Oneida County has no county building department. Utica, Rome and Sherrill, the 26 towns and many of the 16 villages each run a code office that issues permits and inspects work inside its own boundary, and a town office stops at the line of any village that keeps its own officer. The county’s part sits beside that permit: its Health Department approves alternative septic systems for houses, its Department of Public Works permits driveways and other work on county roads, and its planning staff review the zoning actions that local boards must refer.
What requires a building permit in Oneida County?
The local office decides what it lists, and the lists differ. Rome names new windows, decks and steps, kitchen and bath remodels and sheds; Clinton’s village officer wants permits for fences, signs, alterations, solar panels, pools and demolition; Sylvan Beach lists sheds, fences, decks, pools, driveways and remodeling. In Lee and in Trenton the town warns that a project exempt from zoning approval may still need a building permit, and Sangerfield issues a zoning permit before the building permit.
Common local permits
- New homes, additions and structural changes
- Decks, porches, sheds and garages
- Pools, fences and solar arrays
- Wood stoves, furnaces and other fuel-burning appliances
- Demolition and changes of use
- Septic permits in towns that issue them
Separate county approvals
- Alternative septic technology for a house, and systems at permitted facilities: county Health
- New driveway onto a county road: DPW driveway permit
- Any other work in a county right-of-way: DPW work permit
What local offices decide and what the state keeps
The technical rules are the state’s 2025 Uniform Code and Energy Code everywhere in the county. Local choices are zoning, which small jobs a municipality lists, the fee rule, office hours and the filing channel, and a few places add their own laws: Marcy, for example, adopted a Town of Marcy Electrical Code as Local Law No. 2 of 2020. Oneida is one of the twelve counties that the Department of State lists as having opted out of the enforcement of the Uniform and Energy codes. The county therefore does not enforce the code in a town or village that has also opted out; there, the state’s Code Inspection Unit enforces it in place of the local government and charges fees.

Rather talk it over?
Call 1-855-478-4290 →Several boundaries cause confusion. New York Mills is split between New Hartford and Whitestown, Waterville between Marshall and Sangerfield, and Remsen village between Remsen and Trenton. The Clinton ZIP code also reaches into Kirkland, Westmoreland and New Hartford, and the Village of Clinton permits only its own parcels. Sherrill is a city, so the Town of Vernon office does not cover it. The City of Oneida, for its part, is in Madison County.

