In the unincorporated parts of Iowa’s largest county by area, Kossuth County Planning and Zoning at the Courthouse Annex, 109 W. State St., Algona (515-295-3813), regulates all non-farm uses and construction. A zoning compliance permit costs $35, a new house in the A-1 district needs at least 5 acres, and the Zoning Administrator, who is also the county sanitarian, inspects the finished building before issuing an occupancy permit.
What requires a permit in rural Kossuth County?
The county’s zoning page says its zoning, subdivision and floodplain ordinances let it regulate all non-farm uses and construction outside the 13 cities. Under Article XXII of the zoning ordinance the Zoning Administrator issues zoning certificates and occupancy permits: no new building or addition may be occupied, and no vacant land put to use, until an occupancy permit has been issued, and every application for a building permit counts as an application for one.
Zoning compliance permit needed
- New non-farm houses, garages and other buildings
- Remodeling and additions
- Commercial and industrial buildings
- Using vacant land for a new purpose
- A change from one use to a different kind of use
- Utility-scale solar projects (Ordinance 320-C)
Outside the zoning permit
- Farm uses and farm buildings
- Land inside Algona and the other incorporated cities
- Driveways and work in road right-of-way, handled by the County Engineer’s permits
In the A-1 Agricultural district a single-family house is allowed on a lot of at least 5 acres and 300 feet wide, set back 80 feet from state and federal roads or 60 feet from other public roads, 30 feet from side lines and 100 feet from the rear line, and no taller than 2½ stories or 30 feet. Accessory buildings may stand only in the rear yard, may cover less than 30 percent of it and are limited to 15 feet in height there. Livestock confinement feeding is not allowed within 1,200 feet of a residential district.
What the county decides and what the state holds
The zoning ordinance dates from 1973, when the supervisors applied it to all territory outside the incorporated municipalities; staff retyped it in 2013 and the board has amended it since, most recently with Ordinance 320-C on utility-scale solar energy systems, adopted on March 24, 2026. It sets a minimum floor area of 600 square feet for a one-story dwelling but is not a building code, and the county pages name none. Septic systems and wells are covered by the county’s sanitary sewer and well ordinance and the state rules the sanitarian enforces.

The supervisors appointed Corey Petersen as Zoning Administrator for 2026 on January 2, 2026, and the zoning compliance permit form (March 2025) also names him; the county’s zoning web page still lists Luke Snyder as Zoning Administrator. Later 2026 minutes show Corey Petersen also serving as county sanitarian (environmental health director) and weed commissioner, so zoning, septic and well questions go to the same annex office and phone number. The County Engineer handles entrances, utility crossings and tile crossings in the road right-of-way; its permit forms are printed, filled in and returned by mail, email, fax or in person.

| Algona (5,309), the county seat | The city |
| Bancroft (673), Swea City (541), Titonka (492), Whittemore (476), Burt (399), Wesley (379) | Each city under its own ordinances |

Kossuth County permit types
The Zoning Compliance Permit is a printable form: complete the top section, draw or attach an accurate sketch, sign it as owner or authorized agent, and mail or bring it with a $35 check payable to the Kossuth County Treasurer to the Zoning Administrator at the annex. It asks whether you will construct or remodel, the type of improvement, the quarter, section, township, range, civil township and parcel number, the estimated cost, the lot size and front and rear widths, setbacks from the right-of-way and the side and rear lines, the present land use and zoning, and the building’s rooms, stories, height and size.

The ordinance asks for plans in duplicate and a plot plan drawn to scale showing the lot’s shape and dimensions and the building’s exact location, size and height, its existing and intended use and the number of families; one approved copy is signed and returned with the permit. Any lot pins disturbed by grading must be reset before construction. Permanent dwellings are not allowed in the F-1 Flood Plain district, where agriculture, parks, ball fields, private recreation areas and essential services are the permitted uses and shooting ranges, gravel pits and quarries need Board of Adjustment approval with extra distance from neighbors.

