Herkimer County has no building department. Building permits come from the City of Little Falls, from each of the 19 towns, and from villages such as Herkimer, Ilion, Mohawk and Frankfort that keep their own codes offices. Herkimer is one of the twelve counties the Department of State lists as having opted out of the enforcement of the Uniform and Energy codes: the county does not enforce the code in a town or village that has also opted out; there, the Department of State’s Code Inspection Unit provides code enforcement and administration in place of the local government and charges fees for it. The county’s own permits are for driveways, utility work and heavy loads on county roads.

What requires a building permit in Herkimer County?

The Uniform Code sets the baseline and each town writes the details into its local laws. Litchfield’s codes page gives a detailed list: new construction, additions, repairs or remodels with structural changes, mobile home installations on an engineer- or architect-stamped slab plan, and septic repairs or installations, with stamped plans for new or expanded systems. Litchfield also regulates wind towers, solar energy systems and battery energy storage systems by local law, and its Board of Appeals hears variance requests and challenges to permit decisions.

Town, city or village permit

  • New homes, additions and structural remodels
  • Mobile and manufactured homes
  • Septic installations and repairs in towns that permit them, such as Litchfield and the Town of Little Falls
  • Demolition, garages, sheds and pole barns

County and state approvals

  • Driveway on a county road: county driveway permit, no fee
  • Utility work in a county road: county utility work permit
  • Overweight or oversize loads on county roads: load permits
  • Projects in Ohio, Russia, Salisbury and Webb: possible Adirondack Park Agency review

What the towns decide and what the state holds

The state’s 2025 Uniform Code and Energy Code are the construction standards; towns, villages and the city decide zoning, fees and staffing, and stricter local building rules need state Code Council approval. The Department of State’s Code Inspection Unit, which enforces only where a municipality has itself opted out, assigns one code compliance specialist to Herkimer and Madison counties and tells owners and contractors on private projects to contact their town, city or village office. Sharing is common: Columbia, Litchfield and the Town of Little Falls list the same codes phone, and Middleville uses the officer number that the Town of Oppenheim in Fulton County lists.

Herkimer County building department: who handles permitting

The two tables cover all 19 towns, the City of Little Falls and every village the Census Bureau counts in the county, including Dolgeville, which crosses into Fulton County. A village address is not always a village parcel, so check the tax map. German Flatts has a full guide on this site that covers the Ilion and Mohawk offices.

Where no codes office is named, the town or village clerk is the published contact, from the county’s municipal directory. Newport advertised a codes department vacancy for its 2027 fiscal year, so expect changes in that office.

What Herkimer County itself does

  • Highway Department, 313 Third Avenue, Herkimer: a driveway construction permit at no cost, normally issued within two weeks of the application; a utility work permit with a fee set by the Highway Superintendent; and seasonal, divisible and non-divisible load permits, also free, for heavy vehicles on 574 miles of county roads.
  • Herkimer County Planning Board: General Municipal Law 239-l, -m and -n reviews, filed through an online referral form; the board’s staff is the Herkimer-Oneida Counties Comprehensive Planning Program at Union Station, 321 Main Street, Utica (315-798-5710). The board meets at noon on the third Monday of the month at the Herkimer County Chamber of Commerce, 420 East German Street; a referral received after the deadline, about 10 days before the meeting, waits a month.
  • Public Health, 301 North Washington Street: points residents to the state Health Department’s environmental unit; the NYSDOH Herkimer District Office, 5665 State Route 5 (315-866-6879), is the state environmental health office for Fulton, Herkimer and Montgomery counties.

Herkimer County permit types and applications

Residential permits

Most offices use paper forms: Ohio posts a July 2026 application, Winfield an application and information package, Norway and the Town of Little Falls their building and septic forms. Litchfield expects proof of contractor insurance, a plot plan with setbacks, detailed drawings, a materials list, energy code compliance and the general contractor’s details, and requires an engineer or architect where a house exceeds 1,500 sq ft or the cost exceeds $20,000. Ohio also asks for stamped plans on dwellings over 1,500 sq ft of occupied space.

