For property inside the City of Olean, building permits are issued by the Code Enforcement Office, Room 212 of the Olean Municipal Building at 101 East State Street (716-376-5683). Applications for building, mechanical and re-roofing permits go through the city’s iWorQ citizen portal or the office itself, and most permits cost 1% of the job cost, rounded up to the next $1,000, with a $60 minimum. Anyone doing home construction or improvement work for hire in the city also needs an annual city contractor license.
What requires a building permit in Olean?
The office’s own summary is that permits are required for just about any work, and Section 6-4 of the City Code, adopted by Resolution 125-22 in December 2022, makes that formal for all work governed by the state Uniform Code or Energy Code. The city’s fee schedules show what that covers in practice.
Permit needed in Olean
- New buildings, additions, renovations and parking lots
- Roofs, including roof-mounted solar
- Sheds, greenhouses, gazebos and pavilions over 100 sq ft
- Furnaces, boilers, water heaters and air conditioning
- Wood stoves and other solid-fuel appliances
- Fences, pools, hot tubs and inflatable pools 24 inches or deeper
- New electrical services
- Demolition, moving a building, signs and construction trailers
Exempt (City Code § 6-4(b))
- One-story sheds or playhouses at a one- or two-family home, up to 100 sq ft
- Window awnings on a home’s exterior wall
- Temporary stage, film and TV sets
- Partitions or movable cases under 5 feet 9 inches
- Painting, wallpapering, tiling and carpeting
- Listed portable equipment and like-for-like replacements
- Repairs that leave structure, exits and fire protection untouched
Section 6-4(b), adopted by the Common Council, is the rule: a shed of up to 100 sq ft is exempt. The office’s FAQ still says 99 square feet or less and also lists siding, same-size window replacement and changes to existing fixtures as permit-free, which the code’s list does not name, so confirm those jobs with the office; zoning setbacks apply either way.
What the city decides and what the state holds
New York’s Uniform Code and Energy Code set the construction standards. Olean’s Common Council sets the fees by resolution (§ 6-18) and keeps its own local rules on top: contractor licensing in Chapter 13, master plumber licensing in Chapter 27, the Housing Code in Chapter 12, flood damage prevention in Chapter 9, historic preservation in Chapter 11 and zoning in Chapter 28, with a separate form-based code for downtown.

Olean’s Division of Buildings and Code Enforcement works under the authority of the Fire Chief and is supervised by a Fire Captain assigned to the division, currently Capt. David Bauer, Supervisor of Building and Codes (716-376-5684, per the Code Enforcement contacts page). It reviews plans, collects permit fees, inspects construction, licenses home contractors and serves as the Zoning Board of Appeals’ administrative guide. Electrical and plumbing inspections are done by approved third-party inspectors, but every permit is issued and tracked by the office. Curb cuts and work in the street belong to the Department of Public Works.

Olean permit types and filing requirements
Residential permits
The iWorQ portal has three application types: a building permit, a re-roofing operating permit and a mechanical permit for furnaces, boilers, water heaters and air conditioning. You fill out every required field and upload plans and documents, and the portal asks contractors to have their contractor access code ready. Paper forms can also be picked up or downloaded and handed in at Room 212 with the documents and fee. Fences require a Dig Safely call before posts go in, and wood stoves must be installed by a certified installer. A pool permit covers the barrier, locking gates and water alarm, but not the separate electrical inspection.

Commercial permits
Commercial work follows its own 2023 schedule, still at 1% of construction cost with a $60 minimum but with higher flat fees for hot tubs and fences priced by length. Assembly spaces need an occupancy load sign ($35, reprints $10), and inspections outside normal hours are billed at $35 an hour for at least two hours. Commercial site plan review costs $450.
For tenant improvements and new commercial builds, Alliance handles commercial permit expediting through issuance. More on this: commercial building permits explained.

