In unincorporated Buena Vista County, the Zoning and Environmental Health office at the courthouse, 215 E. 5th St., Storm Lake (712-749-2555), must review a zoning compliance permit application before any structure is built, farm buildings included, and issues floodplain, septic and well permits. The permit checks land use and setbacks rather than construction details, and each of the county’s ten cities runs its own permits.
What requires a permit in unincorporated Buena Vista County?
The county’s zoning page is direct: before any structure is built outside city limits, whether or not it is part of a farming operation, an application for a zoning compliance permit goes to the Zoning Administrator for review. The zoning ordinance applies the same permit to buildings that are erected, enlarged, altered or moved and to a change of use.
Zoning compliance permit
- New houses and manufactured homes
- Additions and expansions of buildings
- Garages, sheds and other accessory buildings
- Businesses and industrial buildings
- Moving a building onto a lot
- Wind energy conversion systems, under their own ordinance
Exempt, after review
- Buildings the office determines are for agricultural purposes, which receive an exemption with no requirements placed on them
- Work inside any of the ten incorporated cities, which have their own rules
The application asks whether the land is used for crops, livestock, eggs, milk, fruit or trees, or for a dwelling or business, so the agricultural determination is made on the same form. The ordinance defines a farm as an area of 10 acres or more used for the usual farm products.
What the county decides and what the state holds
Buena Vista County first adopted zoning in 1966. The zoning ordinance it posts is Ordinance 6.1 in the 2003 Code of Ordinances, which replaced the 1966 ordinance, alongside a subdivision ordinance, a 2011 floodplain management ordinance, a wind energy conversion system ordinance, the septic ordinance (5.3) and nuisance and dangerous-building ordinances. The ordinances the county posts include no building code, and its pages describe the permit as a check of district, use, lot size and setbacks. On September 8, 2026 the Board of Supervisors approved a recodification of the county ordinances after a public hearing, with updated terminology; the posted zoning text is still the 2003 edition. The state energy code, trade licensing and electrical inspections apply under state law.
Buena Vista County building department: who handles permitting
Ben Mueggenberg directs Zoning and Environmental Health and was appointed Zoning Administrator and floodplain coordinator at the board’s January 2, 2026 reorganizational meeting, so zoning, floodplain, septic and well permits all start in one courthouse office. The County Engineer handles driveways and work in county road right of way, and the county E911 office handles rural addresses and signs.

Cities in Buena Vista County
The county ordinance covers only land outside city limits; each incorporated city handles permits inside its own boundaries, and the county’s zoning page tells city residents to check with their city office.
| City | Who handles building permits |
|---|---|
| Storm Lake (11,590) | City Building and Code Compliance Department, with its own codes and electrical and plumbing permits |
| Alta (1,958), Newell (814), Sioux Rapids (694), Lakeside (684), Albert City (601) | Each city under its own rules |

Buena Vista County permit types
The zoning office posts printable forms: the zoning compliance permit application, a variance petition and a special use petition for the Board of Adjustment, and a zoning petition for rezonings. Subdivisions follow the county subdivision ordinance whenever a parcel is split or a new lot created.
Residential permits
A rural house needs the zoning compliance permit, a septic permit unless sewer is available, a well permit if a private well is drilled, a driveway or field entrance approval from the County Engineer for a new access onto a county road, a 911 address, and a state electrical permit. The application names the owner of the building and the owner of the land, gives the legal description by quarter, section, township and range, and lists the lot size, the setbacks from the right-of-way line and each lot line, the number of rooms, the height and size, the cost, and whether the building contains a toilet, sink or laundry. A site layout must show the lot, the building’s location, size and height, and the intended use.

