Who permits your project in German Flatts depends on which side of a village line you are on. The town’s Codes Enforcement Officer, Richard Sweeney, covers the roughly 2,200 residents outside the villages, and the permit application is given out on request at the Town Clerk’s office in the Village of Mohawk. The Village of Ilion and the Village of Mohawk, where most of the town lives, each have their own code enforcement office, forms and fees.

What requires a building permit in German Flatts?

Outside the villages, the town has posted no local law, exemption list or code of its own, so the starting point is the state’s minimum rule for local code programs (19 NYCRR Part 1203): construction, enlargement, alteration, improvement, removal, relocation or demolition of a building, and the installation of a solid-fuel heater, chimney or flue, need a permit. That rule lets a local program exempt minor items such as one-story sheds or playhouses of up to 144 sq ft at a one- or two-family home and painting, tiling and similar finish work. Ask the code officer at 315-717-2191 which of those the town applies before ordering materials.

The Village of Ilion publishes its own rule. Its Codes page says a building permit is needed for everything except painting, siding, replacement windows and driveways, and its application adds that any electrical upgrade in which a neutral wire is disconnected needs a building permit before work begins.

Ilion: permit needed

  • New buildings and additions
  • Alterations and repairs
  • Pools and fences
  • Signs and demolition
  • Plumbing and solid-fuel appliances
  • Electrical upgrades that disconnect a neutral

Ilion: no permit

  • Painting
  • Siding
  • Replacement windows
  • Driveways (a road cut needs its own permit)

Ilion’s adopted code words the exceptions more narrowly than the Codes page. Section 113-4 (Local Law 9 of 1991, amended in 1995) requires a permit for any work that must conform to the Uniform Code and allows exceptions only for necessary repairs that do not materially affect structural features; alterations costing less than $1,600 that touch no structure, fire-safety feature, electrical system or solid-fuel heater; residential storage sheds and similar small structures under 140 sq ft not used for living, sleeping, eating or cooking; and farm buildings used solely for agriculture. Because the code ties the alteration exception to cost, ask the Codes Department before skipping a permit for a larger siding or window job.

What the town and villages decide and what the state holds

All three governments enforce the same state Uniform Code and Energy Code and cannot make the construction rules stricter without Code Council approval. Each sets its own office, forms, fees and local laws; Ilion has its own zoning, flood damage prevention, subdivision and plumber-licensing chapters.

German Flatts building department: who handles permitting

German Flatts is a town of 11,969 people, and about 82% of them live in the two villages. Ilion lies almost entirely in the town (a few dozen residents are across the line in the Town of Frankfort), and Mohawk lies wholly within it. Each village appoints its own code enforcement officer, so the town officer’s territory is the rest of the town outside them.

German Flatts permit types and filing

The town does not run an online portal or post its building application for download; you pick the form up at the Town Clerk’s counter in the town office on East Main Street in Mohawk, fill it in and return it there, and the code officer reviews it. The Ilion Codes Department posts its application (revised August 2025) on the village’s Forms & Permits page, along with a road cut permit, the state’s unified solar permit form and a tax, water and codes search request. Mohawk handles applications at Village Hall, 28 Columbia Street, during its short codes hours; the village office line for other business is 315-866-4312.

Residential permits

For a house in the town, bring a description of the work, the property address and tax map number, a sketch or plot plan with distances to lot lines, construction drawings for anything structural, and proof of workers’ compensation and disability coverage or a state exemption form for whoever is doing the work. In Ilion the application asks for the zoning district, whether the lot is in a flood zone, the dimensions and square footage of a new structure and a cost breakdown for electrical, plumbing, HVAC and other work. Section 113-4 asks for three sets of plans and specifications and lets the official waive them for minor alterations; the August 2025 application says two sets of stamped plans may be required and a simple sketch will do for minor repairs. Zoning section 250-36 adds two copies of a plot plan drawn to scale with the lot’s actual dimensions and the size and location of each building, one returned with the permit.

Commercial permits

Commercial buildings go to the same three offices. Ilion has its own Planning Board (ch. 31), zoning chapter (ch. 250) with a village zoning map, sign chapter (ch. 185) and subdivision rules (ch. 205), so a new commercial building or sign there can need board approval as well as the building permit. The Zoning Board of Appeals issues the special permits the zoning chapter lists, such as public utilities and private recreation areas, and on a corner lot in a residence district nothing over 3½ feet high may stand within the sight triangle formed 30 feet back from the intersection.

What comes before the building permit

Flood maps matter in a town on the south bank of the Mohawk River. FEMA lists the town, Ilion and Mohawk as participating communities in the National Flood Insurance Program; the town’s map is marked as having no base flood elevations determined (Zone A, C and X only), while both villages use maps dated September 8, 1999, and Ilion has a flood damage prevention chapter in its code. Ilion’s application asks whether the lot is in a flood zone, so check the map before you design. In Ilion a street, curb or sidewalk opening needs a written application to the Village Clerk at least 24 hours before work starts, and a sewer connection needs a written permit from the village Sewer Inspector, with every cost of the connection borne by the owner. For a lot on a private well or septic system the state Health Department’s Herkimer District Office, 5665 State Route 5, Herkimer (315-866-6879), is the state health office for the county.

German Flatts building permit fees

None of the three offices posts a dollar-amount permit table. Each sets its own charges, and you learn the fee from the office that will issue the permit.