Moving all or part of a building along or across a city street needs a separate permit with a $500 application fee (refunded only if the move is refused), acknowledgments from the electric, telephone and other utilities on the route, a bond with at least two sureties of $250,000 or another amount the City Attorney sets, and a planning meeting with the city and utilities before issue. Construction trailers parked under permit cost $25 a month each, and construction storage trailers $50 a week for one or more. Sign installers need their own city license: $75 for three months or $200 for a year. Pool barriers must be at least 48 inches high with self-closing, self-latching gates that lock, and no opening that a 4-inch sphere could pass through.
What comes before the building permit
- Zoning Board of Appeals: area, use and sign variances and special use permits, $150 each, with the Code Enforcement Office acting as the board’s administrative guide.
- Site plan review: $150 for residential and $450 for commercial projects; downtown parcels follow the Downtown Olean Form-Based Zoning Code adopted in 2015.
- Historic preservation: Chapter 11 of the City Code governs designated historic properties.
- Flood areas: Chapter 9 regulates building in flood hazard areas, and FEMA lists the City of Olean as a participating community.
- Septic and wells: any onsite wastewater installation or repair needs a permit from the Cattaraugus County Environmental Health Division before work starts, with a site investigation and an inspection before the system is covered.
- Streets: curb cuts and right-of-way work go to the Department of Public Works.
Olean building permit fees
The city posts its 2023 residential and commercial permit fee schedules on the Codes Fees page; no later schedule is posted. Fees are based on job cost rounded up to the nearest $1,000 unless a row says otherwise, and § 6-4(k) requires payment when the application is submitted. Paying the fee does not give permission to start work.

|---|---|
| Failure to obtain a permit | $250 plus the permit fee |

Signs cost $5 per $1,000 of sign cost plus a three-year license add-on of $30 for an illuminated sign, $15 for a non-illuminated one and $150 for a billboard. Under § 6-111 an electrical inspection fee may be added to the building permit fee; it is not collected when no electrical inspection is needed and can be refunded on request.

Contractor license. Under § 13-371 every contractor and subcontractor offering home construction or improvement services for hire, from carpenters and masons to roofers, painters, electricians and heating contractors, must hold a city license before working. It costs $50 a year and $35 to renew before it expires; a late renewal is treated as a new application. The license needs $100,000 of liability insurance naming the City of Olean, a local criminal record check countersigned by the Police Chief, workers’ compensation or a CE-200 exemption, and copies of licenses held elsewhere. Plumbers, lawn maintainers and employees of a licensed firm are exempt.
Plumbing. No one may run a plumbing business or install, alter or repair a plumbing system in the city without a master plumber certificate from the city’s Examining Board of Plumbers, except a person repairing the plumbing in their own residence. Licenses expire each January; the last posted master plumber exam was held on June 24, 2025, with applications at Room 212. Plumbing fixture fees are set when the drawings are reviewed.
Electrical. Approved third-party agencies inspect all electrical work. A new service is a $45 permit plus the agency’s inspection, and skipping the third-party inspection carries a $350 charge.
How to apply for an Olean building permit
Look up the parcel on the zoning map, or the form-based code downtown, and file any variance or site plan first.
Hire a city-licensed home contractor and a city-licensed master plumber; check a license on the iWorQ license portal.
Pick the building, re-roofing or mechanical application in the iWorQ portal and upload plans and documents.
Pay 1% of the rounded job cost (minimum $60) by check to the City of Olean through the City Clerk.
Start work only after the permit is issued, and within six months.
Call 716-376-5683 for each building inspection and book the third-party electrical inspection.
Review, corrections and what causes delay
The office reviews construction plans before issuing a permit, and its fee schedules penalize the usual shortcuts: starting without a permit costs $250 on top of the permit fee, lifting a stop-work order costs $250, missing an inspection call costs $100, and building beyond what the permit shows costs $5 per square foot. Every contractor on the job also needs a valid annual city license, which the city requires of all contractors working within its limits.
Olean inspections and certificates
Under Chapter 6 work must stay accessible until the office or an authorized inspector has accepted it, and the permit holder calls when each stage is ready: footings and foundations, framing, building systems, fire-resistant construction, solid-fuel appliances and chimneys, Energy Code items, and a final inspection. Electrical and plumbing inspections are done by approved third-party inspectors. A certificate of occupancy or compliance closes the permit. Permits become invalid if work has not started within six months and expire 12 months after issue; an extension costs 50% of the original fee.

New York building code
New York builds on one statewide code, the Uniform Code, outside New York City; the 2025 edition and 2025 Energy Code took effect on 31 December 2025 (the all-electric provisions remain suspended by court order). Cities, towns and villages administer it, and local standards stricter than the code need Code Council approval. The Uniform Code in New York
Olean’s local administration law is Article I of Chapter 6 of the City Code, adopted on December 13, 2022 by Resolution 125-22.