Commercial permits

In the Town of Little Falls every business and commercial project needs Planning Board approval before the building permit. Ohio prices multi-family, industrial and commercial buildings at $0.10 per sq ft with no cap. County referral applies where the site is within 500 ft of a municipal line, a county or state road or park, or a farm in an agricultural district.

What comes before the building permit

  • Zoning: town or village zoning permits, variances and site plans, with county referral where required.
  • Septic: town septic permits where issued, with stamped designs for new systems.
  • Driveway: the free county permit on a county road.
  • Adirondack Park: in Ohio, Russia, Salisbury and Webb, file the APA Jurisdictional Inquiry Form for new dwellings, subdivisions and shoreline work; the APA’s 2024 map shows Ohio with no zoning, subdivision or site plan law, and Russia, Salisbury and Webb with zoning and subdivision rules.

Building permit fees in Herkimer County

There is no county building fee and the county’s own road permits are mostly free. Town fees vary widely; the Town of Ohio prints its schedule on the application revised in July 2026.

Town of Ohio building permit fees (application rev. July 2026)
Work (Town of Ohio)Fee
Single-family dwelling, addition or modification$0.10 per sq ft, not more than $100
Garage, shed or pole barn$0.10 per sq ft, not more than $75
Manufactured or mobile home$75
Multi-family, industrial or commercial building$0.10 per sq ft
Roof extension or re-frame$0.05 per sq ft
Demolition$20
Minimum permit fee (since January 1, 2024)$20
Renewal for one more year$10 filing fee

Worked example: a new 2,000 sq ft house in Ohio works out to 2,000 × $0.10 = $200, but the fee for a single-family dwelling cannot exceed $100, so the permit costs $100. A 600 sq ft pole barn would be $60. Ohio permits are valid for two years and can be renewed once for a year for $10.

Trade permits and who may pull them

Herkimer County has no county trade licensing. Ilion licenses plumbers under its own village code, as the German Flatts guide explains; the other town pages listed here describe no local licenses. Litchfield requires every third-party inspector to show credentials on request and does not allow switching inspectors mid-project: the one that starts the work must finish it. Workers’ compensation and disability coverage, or the state exemption, is filed before any permit issues.

How to get a building permit in Herkimer County

1. Identify the municipality

Check whether the parcel is in a village, the city or only the town.

2. Call the codes officer

Many officers work part time or by appointment; Herkimer town and Russia list set hours or appointments.

3. Settle septic and access

Get the town septic permit and the county driveway permit if needed.

4. Clear zoning

Get local board approvals, with county referral where state law requires it.

5. File the application

Submit drawings, plot plan, materials list and insurance proof.

6. Inspect and close

Book inspections ahead and obtain the certificate of occupancy or compliance.

Review, corrections and what causes delay

Thin staffing is the main constraint: several towns list no codes office at all, three share one officer, and Newport was recruiting in 2026. A county referral that misses the board’s deadline adds a month, and missing stamped plans on larger houses send applications back.

Inspections and certificates

Inspections are booked with the issuing office. Litchfield asks owners to schedule at least 24 hours ahead from Monday to Thursday and by prior appointment on Friday and Saturday. Ohio’s application makes the owner responsible for getting the codes officer from the nearest public road to a remote site. Certificates of occupancy or compliance come from the same office after the final inspection.

New York building code

New York builds on one statewide code, the Uniform Code, outside New York City; the 2025 edition and 2025 Energy Code took effect on 31 December 2025 (the all-electric provisions remain suspended by court order). Cities, towns and villages administer it, and local standards stricter than the code need Code Council approval. The Uniform Code in New York

FEMA lists all 19 towns, the City of Little Falls and all 10 villages as participating in the National Flood Insurance Program; Ilion takes part in the Community Rating System.
