In unincorporated Dickinson County, Zoning and Environmental Health at the courthouse, 1802 Hill Ave, Suite 2101, Spirit Lake (712-336-6333, option 2), issues the certificate of zoning compliance needed before a building is put up or structurally altered, plus lakeshore landscaping, floodplain and septic permits. The zoning fee runs from $50 to $825 by project value, so $660 for a $300,000 house, and the permit checks setbacks, lot coverage and drainage rather than construction details.
What requires a permit in unincorporated Dickinson County?
Zoning Ordinance 102 says no building or structure that is put up or structurally altered may be occupied or used until the zoning office has issued a compliance permit, and the same applies to a change of use. The permit must be obtained before construction, moving in or structural alteration starts.
Permit needed
- New houses, cabins and manufactured homes (with the manufactured homes addendum)
- Additions and structural alterations
- Garages, sheds and other accessory buildings
- Buildings moved onto a lot
- A change in the use of a building
- Landscaping, stripping, burning or chemical defoliation of a lake shoreline bank (landscaping permit)
- Development in a mapped floodplain (floodplain permit)
- Septic systems (Board of Health permit)
No compliance permit
- Portable recreation structures such as doghouses, treehouses, playhouses and playground equipment
- Land and buildings primarily used for agriculture (non-farm uses by farmers still need a permit)
- Work inside the ten incorporated cities
Fences in residential districts may be 4 feet high in a required front yard and 6 feet in side and rear yards, with taller fences allowed around tennis courts and swimming pools, and the finished side must face out. Accessory buildings must stay 3 feet from side and rear lot lines (5 feet from side lines in the R-4 Lakeshore district), 10 feet from any road and 6 feet from other buildings. Every principal building needs at least 30 feet of frontage on a public road.
What the county decides and what the state holds
The county’s own rules for the lakes area sit in Zoning Ordinance 102: an R-4 Lakeshore Residential district (7,000-square-foot minimum lots for houses and duplexes and a 30-foot front setback or the alignment of the two nearest buildings), a 75% cap on ground covered by buildings, driveways, patios and other hard surfaces in residential and resort districts, a keyhole rule requiring 25 feet of water frontage for each lot or unit sharing a lake access lot and at least 100 feet in all, water quality management plans when an acre or more is disturbed, and Article 23 on landscaping of lakeshore property. The ordinances the county posts include no building code, and its pages describe the permit as a zoning and site review. Energy code, trade licensing and electrical inspections are state matters.

Dickinson County permit types
The applications page carries the certificate of zoning compliance, a manufactured homes addendum, the lakeshore landscaping permit, the floodplain development permit, the private sewage disposal system application, and Board of Adjustment variance and conditional use applications, along with the form to change zoning district boundaries. Incomplete applications are returned.
Residential permits
The compliance application asks for the contractor’s state ID number, the 911 address, the legal description and subdivision lot, whether the improvement is agricultural, whether it is in a floodplain, the lot area and width, the height, parking spaces, total and new impervious surface, whether the lot is in a drainage district, whether a driveway is needed, the area to be disturbed and the setbacks. It must come with a scale site plan showing the plat, distances from the new building to each property line and to other structures, driveways, fences and other features, a drainage plan, the septic and well locations, easements and the share of the lot covered by hard surfaces; elevation drawings of all four sides; a plat or aerial copy; and proof that the lot was not divided into a non-conforming lot after zoning began. Before the permit is issued, the owner must mark the lot pins and the outside building corners on site.

