In the Town of Ballston the Building Department issues building, accessory structure, mechanical and septic permits, and the town’s 2026 fee schedule (Town Board Resolution 26-14) charges $0.25 per square foot for a house, garage or addition, with a $100 minimum that includes the certificate of occupancy. Applications must carry original signatures and stamped plans; call 518-490-2715 weekdays from 8 am to 4 pm. The part of the Village of Ballston Spa inside the town has its own building department.

What requires a building permit in Ballston?

Any home improvement involving a structural change needs a building permit. The department lists the work it reviews and inspects: new homes and commercial buildings; alterations, repairs, renovations and reconstruction; sheds, decks and pools; plumbing and HVAC installations; septic installation, replacement or decommissioning; signs; roof- and ground-mounted solar, EV chargers and generators. A roof replacement also needs a permit.

Permit needed

  • New houses, garages, additions and structural renovations
  • Sheds over 120 sq ft, decks, porches and pole barns
  • Pools and hot tubs, fireplaces, wood-burning equipment and generators
  • Roof replacement
  • Septic systems, new, replaced or decommissioned
  • Solar arrays, EV chargers and geothermal systems
  • Docks and boathouses, signs and demolition

No building permit

  • Sheds of 120 sq ft or less (zoning setbacks still apply)
  • Fences, which must still meet Section 138-52: 6 feet maximum in side and rear yards, 4 feet within 25 feet of the front line or road, 8 feet for farm fencing, and no barbed wire except for agriculture or security

For fences the department recommends setting them 1 to 2 feet inside your line, finished side out and never in a town, county or state right of way. Geothermal systems have their own application under Local Law 2 of 2025, which regulates geothermal permitting.

Chapter 62 of the Town Code adds two points: farm buildings used directly and solely for agriculture, such as barns, sheds and poultry houses, are outside the town permit requirement, and so are necessary repairs that are not structural and meet the Uniform Code. Installing heating equipment always needs a permit.

What Ballston decides and what the state sets

The state Uniform Code and Energy Code govern construction. Ballston’s own Zoning chapter (138) sets setbacks and uses and was amended in November 2025 by Local Law 4 of 2025; Local Law 3 of 2025 added rules for battery energy storage and cryptocurrency or data mining, and Local Law 1 of 2026 amended the solar section (138-162). Separate chapters cover docks, moorings, boathouses and marinas (Chapter 54), geothermal systems, flood damage prevention and stormwater.

Ballston building department: who handles permitting

The Building Department, headed by Building Inspector Jeffrey Stickles (518-490-2740), reviews plans, issues permits, inspects work and carries out fire safety inspections of commercial and multi-family buildings. It covers the town outside the Village of Ballston Spa: of Ballston’s 13,547 residents (Census 2025), 922 live in the part of the village that lies in the town, and the rest of the village is in the Town of Milton. The village runs its own Building Department for its whole area, staffed by two part-time building inspectors and a fire code enforcement officer; it issues permits for new construction, repairs, fences and pools and carries out fire safety inspections. Note that the village requires fence permits, which the town does not.

Ballston permit types and filing rules

Residential permits

Choose the application that fits the job: Residential General (new construction, garages, renovations, additions and alterations), Accessory Structures (decks, sheds, pole barns), Swimming Pool, Mechanical (generators, solar arrays, fireplaces, hot tubs), Wastewater System, Geothermal, Demolition, Dock and Boathouse, and Sign. Each form gives its own submittal list. The department wants original signed documents and wet-stamped plans, plus a digital copy by email or USB for larger plan sets.

A new house or addition needs two sets of scaled plans stamped by a New York licensed design professional, showing window light and ventilation; energy calculations under the state Energy Code; two copies of a plot plan locating the house and septic system; the contractor’s liability and workers’ compensation certificates, or form BP-1 when the owner does the work; and a highway entrance permit from the town, county or state for the driveway. The form also asks whether the lot fronts a bonded or accepted street.

Waterfront owners use the Dock and Boathouse application ($50 for a dock), which the department files under its lake regulations together with the town’s dock ordinance. Animal permits, lot line adjustments and changes of occupancy have their own forms on the same page.

Commercial permits

Commercial buildings use their own application and pay $0.35 per square foot, minimum $250; a change of occupancy or tenancy is a $50 filing. Changes to telecommunications towers need a $1,000 engineering review escrow, and projects covered by the state construction stormwater permit post a $1,000 inspection escrow when the town accepts the stormwater plan.