- Health Department, Environmental Health: its sewage program approves treatment systems at facilities that hold health permits and approves alternative sewage technologies for individual houses. The water division oversees about 155 public water supplies and advises private well owners.
- Department of Public Works: driveway permits for every county road, and work permits for anyone working in the county right-of-way. Forms go by mail or email to 5999 Judd Road, Oriskany (315-793-6200).
- Department of Planning: serves Herkimer and Oneida counties and reviews every non-ministerial zoning or subdivision action that a municipality with zoning must refer under General Municipal Law 239-l, -m and -n.
Oneida County permit types and applications
Residential permits
Each office uses its own form. Floyd posts separate zoning, building and sanitation permit applications; Forestport lists its requirements and asks applicants to call for an appointment; Trenton charges a $15 application fee with the joint zoning and building form, which the Town Clerk forwards to the zoning officer before the codes department sets the building fee. Small-town officers often keep short hours: Lee’s office is open Wednesday evenings and Saturday mornings, and Remsen, Steuben and Western work by appointment.
Building or remodeling a home here? Alliance handles residential permit applications, so the crew isn't waiting on the counter.
Commercial permits
Commercial projects need stamped plans and, in most municipalities, a planning board site plan first. Those site plans, special permits and variances often trigger a county referral, and the county review clock starts only when a complete referral with all supporting documents arrives through the online form. In Clinton’s historic district, a certificate of appropriateness from the Historic Preservation Commission comes before the Planning Board and the building inspector.
For tenant improvements and new commercial builds, Alliance handles commercial building permits through issuance. More on this: commercial building permits explained.
What comes before the building permit
- Zoning: a zoning permit or determination where the town requires one (Sangerfield, Trenton), then the planning board or zoning board of appeals if the project needs them.
- County referral: actions sent to the county planning department under section 239.
- Septic: the town septic or sanitation permit, or county Health approval for an alternative system; Verona’s code asks for a written county Health construction permit before a private wastewater system is built.
- County road: the DPW driveway permit.
- Historic review: Rome’s residential historic district and Clinton’s historic district.
Building permit fees in Oneida County
Fees are set by each city, town and village, and they are built on different bases. The three schedules below come from this site’s finished guides; Sangerfield (August 14, 2024), Western (2025), Boonville and Marshall post their own schedules on the pages in the table.
| Place | One- or two-family house | Schedule |
|---|---|---|
| City of Rome | $200 for the first 1,500 sq ft plus $100 per added 1,000 sq ft or part | Fees for Building Permits, posted January 2026 |
| Town of New Hartford | $0.26 per sq ft | Town Code section 118-140 |
| Town of Whitestown | $15 per 100 sq ft; $150 of it paid as a non-refundable deposit at filing | Fee schedule of May 15, 2024 |
Want this handled start to finish?
Get a free quote →Worked comparison for a new one-family house of 2,000 square feet: Rome charges $200 for the first 1,500 square feet and $100 for the remaining 500, which counts as part of a further 1,000, so $300. New Hartford’s rate gives 2,000 × $0.26 = $520. Whitestown’s gives 20 × $15 = $300, of which $150 is paid at filing.
Trade permits and who may pull them
The county’s pages show no county trade license; the rules come from the cities and towns. In Utica only persons licensed by the city may do plumbing or electrical work, and the Codes Department runs the license exams. Rome requires plumbing to be done by a City of Rome licensed plumber and has electrical work inspected by an approved third-party agency. Marcy’s Electrical Code is a town law of its own.
Towns such as New Hartford rely on registered electrical inspection agencies and publish their lists. Septic work is often a town permit too: New Hartford issues it after a New York licensed engineer designs the system, and Steuben’s officer inspects septic permits along with building and mobile home permits. Proof of workers’ compensation and disability coverage, or the state exemption form, goes with each application.
How to get a building permit in Oneida County
Check the tax map: city, town, or a village inside the town.
Many officers keep short hours; book a meeting and ask for the form and fee sheet.
Get the zoning permit, site plan or variance, including any county referral.
Town septic permit or county Health approval; DPW permit for a county-road driveway.
Submit plans, insurance certificates and the fee the way that office takes them.
Book each stage and collect the certificate of occupancy or compliance.
Review, corrections and what causes delay
In this county delays usually come from the calendar rather than the plans: a part-time officer who keeps two short sessions a week, a board hearing that has to be scheduled, or a county referral that has not started because an attachment is missing. Starting work early is costly too; New Hartford doubles the application fee and Whitestown charges double or at least $100.
Inspections and certificates
Inspections are booked with the office that issued the permit, usually by phone with the officer named on its page. Several offices schedule only by appointment (Remsen, Steuben, Western, the Village of Clinton), and Camden village’s officer keeps Wednesday morning hours, so call before the work reaches a stage that will be covered up. Wiring is inspected by the third-party agency the owner hires, and its certificate goes back to the local office.
In New Hartford the engineer of record inspects the septic system he or she designed. At the end the local office issues a certificate of occupancy for a new building or a certificate of compliance for other work; Sylvan Beach’s officer, for example, issues both.
New York building code
New York builds on one statewide code, the Uniform Code, outside New York City; the 2025 edition and 2025 Energy Code took effect on 31 December 2025 (the all-electric provisions remain suspended by court order). Cities, towns and villages administer it, and local standards stricter than the code need Code Council approval. The Uniform Code in New York

Oneida County permit FAQ
Does Oneida County issue building permits?
No. The county has opted out of the enforcement of the Uniform and Energy codes, and permits come from the city, town or village where the land lies.
Who approves a septic system in Oneida County?
It depends on the system and the town. County Health approves alternative technologies for houses and systems at permitted facilities; towns such as New Hartford, Floyd and Forestport issue their own septic or sanitation permits.
My address says Clinton. Which office do I use?
Only parcels inside the Village of Clinton go to the village officer. Others go to Kirkland’s Planning and Codes Office, or to Westmoreland or New Hartford if the parcel lies there.
Do I need a county permit for a driveway?
Yes on a county road. DPW issues a driveway permit for every driveway onto a county road and a work permit for other work in the right-of-way.
Do electricians and plumbers need a license?
Not from the county. Utica allows only city-licensed plumbers and electricians, and Rome requires a city-licensed plumber.
Does the county review my variance or site plan?
It advises. The county planning department reviews actions referred under section 239, and the local board then makes the decision.
Are Oneida County communities in the flood insurance program?
Yes. Every city, town and village in the county that FEMA lists is in its participating section, so local floodplain rules apply in mapped flood zones.
Oneida County permit search and official resources
Permit records stay with the municipality that issued them. Ask that office or its clerk for a copy, or file a Freedom of Information Law request; Rome, for example, takes FOIL requests through the City Clerk. County Health keeps its own septic approvals.
