For land in the Town of Canton outside the Village of Canton and the Village of Rensselaer Falls, building permits come from the Town Code Enforcement Office in the Canton Municipal Building, 60 Main Street (315-714-3659). A typical new home costs $30 plus $0.22 per square foot, repairs and renovations start at $30, permits last 12 months, and starting work without a permit adds a $50 fee and can bring fines of $50 to $500 a day.

What requires a building permit in Canton?

The town code officer’s notice puts it plainly: anyone who builds, enlarges, alters, repairs, moves or demolishes a building, changes its occupancy, or installs or replaces regulated electrical, gas, mechanical or plumbing systems must apply and get the permit first. It adds a reminder about roofs: a new roof covering cannot go over a water-soaked or deteriorated roof, over wood shake, slate or tile, or over two existing layers; those roofs must be stripped to the deck.

Building permit

  • New homes, additions and manufactured homes
  • Renovations, alterations and repairs, priced by cost
  • Garages, pole barns and sheds of 145 sq ft or more
  • Swimming pools and decks
  • Every solar energy system and battery storage system
  • Outdoor wood boilers (zoning permit too)
  • Demolition and asbestos abatement
  • Septic systems (no fee)

Zoning permit or other approval

  • Sheds up to 144 sq ft: $25 fee and a zoning permit
  • Chicken coops under 144 sq ft: no building permit unless attached to another building
  • Signs: a permit from the Planning Board
  • Changes of use, relocations and changes to a building’s outside dimensions: zoning permit

The 2024 Zoning Law requires a zoning permit for any change of use, new building, relocation, change to a building’s outside dimensions or excavation for a building, so most building projects need both papers. The zoning permit is $30.

Placement rules come from Section 70-34. A detached accessory building over 100 square feet at a home must stay out of the front yard unless it is at least 100 feet from the front line, sit 10 feet from side and rear lines and 10 feet from the house or any other accessory building, and meet the house setback on the street side of a corner lot. On corner lots nothing over 3 feet tall, fences and hedges included, may stand in the triangle formed by points 20 feet back along each street. Portable storage containers for a renovation or a move may stay up to 30 days, twice a year, on a driveway rather than the street; permanent containers are allowed only on lots of 2 acres or more, out of sight in a side or rear yard.

What Canton decides and what the state sets

The Uniform Code and Energy Code set the technical rules. The town sets its own fee schedule, zoning (Local Law 1 of 2024, which also replaced the town’s earlier solar laws), electrical standards in Chapter 27 of the Town Code and flood damage prevention in Chapter 29. Chapter 27 adds a local rule: newly built, converted or altered commercial buildings must be wired in conduit or metal-clad cable and have interconnected smoke and fire detection.

Canton building department: who handles permitting

The town and the Village of Canton keep separate code enforcement officers, both in the Canton Municipal Building. Michael McQuade is the Town Code Enforcement Officer, responsible for the town outside the village limits; he answers on the office line or his cell. Applications can be picked up at the code office or at the Town or Village Clerk’s office.

Rensselaer Falls posts its own blank building permit and its own Use and Development Code; the Village of Canton has its own fee schedule, zoning map, Planning Board and Zoning Board of Appeals. Check which side of the village line a parcel is on before applying: the town has 11,256 residents (Census 2025 estimate), of whom about 4,000 live outside the two villages.

Canton permit types and filing rules

Residential permits

The Town Building Permit Application is a single form for renovations, alterations, repairs, additions, decks, demolition, septic systems, electrical upgrades, roofs, solar installations, signs and changes of certificate of occupancy. Residential buildings over 1,500 square feet need engineered drawings, and the new-home checklist says any plan prepared by an architect, engineer or surveyor must carry a New York stamp. A full new-home package includes a plot plan with distances from the legal property lines (not streets, sidewalks or fences), foundation and structural plans, floor plans and wall sections, stair details, elevations, energy code documents and the location of the radon system; truss drawings must be on site for the rough framing inspection, and unfinished basements need under-floor fire protection.

The town also posts building guides for single-family homes, decks and porches, garages, additions and pole barns, plus a lumber mill certificate form.

Commercial permits

All commercial projects need engineered drawings. New commercial and industrial buildings are $0.35 per square foot and multiple dwellings of three or more units $0.25; operating permits are $40. Commercial wiring must be in conduit or metal-clad cable with interconnected detection. Commercial solar farms and Tier 2 battery storage systems pay $10,000 per megawatt (AC).