Commercial, resort and industrial projects use the same certificate, with parking and loading required by the ordinance. Uses listed as conditional need Board of Adjustment approval ($500), planned unit developments and wind energy conversion systems carry an $825 additional fee, and multi-family buildings pay $300 per unit.
For tenant improvements and new commercial builds, Alliance handles commercial building permits through issuance. More on this: commercial building permits explained.
What comes before the building permit
- Drainage and stormwater. Every application needs a drainage plan. When an acre or more will be disturbed, a vacant lot will exceed 60% hard surface, or an improved lot will gain 25% or more, the plan must meet the statewide urban design standards (SUDAS), infiltrate 1.25 inches of runoff and be designed by a licensed engineer.
- Shoreline. Work on the bank between the ordinary high water mark and the front setback line needs a landscaping permit first.
- Floodplain. The floodplain application lists the base flood elevation, the required and proposed lowest-floor elevations and any Iowa DNR, U.S. Army Corps of Engineers or erosion control permits.
- Data centers. The Planning and Zoning Commission discussed a moratorium in July 2026 and was still drafting a data center ordinance on its October 19, 2026 agenda.
Dickinson County permit costs and fees
The zoning ordinance leaves fees to Board of Supervisors resolution. The current schedule is printed on the zoning compliance application posted in September 2025 with updated fees; it is a flat fee per value band, not a rate.
| Estimated cost of structure | Fee |
|---|---|
| $0 to $500 / $501 to $2,500 | $50 / $75 |
| $2,501 to $5,000 / $5,001 to $10,000 | $100 / $125 |
| $10,001 to $50,000 | $250 |
| $50,001 to $100,000 | $330 |
| $100,001 to $250,000 | $495 |
| $250,001 to $500,000 | $660 |
| $500,001 to $1 million / over $1 million | $750 / $825 |
| Multi-family | $300 per unit |
| Variance / conditional use / administrative review | $500 each |
| Rezoning / plat filing | $250 / $600 |
| Wind energy system or planned unit development (added fee) | $825 |
| Lakeshore landscaping permit | $50 plus $2 per $100 of value, maximum $600 |
| Private sewage disposal (septic) permit | $150 |
Rather talk it over?
Call 1-855-478-4290 →Worked example: a $300,000 lake home falls in the $250,001 to $500,000 band and pays $660; a $40,000 garage pays $250. City, county, state and federal governments pay no zoning fees. Article 23 of the ordinance still caps the landscaping fee at $300, while the 2025 schedule caps it at $600; on July 20, 2026 the Planning and Zoning Commission voted 6–0 to recommend amending Article 23 so the cap follows the supervisors’ current fee schedule. That vote is a recommendation; no supervisors’ minutes adopting it are posted on the county pages read, so ask the office which cap applies. Checks are payable to Dickinson County Zoning.
Trade permits and who may pull them
Dickinson County’s pages describe no county electrical, plumbing or mechanical permit and no construction inspections. Electrical work outside the cities is permitted and inspected through the State of Iowa electrical program at the Department of Inspections, Appeals, and Licensing; trade licenses are state licenses, and contractors earning $2,000 or more a year from construction register with that department; the zoning form asks for the contractor’s state ID number.
- Septic systems. The Board of Health application lists the owner, the site, the number of bedrooms, the contractor, the system type and a percolation report, while the soil analysis is done by the county office. Installation may not begin until the permit is issued, the office must be called at 712-336-2770 ext. 2 at least 48 hours before installation for a site visit, and the contractor or homeowner supplies an as-installed drawing afterward.
- Wells. The county’s wells page posts the Iowa DNR forms for plugging abandoned wells, recording well rehabilitation and private well water testing.
- Road and drainage work. Utility construction in the right of way, work in the right of way, oversize trips and drainage district permits go through the Engineer’s office.

Make sure the lot is outside the ten cities, and check its zoning district and flood zone.
Apply for a rural address through 911 administration and an entrance permit from the Engineer if a driveway is needed.
File the septic application and have a drainage plan, engineered where the stormwater thresholds apply.
Show every setback, hard surface and the septic and well, plus drawings of all four sides.
Mark the lot pins and building corners, then submit the compliance application and fee to the zoning office.
Post the permit within 10 days of issue and keep it up until construction is done; arrange the state electrical permit.
Review, corrections and what causes delay
The ordinance has compliance permits issued to complying applicants within seven days. Missing drawings, unmarked lot pins or doubtful lot lines, for which the Zoning Administrator may order a survey by a certified land surveyor, are common reasons for delay. Variances, conditional uses and rezonings need hearings; the Planning and Zoning Commission met at 1:00 pm on July 20, September 21 and October 19, 2026, the October meeting at the Maser Monarch Lodge in Okoboji.
Inspections in Dickinson County
The compliance permit does not include framing, plumbing or mechanical inspections. The application requires the lot pins and outside building corners to be marked on the ground, and the activity allowed by the permit must start within six months or the permit expires; within one year of issue every exterior part of the building must be finished and the lot brought to final grade, clear of construction and excess earth.
For a lakeshore landscaping permit the office reviews the application and inspects the site within 14 days. Septic installations get a site visit booked 48 hours ahead. In the floodplain, the owner must give the office certification from a professional engineer or land surveyor registered in Iowa that the fill, floor elevations or floodproofing were built as required before the building is used. The Engineer’s entrance form records whether a culvert is required, limits paved entrances to 32 feet wide and unpaved ones to 60 feet, and requires the entrance to be shaped so water from the property does not drain onto the road.
Iowa building code
Dickinson County enforces Zoning Ordinance 102 with its lakeshore, stormwater and keyhole rules, its subdivision and nuisance ordinances and Flood Plain Ordinance 22-3, adopted on September 13, 2022; none of the ordinances it posts is a building code for the unincorporated area. FEMA’s Community Status Book lists Dickinson County as participating in the National Flood Insurance Program, with flood maps effective September 29, 2022.
Iowa lets most cities and counties adopt the state building code, another code or none (a city of more than 15,000 must enforce at least the state code), but the energy, accessibility, fire, plumbing, mechanical and electrical rules apply statewide. Iowa rules