Commercial permits
Businesses use the same zoning compliance permit; commercial buildings belong in the C-1 district and industrial operations in I-1, and the site layout must also show parking, loading spaces and employee and customer numbers. Animal feeding operations are reviewed by Environmental Health, including the Master Matrix evaluation for new construction, and the office keeps manure management plans for public viewing.
For tenant improvements and new commercial builds, Alliance handles commercial permit filing through issuance. More on this: commercial building permits explained.
What comes before the building permit
- Zoning approvals. Variances and special uses go to the Board of Adjustment by petition; rezonings go through the Planning and Zoning Commission, which recommends, to the Board of Supervisors, which adopts them by ordinance.
- Septic and well. Both permits are issued by the same office, and a new well must be permitted before drilling.
- Floodplain. Development in the mapped floodplain needs a floodplain development permit from the Zoning Administrator, who acts on it within 14 days.
- Road access. Driveways and field entrances on county roads are approved by the County Engineer.
Buena Vista County permit costs and fees
The zoning ordinance leaves permit fees to the Board of Supervisors, which sets them by resolution outside the ordinance-amendment process; the county does not post the current zoning fee schedule online, and the fee is entered on the application when it is reviewed. Environmental Health posts one fee on its well page.
| Item | Fee or rule |
|---|---|
| Zoning compliance permit | Set by Board of Supervisors resolution; quoted by the zoning office |
| Agricultural building determined exempt | Exemption granted; no requirements placed on the building |
| Private well permit (drinking, heat pump, livestock, monitoring wells) | $125 |
| Private well water tests through the state grant program | Free while grant funds last |
| Building without a permit | Fine of up to $500 or up to 30 days in jail per offense, each day a separate offense |
Rather talk it over?
Call 1-855-478-4290 →Timing matters as much as cost: a zoning compliance permit is void unless the project is ready for its first inspection within 180 days of approval. Septic permit and floodplain permit fees are not posted; ask the office when you apply. For driveways, the County Engineer approves the entrance before it is built.
Trade permits and who may pull them
Buena Vista County’s pages describe no county electrical, plumbing or mechanical permit and no construction inspections. Electrical work in the unincorporated area is permitted and inspected through the State of Iowa electrical program run by the Department of Inspections, Appeals, and Licensing. Contractors earning $2,000 or more a year from construction register with that department; trade licenses are state licenses.
- Septic installers work under the owner’s county septic permit. The size of each system follows state rules based on soil type and bedrooms; a soil analysis sets the drainfield length, the number of bedrooms sets the tank size, and every system needs prior approval and an inspection before it is completely installed.
- Well drillers must be state certified and arrange the county well permit before starting work; a penalty may apply if no permit is obtained, and a well that does not meet standards may have to be filled. On September 1, 2026 the supervisors approved a 28E agreement with the Iowa DNR on well permits.
- Time-of-transfer inspectors certified by the Iowa DNR inspect septic systems before a home or building on a septic system is sold; the county posts the worksheet and the waivers for a new installation, demolition or a future inspection.
How to apply for a Buena Vista County permit
If the land is inside one of the ten cities, apply to that city instead.
Ask at 712-749-2555 about the district, setbacks and whether the building qualifies as agricultural.
Have your driller arrange the well permit and apply for the septic permit with a soil analysis.
Request driveway or field entrance approval from the County Engineer and a 911 address from E911.
Submit the application and site layout to the courthouse office and pay the fee set by the board.
Have the electrician buy the state electrical permit, and call the zoning office when the foundation is staked out.

The office checks the agricultural status, district, lot size and setbacks, and any building height or accessory-structure rules, and refers lot splits to the subdivision ordinance. Projects that need a variance, special use or rezoning wait for hearings: a rezoning is adopted as an ordinance read at more than one supervisors’ meeting, and the October 2026 minutes show one such rezoning moving from its first to its second reading. Floodplain sites also need any federal or state permits, including Iowa DNR approval where required.
Inspections in Buena Vista County
The zoning ordinance requires the Zoning Administrator to inspect the lot and building twice: when the building foundation is staked out and when the work is complete. The permit holder must tell the office when the site is ready, and failing to give that notice cancels the permit, so a new permit is needed before work continues. After the final inspection the office issues an occupancy permit, and no building that needed a zoning permit may be used until it has one.
These inspections check that the building, its use and its location match the approved application, not the framing, plumbing or mechanical work. Environmental Health inspects septic systems before they are completely installed and checks the location and setbacks of new wells; wiring is inspected by the state electrical inspector under the state permit. In the floodplain, the lowest floor including any basement must be at least 1 foot above the 100-year flood level, on compacted fill at that height extending at least 18 feet beyond the building unless the county allows another method such as piers.
Iowa building code
Buena Vista County enforces its zoning, subdivision, floodplain, wind energy, septic, nuisance and dangerous-building ordinances, and none of the ordinances it posts is a building code for the unincorporated area. FEMA’s Community Status Book lists Buena Vista County as participating in the National Flood Insurance Program, with a current effective map dated October 13, 2022.
Iowa lets most cities and counties adopt the state building code, another code or none (a city of more than 15,000 must enforce at least the state code), but the energy, accessibility, fire, plumbing, mechanical and electrical rules apply statewide. Iowa rules

Do I need a permit to build outside city limits in Buena Vista County?
Yes. A zoning compliance permit application must be reviewed before any structure is built, even on a farm; buildings found to be agricultural are then granted an exemption.
Does Buena Vista County have a building code or building inspector?
The ordinances the county posts include no building code. Its inspections check the staked location and the finished building against the zoning permit, not construction details.
How much is a county zoning permit?
The fee is set by Board of Supervisors resolution and is not posted online; call the zoning office at 712-749-2555. A private well permit is $125.
Who issues electrical permits in rural Buena Vista County?
The State of Iowa electrical program; the county pages list no county electrical permit or inspector.
How long is a zoning compliance permit good for?
It is void unless the project is ready for its first inspection within 180 days, and missing the inspection notice cancels it.
How high must a house in the floodplain be?
The lowest floor, including the basement, must be at least 1 foot above the 100-year flood level, under a floodplain development permit.
Who handles permits in Storm Lake or Alta?
The city itself. Storm Lake’s Building and Code Compliance Department and each other city office handle permits inside city limits.
