For land in the Town of Sullivan outside the Village of Chittenango, Code Enforcement Officer Larry Ball and the Building, Planning & Zoning office at Town Hall issue building permits on a paper application with a stamped survey and two plan sets. The town’s instructions call for a permit for every fence and every shed, septic plans go to the Madison County Health Department before the town permit, and since July 1, 2026 the town has had a 12-month moratorium on data centers and cryptocurrency mining.
What requires a building permit in the Town of Sullivan?
The town’s application instructions list the work that needs a permit: any addition such as a deck, porch or garage; structural, plumbing or electrical alterations; every swimming pool, above-ground or in-ground; any storage shed “no matter the size”; any demolition; any fireplace, pellet or wood stove; any sign; and any fence. The application form adds generators, roofing, foundations, mechanical work, fire protection systems, changes of occupancy, grading and pole barns, and work not checked on the form needs a separate application.
Permit needed
- New homes, additions, garages, pole barns, decks and porches
- Sheds of any size (zoning permit; building permit over 144 sq ft)
- All fences
- Pools, spas and hot tubs over 24 inches deep
- Roofing, foundations, generators and mechanical work
- Fireplaces, wood and pellet stoves, chimneys
- Solar arrays, signs, demolition and grading
- Septic systems and sewer hook-ups
Exempt under chapter 123
- Painting, wallpaper, tile and carpet
- Window awnings on a one- or two-family house
- Partitions under 5 feet 9 inches
- Like-for-like equipment replacement
- Repairs that do not touch structure, exits or fire protection
Two chapters of the code explain the town’s “every shed” rule. Chapter 123, rewritten by Local Law 2 of 2025, exempts one-story sheds and playhouses of up to 144 sq ft at a house from the building permit, but zoning section 275-18 says no building or structure may be erected, added to or structurally altered until the Zoning Administrative Officer has issued a permit, with two copies of a site plan showing the lot’s actual dimensions and the size and location of every building. So a small shed still needs the zoning permit, and fences, which chapter 123 does not exempt, need a permit as well.
What the town decides and what the state holds
The state’s Uniform Code and Energy Code set the construction standards, and stricter local building rules need Code Council approval. The Town Board sets permit fees by resolution (section 123-17), writes the zoning chapter with its fence and lakefront rules, adopts local laws such as the 2026 data center moratorium, and requires applicants for board approvals to pay the town’s consultant costs (ch. 140).

The town is home to 14,623 people. The Village of Chittenango, with 4,753 of them, has its own codes office and permits for building, pools, fences, signs, solid-fuel devices and residential solar, with its own code on eCode360. Everyone else, about 9,900 residents, is served by the town office. The Village of Canastota is in the neighboring Town of Lenox, not in Sullivan.

Town of Sullivan permit types and filing
The town works on paper. The Building Permits page posts the general application with its instructions, building detail requirements, a pole barn guide, fence, detached garage and shed, solar, pool and deck handouts, and separate applications for solid-fuel appliances and chimneys, demolition, floodplain development (with the FEMA elevation certificate), septic systems, sewer hook-ups, signs and operating permits. The form must be typed or filled in ink, and you pay by cash or check to the Town of Sullivan.
Residential permits
Every application needs a recent stamped survey showing existing buildings and the new work, with distances to all decks, sheds, other structures and lot lines, and two complete sets of plans and specifications covering structure, mechanical, electrical, plumbing and fire protection. Projects over $20,000 or over 1,500 sq ft need plans by a New York registered architect, with the seal and signature on every sheet. The form asks for the estimated value of work, the electrical inspection agency, the plumber and mechanical contractor, and whether the lot is in a flood zone or wetland or has easements. Contractors attach liability and workers’ compensation certificates or a state exemption; an owner doing the work uses Form BP-1.

Commercial permits
Commercial, industrial and office parcels use the same application, with the occupancy change and fire protection boxes where they apply, and operating permits for regulated uses. Under chapter 123, permits for anything other than residential construction expire six months after issue. Asbestos questions for demolition go to the state Labor Department’s Asbestos Control Bureau in Syracuse (315-479-3215).

