Winnebago County, Iowa Building Permit Guide

To get a building permit in Winnebago County, confirm which office issues permits for the property’s address, then submit the application with your plans and required documents, pay the permit fees, and pass inspections before final approval. Alliance Permitting can prepare, file and track the permit for you and schedule the inspections.

Winnebago County’s Zoning Administrator in the Forest City courthouse issues $10 zoning certificates for rural building; septic ($200) and well ($175) permits come from Environmental Health, and driveways need an approved contractor.

Outside Forest City, Lake Mills and the other cities, Winnebago County requires a zoning certificate from the Zoning Administrator before a non-farm building is built or added to; call 641-585-0999 for an appointment at the courthouse in Forest City. The application fee is $10, the sanitarian must approve the septic system before the certificate issues, and Environmental Health charges $200 for a septic permit and $175 for a well permit.

What requires a permit in rural Winnebago County?

Section 1.51 of the county zoning ordinance says no building or other structure, or part of one, may be erected or added to without a zoning certificate from the County Zoning Administrator, and the county’s zoning page asks anyone planning construction, reconstruction, alterations or a change of use to contact the administrator first. The application form lets you apply to build, to alter or to occupy a building.

Zoning certificate needed

  • New houses and other non-farm buildings
  • Additions to buildings
  • Non-farm garages and sheds, which stay out of the front yard and 5 feet from side and rear lot lines
  • Occupying or changing the use of a building
  • Any farm or other structure, dam, fill or excavation in a floodplain
  • A new driveway (Road Department permit)

No zoning certificate

  • Farm buildings, farmstead dwellings, farm fences, farm ponds and soil conservation work
  • Building, remodeling or expanding anything customarily tied to farming
  • Land inside the seven cities

Section 1.04 adds a catch: farm projects need no certificate, but all other new construction and building expansions must be reported to the Zoning Administrator before work starts. A deck no higher than the first floor may extend into a required yard if it stays 2 feet from the side lot line, and a detached non-farm accessory building may take up no more than 30 percent of the rear yard and may not be used unless the main building is occupied.

What the county decides and what the state holds

The county sets its own minimum house standards in the zoning ordinance: a single-family home must be at least 22 feet wide on three or more outside walls and have at least 800 square feet of floor space, sit on a full frost-free perimeter foundation (pier footings only with an engineer’s or architect’s certificate), and a non-farm house may not be built within 200 yards of a public hunting area. Beyond these rules the county pages describe no building code or construction inspections; septic and well standards come through Environmental Health.

Winnebago County building department: who handles permitting

Zoning Administrator Matt Duve runs the zoning office, which sees visitors by appointment. Environmental Health, part of Public Health, issues septic and well permits; the Road Department controls driveways and other work in the county right-of-way.

Winnebago County permit types

The county posts one zoning application, sent to the zoning office by email or delivered in person. It asks for the parcel number or the quarter, section, township and range, the type of improvement and its dimensions, the lot size, the setback from the front right-of-way line and from each side and rear lot line, the type of sanitary disposal with the septic tank permit number, whether the work is new, an alteration or an addition, and the number of families. A sketch of the lot with the proposed buildings and their distances to all boundaries goes with it.

Residential permits

For a new rural home, the septic permit comes first: the ordinance makes the sanitarian review and approve sewer facilities for any residential, commercial or industrial use before a zoning certificate issues, and contractors must keep the septic permit on hand to show the Zoning Administrator. Every new building must sit on a lot next to a public road, unless it is on a private road approved before the ordinance took effect.

Commercial permits

Commercial and industrial projects in the C, LI and HI districts use the same certificate; uses needing a special exception or variance go to the five-member Board of Adjustment, and rezonings to the five-member Planning & Zoning Commission and the supervisors. The commission’s members serve without pay other than mileage, recommend action to the supervisors on every zoning matter and act as a coordinating body for planning that affects the individual communities and the county as a whole. In September and October 2026 the supervisors discussed amending the zoning ordinance to cover solar, battery fields, crypto mining and data centers, including corn suitability (CSR) limits, noise, setbacks and decommissioning; on October 13 they agreed to keep researching, and no amendment or moratorium had been adopted in the minutes posted.