Commercial permits
Businesses use the same permit and district rules. Landfills, golf courses and riding stables, airports and sand and gravel mining in the A-1 district need Board of Adjustment approval, and utility-scale solar must meet Ordinance 320-C. In 2026 the supervisors also moved to repeal Ordinance 300A on hazardous liquid pipelines (first reading of Ordinance 300B on June 9), and on October 6 they discussed a possible ordinance or moratorium for data centers; none had been adopted in the minutes posted.
For tenant improvements and new commercial builds, Alliance handles commercial permit filing through issuance. More on this: commercial building permits explained.
What comes before the building permit
- Septic and well. Permits from the sanitarian at the same annex office.
- Entrance. The County Engineer’s entrance permit for a new, relocated or widened driveway.
- Address. A 911 address through the county’s 911 Joint Service Board.
- Zoning relief. Appeals, special exceptions and variances go to the Board of Adjustment and rezonings to the Planning and Zoning Commission; neither meets on a regular schedule, so a meeting is called when a request is filed. The five-member Board of Adjustment, a majority of whom live in the unincorporated county, may grant a variance only for an unnecessary hardship that is physical rather than economic and only where it would not be contrary to the public interest; the Planning and Zoning Commission advises the supervisors on the master plan, the zoning and subdivision ordinances and rezonings.
Kossuth County permit costs and fees
The county’s fees for a rural build are simple on the zoning side and cost-based on the road side.
Rather talk it over?
Call 1-855-478-4290 →| Item | Fee |
|---|---|
| Zoning compliance permit (form dated March 10, 2025) | $35, payable to the Kossuth County Treasurer |
| Entrance permit | No permit fee printed; the applicant reimburses the county’s costs, including culvert pipe priced per foot |
| Septic and well permits | Set by the county; amounts not printed on the sanitarian page |
| GIS data requests | $25 minimum, $50 per hour |
The $35 fee is flat; the form asks for the estimated construction cost but does not scale the fee to it, so a $15,000 detached garage on an acreage and a $400,000 house both pay $35. On the entrance permit you choose whether a private contractor or the county road department builds the drive; either way the county inspects the site first, decides whether a culvert is needed and its length and diameter, estimates the truckloads of fill, and bills the applicant for any county work promptly after it is done.
Violating the zoning ordinance can bring fines, with each day counted as a separate offense, and the County Attorney may go to court to stop illegal construction or use.
Trade permits and who may pull them
Kossuth County’s pages describe no county electrical, plumbing or mechanical permits. Electrical permits and inspections outside the cities therefore come from the state (DIAL) before wiring begins, and plumbers and heating contractors work under their state licenses.
- Septic systems need a permit from the sanitarian, who works under the state’s onsite wastewater rules (IAC 567 chapter 69) posted on the sanitarian page and the county’s sanitary sewer and well ordinance.
- Wells need a sanitarian well permit; the office also takes water samples.
- Utility and tile work in the road right-of-way needs the Engineer’s utility accommodation permit or must follow the tile crossing policy.
The zoning compliance permit names both owner and contractor and may be signed by the owner or an authorized agent under penalty of perjury.

The administrator checks the application against the district rules; a lot under 5 acres for a house in the A-1 district, a site in the flood plain or a use that needs Board of Adjustment approval will hold it up. Because the boards meet only when an appeal or request is filed, a variance or rezoning takes longer than a routine permit. If an occupancy permit is refused, the reasons must be sent in writing within 14 days of the request.
Inspections in Kossuth County
Kossuth County’s ordinance includes a final zoning inspection. No occupancy permit for a building may be issued until construction is complete and the Zoning Administrator has inspected the premises and certified that they match the plans and specifications the certificate was based on. A temporary certificate valid for up to six months may be issued while an addition is finished or the building is partly occupied, and short temporary occupancy permits of up to 10 days are available for events such as carnivals or revival meetings.
The county pages list no framing or trade inspections. The sanitarian handles septic and well permits, the Engineer’s staff inspect each proposed entrance before approving it, and wiring is inspected by the state electrical inspector. The sanitarian also reviews master matrix scoring and required separation distances for proposed livestock confinement sites; in April 2026 the supervisors heard two such sites with the sanitarian’s letters confirming the scoring and setbacks were met.
Iowa building code
Kossuth County regulates rural building through its 1973 zoning ordinance and amendments, its subdivision and floodplain management ordinances and the sanitarian’s septic and well permits; the county pages name no building code. FEMA’s Community Status Book lists Kossuth County as participating in the National Flood Insurance Program, with its first flood insurance rate map dated May 1, 1992 and a current map dated March 20, 2018.
Iowa lets most cities and counties adopt the state building code, another code or none (a city of more than 15,000 must enforce at least the state code), but the energy, accessibility, fire, plumbing, mechanical and electrical rules apply statewide. Iowa rules

The Zoning Administrator keeps permanent records of maps, nonconforming uses, amendments, variances, appeals and applications, and issued certificates, so permit history for a parcel can be requested from the office. Supervisors’ minutes and the zoning boards’ agendas and minutes are posted on the county site, and parcel lines, zoning research and ownership can be checked through the assessor’s parcel search and the county’s interactive GIS map; printed GIS maps up to 36 by 48 inches are sold at the courthouse.