What comes before the building permit
The application has boxes for Planning Board and Zoning Board review and for septic approval, and the office marks which apply. The Planning Board meets on the first Tuesday of each month. Applicants for site plans, special use permits, variances, zone changes and subdivisions post a deposit with the Town Comptroller and pay the town’s legal and engineering review costs. On a septic lot, plans stamped by an engineer go to the Madison County Health Department for approval before the town issues the permit; on sewer, the town’s sewer hook-up permit applies. Flood-zone work needs the town floodplain permit and an elevation certificate, and land disturbance of one acre or more needs a stormwater pollution prevention plan approved under chapter 230.
Zoning also limits what can go where. The districts include an Oneida Lake Recreational Overlay District along the lake, and no accessory building may go on a vacant lot, except that a standalone building such as a garden shed or sugar house may be allowed by Planning Board special use permit on a lot of at least five acres in the Agricultural, Business, Industrial and LR-40 districts south of State Route 31. It is limited to 400 sq ft and 12 feet high unless the board approves more, and one built ahead of a house needs a deposit, the house plans and a signed promise to build the house within a year.
Land mapped in the Resource Management Overlay District, which covers flood hazard areas, wetlands, steep slopes and certified agricultural districts, goes to the Planning Board for resource-management site plan review under section 275-11; no structure may sit on a slope steeper than 25%, and accessory buildings under 400 sq ft and expansions of no more than 50% that need no added parking are exempt from that review.
Rather talk it over?
Call 1-855-478-4290 →Town of Sullivan building permit fees
The Town Board sets building permit fees by resolution under section 123-17, and the office gives the fee when it reviews the application; its page says to call for building permit information. The application has separate lines for the permit fee and a sewer connection fee, and pools are charged the regular building permit fee under chapter 240.
| Item | Rule or charge |
|---|---|
| Building permit | Town Board fee schedule; quoted by the office |
| Sewer connection | Separate fee line on the application |
| Permit not completed in its time frame | 100% recharge of all permit fees and the deposit is forfeited |
| Board applications (site plan, variance, subdivision) | Deposit with the Comptroller; consultant costs reimbursed |
| Moratorium hardship relief | $250 filing fee plus the town’s costs |
| Septic system | Madison County review of engineered plans, then the town permit |
The completion rule is the one most likely to cost money: the department warns that a permit not finished within its time frame is recharged in full and the deposit is lost, so plan the schedule before you apply.
Trade permits and who may pull them
Sullivan has no local electrician, plumber or contractor license. All electrical work must be inspected by a third-party agency the town approves, and pools need an electrical inspection as well. The 2024 list names Upstate Electrical Inspection Agency, Central New York Electrical Inspection Services, The Inspector, Commonwealth Electrical Inspection Service and Atlantic-Inland Inspection Agency. Plumbing and mechanical contractors are named on the building application rather than permitted separately.
Wood and pellet stoves, fireplaces and chimneys use their own solid-fuel permit application. Septic installers work from plans stamped by an engineer and approved by Madison County first; the county also observes percolation and deep-hole tests (315-366-2526).

Review, corrections and what causes delay
An application missing anything on the handout is not processed, and unlisted work needs its own application. Time limits are tight. Section 123-3 of the adopted code makes a permit invalid if the work has not started within 30 days of issue and has it expire six months after issue, or 12 months for residential construction; the older application instructions still print a six-month start and a 12-month term, so plan on the code’s 30-day start. Renewals need an application, a fee and the code officer’s approval.
Town of Sullivan inspections and certificates
The approved plans and permit stay on site for inspection. The town inspects the stages listed on the permit, the electrical agency inspects wiring, and Madison County oversees septic testing. No building may be used until the department issues a certificate of occupancy, and the town can withhold a certificate of occupancy or compliance for code violations or for unpaid consultant costs under chapter 140. Section 275-18 has the certificate applied for together with the zoning permit and issued within 10 days after the work is approved; a temporary certificate, for emergencies or hardship only, lasts up to six months and can be renewed no more than three times. Violations of chapter 123 carry fines of up to $200 a day.
Under chapter 240, amended in 2024, pools must meet the state code, generally empty onto the owner’s own land, and have lighting shielded so it does not shine on neighbors. Residential fences may be 4 feet high in front and side yards and 6 feet in rear yards, at least 1 foot from every lot line with the finished side out; on lakefront lots the lake side is limited to 4-foot chain link or split rail that leaves at least 80% of the view open.

Town of Sullivan permit FAQ
Does the town issue permits in Chittenango?
No. The Village of Chittenango has its own codes office (315-687-5143) and its own building, pool, fence and sign permits.
Do I need a permit for a shed?
Yes. A shed of up to 144 sq ft is exempt from the building permit under chapter 123, but zoning section 275-18 requires a permit before any structure goes up, so every shed needs one.
How high can my fence be?
4 feet in front and side yards and 6 feet in the rear yard of a residential lot, at least 1 foot off the line, and every fence needs a permit.
How much is a building permit?
Fees are set by Town Board resolution and quoted by the office at 315-687-5251. A permit not completed on time is recharged in full and the deposit forfeited.
Who approves septic systems?
The Madison County Health Department approves engineer-stamped plans first; the town then issues its septic permit.
Can a data center be built in Sullivan?
Not while Local Law 6 of 2026 is in force: it bars new data centers, data storage and cryptocurrency mining for 12 months from July 1, 2026.
Is Sullivan in the flood insurance program?
Yes. FEMA lists the Town of Sullivan and the Village of Chittenango as participating communities; town floodplain work needs a floodplain permit and elevation certificate.
Town of Sullivan permit search and official resources
The town has no online permit search. Ask the Building, Planning & Zoning office about a property’s permit history, or file the town’s Freedom of Information Law request form. Short-term rental rules (proposed Local Law D-2026) have not been adopted in any posted minutes; the continued public hearing is on the agenda for the Town Board’s November 4, 2026 meeting.
