumbing, HVAC and elevations, and the checklist adds project-specific items: a survey with the shed, pool, porch or deck plotted on it; drawings and a scope list for decks and remodels; and an asbestos check with a signed asbestos addendum for demolition. Stamped architect or engineer drawings are required for jobs over $20,000 and for homes over 1,500 sq ft. A homeowner doing the work files the state BP-1 exemption form; contractors file workers’ compensation and disability proof (C-105.2, U-26.3, SI-12) or a CE-200.

Commercial permits

New commercial buildings and complete renovations are charged 40 cents per sq ft, and light renovations with no plumbing changes and only switch or receptacle work 25 cents. Commercial and industrial jobs normally take 4 to 8 weeks to review, and the city may hire a third party for plan review and inspection help. The application also prints the city’s design criteria, including a 42-inch frost depth, 40 to 70 psf ground snow load, 115 mph wind speed and required ice-shield underlayment.

What comes before the building permit

Zoning comes first, and every board application starts with a call to Code Enforcement at 315-363-8460. If the officer finds the project needs the Joint Zoning Board of Appeals/Planning Commission, you file a code enforcement application that is denied as a formality, which moves the request to the Planning Department. Board applications need a cover sheet signed by the owner of record, notarized authorization for an agent, and four printed copies plus a digital copy, at least 19 days before the meeting; the board meets on the second Tuesday of each month at 6 p.m. in the Common Council Chambers. Some projects also need a pre-application meeting with engineering, water, fire, codes and planning staff, a county planning referral and coordinated environmental review, each with a 30-day response period. Decisions are mailed, and an appeal is an Article 78 case filed within 30 days. Section 190-24 bars a permit for a building needing water and sewage until the applicant shows both are provided for. On sewer, that is the city’s sewer permit application; off sewer, it is the city’s private waste disposal application, listing every water supply within 100 feet, with Madison County Public Health (315-366-2526) reviewing alternative system designs and observing percolation and deep-hole tests. New access to a state or county highway needs an on-site turnaround so cars do not back onto the road, and flood-zone work follows the city’s flood damage prevention chapter (ch. 64).

Oneida building permit fees

The city’s Building and Demolition Permit Fee Schedule, posted as its 2025 schedule, prices work by square foot measured on the outside dimensions, with a $25 minimum for any building or demolition permit. Renovations are charged on the actual floor area being worked on.

Permits expire after 12 months with one free 90-day extension; later extensions and renewals cost 50% of the original fee, at least $25.

Trade permits and who may pull them

The city does not license electricians or plumbers, but it controls who inspects. All required electrical work must be inspected by one of the five agencies the city approves: The Inspector, LLC; Atlantic-Inland, Inc.; Commonwealth Electrical Inspection Service; Central New York Electrical Inspection Service; and Upstate Electrical Inspection Agency. Under chapter 45 an agency must start within 48 hours of being called, or the job can go to another approved agency, and the owner files the agency’s certificate of compliance with the city. Pools need a third-party electrical inspection as well.

Plumbing and electrical work on a house carry flat city fees ($50 for a residential plumbing repair, $25 for residential electric), and a truss roof adds a $50 truss fee. Pool contractors must file an insurance certificate with the pool application.

How to apply for an Oneida building permit

1. Confirm the city address

Make sure the parcel is inside the City of Oneida, not a neighboring town or Oneida County.

2. Check zoning

Ask the Code Office whether the job needs a variance, special use permit or site plan from the joint board.

3. Pick up the forms

Download them or use the form station at City Hall; add the sewer or private waste disposal application if water and sewage are involved.

4. Assemble the package

Owner-signed application, drawings, survey with the work plotted, insurance or BP-1, and stamped plans over $20,000 or 1,500 sq ft.

5. Submit and pay

Hand in the complete package at City Hall; incomplete applications are mailed back unprocessed.

6. Call the agency and the city

Book the electrical agency and call 315-363-8460 for each city inspection.

Review, corrections and what causes delay

The city gives normal review times of about 7 to 10 days for a home job without stamped plans, about 4 weeks when stamped plans are required, and 4 to 8 weeks for commercial and industrial work. Missing items send the whole package back by mail, so the most common delay is an unsigned application or a missing survey or insurance form. Under chapter 33 a permit becomes invalid if work has not started within six months, and it expires after 12 months.

Oneida inspections and certificates

Code officers make site inspections to confirm the work meets the approved plans and the codes, and they can issue a stop-work order on a non-compliant site. Call the office at each stage your permit lists, and book the electrical agency separately. A pool cannot be used until its barrier is in place: chapter 159 requires a fence 4 to 6 feet high enclosing the pool, unless a rigid wall is at least 48 inches high with a ladder that locks or is removed, and doors from a house or garage into the pool area need self-closing devices and alarms.

Work ends with a certificate of occupancy or certificate of compliance, $25 under the city schedule. Rental properties also get scheduled property-maintenance inspections from the code officer assigned to rentals, covering exterior and interior conditions, egress, smoke and carbon monoxide alarms and dryer venting.

New York building code

New York builds on one statewide code, the Uniform Code, outside New York City; the 2025 edition and 2025 Energy Code took effect on 31 December 2025 (the all-electric provisions remain suspended by court order). Cities, towns and villages administer it, and local standards stricter than the code need Code Council approval. The Uniform Code in New York

Do I need a permit for a shed?

Not a building permit up to 144 sq ft under chapter 33 (the city’s zoning page still says 120), but section 190-14 requires a zoning permit for every accessory building. A shed must be out of the front yard, 10 feet from side and rear lines and other buildings and no taller than 18 feet; above 144 sq ft the building fee is 25 cents per sq ft.

Do I need a permit for a pool?

Yes, for any residential pool holding 24 inches of water or more. The city needs a survey with the pool plotted, a 10-foot setback and a third-party electrical inspection, and its checklist says pools under 4 feet tall, blow-up pools included, need a fence.

How tall can a fence be?

No more than 6 feet in a front or side yard, at least 3 feet back from any street right-of-way or sidewalk, and no higher than 3 feet in a corner-lot sight triangle.

Which electrical inspectors can I use?

One of the five agencies on the city’s approved list; inspections by any other agency are not accepted.

Who approves a septic system?

The city’s Code Enforcement Office takes the private waste disposal application; Madison County Public Health reviews alternative system designs and observes soil tests.

What happens if I start work without a permit?

The city issues a stop-work order and inspects the job thoroughly, and the Zoning & Construction Division says permit fees are doubled for work started without a permit.

Is Oneida in the flood insurance program?

Yes. FEMA lists the City of Oneida as a participating community, and flood-zone work follows the city’s flood damage prevention chapter.

Oneida permit search and official resources

The city has no online permit search. Ask the Code Enforcement Office about a property’s permits and certificates, or make a Freedom of Information Law request to the City Clerk at City Hall.