What comes before the building permit

  • Zoning permit ($30) for new buildings, changes of use and changes to a building’s outside dimensions.
  • Town Planning Board site plan review ($25), special use permits ($40) and sign permits.
  • Town Zoning Board of Appeals variances ($40) and interpretations.
  • Watercourse Protection Overlay: land within 500 feet of the Grasse River, Oswegatchie River, Little River and Harrison Creek has extra rules, including a 50-foot buffer from the high-water mark where removing natural vegetation is restricted, and any project there adding 5,000 sq ft or more of hard surface needs Planning Board site plan review.
  • Flood zones: the town and the Village of Canton both take part in the National Flood Insurance Program; the town’s flood map is dated August 17, 1998.
  • Septic: the town permits septic systems at no charge, and a sewage disposal certificate of compliance is needed before occupancy. The State Health Department’s Canton District Office, 58 Gouverneur Street (315-386-1040), is the state health office for St. Lawrence County.

Canton building permit fees

The Town of Canton Building Permit Fee Schedule, posted by the Code Enforcement Office and undated, collects every fee when the permit issues. New construction is priced by square foot; renovations, alterations and repairs by construction cost.

For a 1,600 sq ft typical house the fee works out to $30 plus 1,600 × $0.22, or $382, and a 24 by 30 foot garage (720 sq ft) is $43.20. The renovation bands do not join up neatly (the $100,001 band starts at $400), and the sheet does not say whether the per-$1,000 charge runs on the whole cost or only the part above the band’s floor, so ask the office to price a renovation before you budget. A 7 kW rooftop solar array is $105.

Trade permits and who may pull them

Electrical. Chapter 27 lets the Town Board appoint electrical inspection agencies as the town’s agents, and their fees are paid by the applicant, never the town. Before a certificate of occupancy, the town needs two electrical certificates: one for the service entrance and one for the building wiring. Electrical upgrades are also listed on the town application.

Heating, ventilation and plumbing. The occupancy checklist asks for installation specifications for every heating or cooling system, test results for smoke and carbon monoxide alarms, sprinkler test certificates where sprinklers are required and an ACH-50 blower-door test certificate.

Septic. Septic work goes on the town building permit with no fee, and the finished system needs a sewage disposal certificate of compliance before the house can be occupied.

Contractors. The town’s code and pages set no contractor, electrician or plumber license. The application asks for the contractor’s workers’ compensation, disability and general liability insurance; the BP-1 owner affidavit and the state’s CE-200 exemption are posted on the code enforcement pages.

How to apply for a Canton building permit

1. Find the right office

Village of Canton, Rensselaer Falls or the town office.

2. Check zoning

Most new buildings and changes of use need a $30 zoning permit.

3. Get the application

Download it or pick it up at the code office or a clerk’s office.

4. Attach plans

Engineered drawings for homes over 1,500 sq ft and all commercial work.

5. Pay at issuance

All fees are collected when the permit is issued.

6. Call for inspections

Notify the officer when each stage is ready, then request the C.O.

Review, corrections and what causes delay

The town does not publish a review time. The town officer’s notice warns that several projects have started before a permit was issued. Doing so adds $50 to a building permit and $100 to a demolition permit, and violations can be fined $50 to $500 for each day they continue. The checklist also insists on stamped plans and a plot plan measured from the legal property lines rather than a fence, sidewalk or road. Permits last 12 months; unfinished work needs a renewal at 25% of the original fee.

Canton inspections and certificates

Call the Town Code Enforcement Officer when each stage of work is ready and for the final inspection; the office and cell numbers are on the town’s fee schedule and checklist. Engineered truss drawings must be on site for the rough framing inspection.

A certificate of occupancy is free when issued under a permit. Before it issues, the town’s occupancy sheet asks for the two electrical certificates, the sewage disposal certificate of compliance, the ACH-50 test certificate, truss specifications, HVAC installation specifications, smoke and carbon monoxide alarm test results and any sprinkler certificates. The building must be weather-tight with working windows, have doors on bedrooms, meet the garage separation rule and show 4-inch house numbers at the street. Unfinished work must be listed with an estimated completion date.

New York building code

New York builds on one statewide code, the Uniform Code, outside New York City; the 2025 edition and 2025 Energy Code took effect on 31 December 2025 (the all-electric provisions remain suspended by court order). Cities, towns and villages administer it, and local standards stricter than the code need Code Council approval. The Uniform Code in New York