What comes before the building permit

  • Septic and well. Environmental Health permits, with the septic permit number written on the zoning application.
  • Driveway. A Road Department permit, applied for at least seven days ahead and built by an approved contractor.
  • Floodplain. Development in a mapped flood hazard area is regulated under Floodplain Management Ordinance No. 44.
  • Zoning relief. Appeals of the administrator’s decisions must be filed within 10 days; hearings are advertised 4 to 20 days ahead.

Winnebago County permit costs and fees

Section 1.51 leaves zoning certificate fees to a resolution of the supervisors, and Section 1.74 says the fee schedule is posted in the Zoning Administrator’s office and no action is taken until fees are paid. The fee printed on the current application form is $10.

A rural home with its own well and septic system therefore pays $10 plus $200 plus $175, or $385, in county permit fees, plus the cost of the driveway work. The Environmental Health page also lists amounts the Private Well Grants program can help with: up to $400 for shock chlorination, $600 for a well assessment, $700 for plugging and $2,000 for reconstruction.

The application form says a zoning certificate expires two years after it is issued. The ordinance is more specific: the two years apply if work starts within 180 days, and the certificate lapses after 180 days if construction has not substantially begun; the Zoning Administrator may grant extensions in writing for good cause.

Trade permits and who may pull them

Winnebago County’s pages describe no county electrical, plumbing or mechanical permits. Electrical permits and inspections in the rural county therefore come from the state (DIAL) before wiring starts, and plumbing and heating contractors work under their state licenses.

  • Building contractors on any project with a septic system must get the septic permit from the county sanitarian and keep it available for the Zoning Administrator.
  • Well drillers need the $175 county well permit through Environmental Health.
  • Right-of-way contractors. Because of widespread non-compliance with permit conditions, the county now requires a contractor on its approved list for every driveway and all other work in the right-of-way; work-in-the-right-of-way permits are usually reviewed within two business days, while utility permits also go to the supervisors.

The zoning application itself is signed under oath by the owner or an agent.

Review, corrections and what causes delay

The administrator approves or denies the application and can issue a non-conforming certificate only on written order of the Board of Adjustment. A request that needs the board, such as a variance or a special exception, waits for a hearing advertised 4 to 20 days in advance; the board met on September 28, 2026 at 4:00 p.m. to hear a zoning application for an agricultural use near Lake Mills. Missing septic approval is the most direct cause of delay, because the certificate cannot be issued without it.

Inspections in Winnebago County

The zoning office checks proposed construction for compliance with the ordinance, and the county pages list no framing, plumbing or final building inspections for rural homes. Septic systems are reviewed by the sanitarian, the Road Department oversees driveway construction for spacing, safety and its standards, and wiring is checked by the state electrical inspector.

Driveways must meet the county’s construction standards: a culvert of at least 15 inches, sized and lengthened as the County Engineer decides, made of new concrete, corrugated metal or dual-wall plastic; a top width of 24 to 45 feet; side slopes of 2:1 on gravel roads and 6:1 on paved ones; and no buried rocks. Entrances must be spaced at least 400 feet apart for homes, 600 feet for businesses and 1,000 feet otherwise, and once a culvert is in, the county maintains it.

In the floodplain, Ordinance No. 44 splits mapped areas into a Floodway district, a Floodway Fringe district (Zone AE outside the floodway) and a General Floodplain district (Zone A). No development may go into the floodway if it would raise the base flood elevation at all. A floodplain development permit covers only the use and construction shown in the approved plans, and before anyone uses or occupies the structure the applicant must submit a certificate from an Iowa-registered professional engineer or land surveyor showing that the finished fill, floor elevations or floodproofing were built as the ordinance requires.

Iowa building code

Winnebago County regulates rural building through its zoning ordinance, Floodplain Management Ordinance No. 44 (adopted October 25, 2022) and its septic and well permits; none of the ordinances on its list is a building code. FEMA’s Community Status Book lists Winnebago County as participating in the National Flood Insurance Program, with its first flood insurance rate map dated June 19, 2020 and a current map dated December 15, 2022.

Iowa lets most cities and counties adopt the state building code, another code or none (a city of more than 15,000 must enforce at least the state code), but the energy, accessibility, fire, plumbing, mechanical and electrical rules apply statewide. Iowa rules

Winnebago County permit search and official resources

Zoning certificates and applications are kept by the zoning office, which can tell you what has been issued for a parcel; Board of Adjustment actions are filed with the Zoning Administrator, and variances are recorded with the County Recorder. Supervisors’ minutes are posted on the county site.