Village of IlionYearly Uniform Schedule of Fees approved by the Village Board; the applicant is told the fee after the application is approved

Ilion’s fee chapter (ch. 105) and its posted Inspection Fee Schedule both point to that annual Village Board schedule, so the figure can change each year. Zoning section 250-36 says building permit fees are paid to the Enforcement Officer when the application is filed, while the August 2025 application says you are told the fee after approval, so ask which applies when you hand it in. The charges written into Ilion’s code itself are for street work: $15 per pavement, road or curb cut, paid with the application, plus a certified check of $200 for each street cut of up to 50 sq ft and $15 per curb cut, held until a year after permanent paving.

Trade permits and who may pull them

The town has not adopted a local electrician, plumber or home-improvement contractor license that appears on its site, and trade work in the town is reviewed and inspected under the building permit. Ilion is different for plumbing. Chapter 175 of the village code bars anyone from working as a plumber in the village without a village license or certificate. A master plumber applies to the Village Clerk, passes an exam under the Village Engineer unless they show a completed journeyman apprenticeship or a current license from another Uniform Code jurisdiction, posts a $5,000 surety bond and renews each year before January 1. Journeymen, apprentices and helpers register with the clerk and work only under a licensed master, appliance dealers can get a limited license for hook-ups, and only a licensed master plumber may connect to or repair a connection with the village sewer or water system. Electrical work in Ilion that disconnects a neutral wire needs a building permit first.

Whoever pulls the permit must show proof of workers’ compensation and disability coverage, or the Workers’ Compensation Board exemption form, under the wording on the office’s own application.

How to apply for a German Flatts building permit

1. Find your office

Check whether the parcel is inside Ilion or Mohawk; only land outside both goes to the town code officer.

2. Call the code officer

Describe the job to 315-717-2191 (town), 315-895-7449 ext. 3223 (Ilion) or 315-985-0080 (Mohawk) and ask what drawings and approvals it needs.

3. Get the form

Town: Town Clerk’s office, weekdays 9 a.m.–4 p.m. Ilion: download from Forms & Permits. Mohawk: Village Hall.

4. Check flood and site issues

Look up the flood zone, and for a well or septic lot contact the state health district office.

5. Submit with plans and insurance

Hand in the form with drawings, a sketch or plot plan, and workers’ compensation proof.

6. Pay, post and build

Pay the fee the office sets, keep the permit at the site and call for each inspection.

Review, corrections and what causes delay

The town officer is reached by phone or email rather than at a posted counter, and Mohawk’s codes office keeps one hour on Mondays plus Tuesday appointments, so call ahead. In Ilion, work cannot start until the permit is approved, any change from the approved plans needs revised plans approved first, and a permit can be suspended or revoked for work that departs from the Code or for false statements. Section 113-4 makes an Ilion permit expire one year after issue, or when the certificate of occupancy issues if sooner, and allows renewal for successive one-year periods on written request if the permit is not suspended, the application is up to date and the renewal fee is paid; the application form mentions only one additional year.

German Flatts inspections and certificates

Inspections are made by the officer who issued the permit: a town job by the town Codes Enforcement Officer and a village job by that village’s officer.

Ilion’s section 113-7 calls for an inspection before any work is covered and at each stage: building location, site preparation, excavation, foundation, framing, electrical, plumbing, heating and air-conditioning, fire protection, exits and a final inspection; the owner or contractor must tell the inspector the work is ready. In Ilion the certificate of occupancy is applied for together with the building permit and issued within 10 days after the work is approved, a temporary certificate runs six months, and the officer can also issue a certificate of code compliance when a property is sold. Apartment buildings there get fire-safety inspections at least every 36 months and places of public assembly every 12 months.

A new building or a change of use is not occupied until the office issues a certificate of occupancy, and other permitted work closes with a certificate of compliance.

New York building code

New York builds on one statewide code, the Uniform Code, outside New York City; the 2025 edition and 2025 Energy Code took effect on 31 December 2025 (the all-electric provisions remain suspended by court order). Cities, towns and villages administer it, and local standards stricter than the code need Code Council approval. The Uniform Code in New York

German Flatts permit FAQ

Does the Town of German Flatts issue permits in Ilion or Mohawk?

No. Ilion’s Codes Department at 49 Morgan Street and Mohawk’s codes office at 28 Columbia Street each issue permits inside their village. The town officer covers the rest of the town.

Where do I get a town building permit application?

At the Town Clerk’s office, 66 East Main Street in the Village of Mohawk, open weekdays 9 a.m. to 4 p.m. The town does not post the form online.

Do I need a permit for siding or replacement windows in Ilion?

The Codes page says no for painting, siding, replacement windows and driveways. The adopted code exempts only repairs that do not affect structure and non-structural alterations under $1,600, so call 315-895-7449 ext. 3223 about a larger job.

How much does a permit cost?

Each office sets its own fees and none posts a table. Ilion uses a yearly schedule approved by its Village Board and tells you the fee after approving the application.

How long is an Ilion permit good for?

One year from issue under section 113-4, renewable for further one-year periods on written request with the renewal fee.

Is German Flatts in the flood insurance program?

Yes. FEMA lists the town and both villages as participating communities; FEMA’s list shows Ilion at Community Rating System class 10, which gives no premium discount.

Can any plumber work in Ilion?

No. Ilion licenses plumbers itself: a master plumber needs a village license, renewed each year with a $5,000 bond, and only a licensed master may connect to the village water or sewer system. The town has no comparable license.

When can I reach the Mohawk codes office?

Mondays 1 to 2 p.m., and Tuesdays by appointment, at 315-985-0080.

German Flatts permit search and official resources

There is no online permit search for any of the three offices. For a town permit history, ask the Codes Enforcement Officer or send a Freedom of Information Law request to the Town Clerk. Ilion uses its own Tax, Water and Codes Search Application Form for property searches, posted with its permit forms.

Inspections are where schedules slip.
