Gainesville, Lindsay, Muenster and Valley View each issue building permits inside their own limits.
Which county permits apply on rural land?
A building on unincorporated land is not inspected by the County, but the site work around it can need these County approvals:
Anywhere outside cities
- On-site sewage facility (septic) permit before any part of a system is installed
- Floodplain Development Permit for building, filling or altering land in a FEMA flood zone
- Driveway application for a new connection to a county road
- Road bore or road cut agreement for boring under or cutting a county road
- Subdivision plat approved by Commissioners Court when land is divided
- RV park application for recreational vehicle developments
- 911 address for a new site
Lake Ray Roberts zoning area
- Lake Area Development (Building) Permit for any new structure over 800 square feet
- Utility Connection Certificate before water, sewer, electric, gas or other service is connected or reconnected
- Site plan, except in the Agricultural district
- Zoning change, Specific Use Permit, planned development or special exception where the use is not allowed by right
The lake zoning area is the land within 5,000 feet of the 645-foot elevation take line around Lake Ray Roberts. Land inside a city is excluded from it.
Who issues building permits in each Cooke County town?
Cooke County has nine incorporated places. Where a city has a building department, that city permits construction inside its limits; the County’s floodplain, driveway and lake-area permits apply only outside them. Septic is the exception: TCEQ lists Cooke County as its septic agent for the entire county except the Town of Road Runner, which is an agent inside its own limits, and the City of Gainesville’s septic program is administered by the County.

How to get county approvals for a rural build
If the land is inside Gainesville, Muenster, Lindsay or Valley View, apply to that city. If it is within 5,000 feet of the Lake Ray Roberts take line, the lake zoning rules also apply.
Request a 911 address through the County’s addressing link, then send the driveway application to the precinct commissioner’s office (Subdivisions & Development handles Precincts 1, 3 and 4).
An engineer, sanitarian or licensed site evaluator does the soil evaluation, and an engineer, sanitarian or licensed installer designs the system. File the application, design, plat or survey and fee with the OSS Inspector; the County approves or denies within 30 days.
For a site in a FEMA flood zone, file the Floodplain Development Permit application with a sealed site plan and elevation certificate at the County Judge’s office before work starts.
Near Lake Ray Roberts, take three copies of the Lake Area Development Permit application and site plan to the County Judge’s office, with the Utility Connection Certificate request.
The OSS Inspector must see the system after installation and before it is covered.

The County does not inspect framing, wiring or plumbing in rural homes. Its inspections and certificates cover the site:
- Septic: one inspection after installation and before cover-up. An aerobic system also needs a signed maintenance contract with a licensed provider and a notarised affidavit recorded with the County Clerk.
- Floodplain: within 14 days after a foundation is built, a licensed surveyor or engineer sends the County a FEMA Elevation Certificate, and a structure in the floodway needs a “No Rise” certificate. The floodplain permit expires one year after it is bought.
- Lake Ray Roberts: the County Judge reviews a Lake Area Development Permit within 15 calendar days, and an application not acted on by then is treated as approved on day 16. The permit lapses if work has not begun within 12 months. The Utility Connection Certificate is issued within 15 days of a written request once the building is complete and conforms to the lake rules.

Texas has no single statewide building code: state law makes the International Residential Code the base code for homes in cities and the International Building Code the base for commercial buildings, with each city choosing the edition and its own amendments, while the National Electrical Code and the energy code apply statewide.