What comes before the building permit

  • Zoning Board of Appeals: use variance $500; area variance $250 plus $50 for each additional variance; an interpretation of the law $100.
  • Planning Board: site plan $500 plus $0.05 per square foot of building, with a $2,000 engineering escrow; special use permit $500 with a $2,000 engineering escrow; lot line adjustment $150; minor subdivision (one to four lots) $200 plus $100 a lot; major subdivision (five or more) $500 plus $100 a lot; a $1,500 stormwater plan review escrow where one is needed; and a GIS mapping fee of $200 a lot or $250 a map. The applicant also pays any expenses the town incurs in review.
  • Soil disturbance: required only for sites over one acre: $200 up to three acres and $60 for each extra acre.
  • Highway access: a driveway entrance permit from the road owner.
  • Flood zones: the town takes part in the National Flood Insurance Program, with a flood map dated August 16, 1995.

For example, a 2,400 sq ft new house is 2,400 × $0.25, or $600, certificate of occupancy included. Projects seeking development approval also pay the town’s adopted mitigation fees: water system mitigation of $1,583 per residential equivalent dwelling unit (EDU), traffic mitigation of $785 for each weekday peak-hour trip a project adds (from the Generic Environmental Impact Statement adopted April 12, 2022 and amended November 12, 2024), and $2,000 per new dwelling in lieu of parkland on subdivisions.

Where the zoning code calls for the purchase of development rights, the schedule sets $10,000 per residential unit and $2.00 per square foot for business and commercial space. Those charges can be reduced through the town’s Green Energy Incentive Program: points are awarded for features such as air-source heat pumps (6), solar panels or solar shingles (12), storage batteries (6), heat pump water heaters (2) and LEED-rated buildings (3 to 12), and the reduction follows the table in Section 138-168. A returned check costs $20, and replacement payments must be certified funds or cash.

Trade permits and who may pull them

Electrical. The Building Department does not inspect electrical work. Chapter 56 of the Town Code bars installing or altering wiring until an inspection application is filed with an approved agency, and bars connecting power until that agency issues a certificate. The town lists Atlantic Inland, Middle Department Inspection Agency and The Inspector, LLC as approved, and says any licensed electrical inspector may do the inspection.

Plumbing, HVAC and fuel-burning equipment. These are permitted and inspected by the Building Department, mostly under the $100 mechanical permit.

Septic. Saratoga County’s Department of Health sends residential systems outside realty subdivisions to the local building department, so Ballston issues the septic permit ($100). Under Section 138-26, a new, expanded or replacement system must be designed by a New York licensed design professional, and the application asks for percolation and water-table results and two sets of plans. It also records the number of bedrooms, whether there is a garbage disposal, the tank size, the trench width and the number and length of laterals, and whether water comes from a municipal line or a well. Decommissioning an old system uses the same form.

Licensing. The Town Code has no contractor, electrician or plumber licensing chapter; the town checks insurance certificates or the owner’s BP-1 exemption.

How to apply for a Ballston building permit

1. Confirm the jurisdiction

Parcels in the Village of Ballston Spa go to the village office on Front Street.

2. Check zoning

Find setbacks in Chapter 138 and see whether the ZBA or Planning Board is involved.

3. Pick the right form

Residential, accessory, pool, mechanical, septic or another listed application.

4. Sign originals and stamp plans

Wet signatures and stamps, plus a digital copy for large sets.

5. File at Town Hall

Bring the package to 323 Charlton Road or mail it to P.O. Box 67, Burnt Hills, with insurance certificates.

6. Schedule inspections

Call, email or stop in 24 hours ahead for a morning or afternoon slot.

Review, corrections and what causes delay

The department’s forms say a permit issues only when the application is complete, so photocopied signatures, unstamped plans, missing energy calculations or a plot plan without the septic location will hold a file. Projects that go to the Planning Board also carry engineering review escrows, and traffic mitigation fees are paid on Planning Board approval.

Ballston inspections and certificates

Chapter 62 requires inspection before any part of the work is enclosed or covered and at the completion of each stage, including the building location, site preparation, excavation, foundation, framing, superstructure, electrical, plumbing and HVAC; the owner or contractor must tell the Building Inspector when each stage is ready. No certificate of occupancy is issued while any deficiency remains uncorrected.

Inspections run on weekdays between 10 am and noon and between 1 and 3 pm; other times need the department’s advance agreement. Book at least 24 hours ahead in person, by phone at 518-490-2715 or by email, giving your name, phone, address and the type of inspection. If the inspector arrives and the work is not ready, each extra trip costs $100. The certificate of occupancy for a house is included in the residential permit fee; power may not be connected until the electrical agency has issued its certificate. A permit that runs out can be renewed for half the original fee, at least $100.

Once buildings are occupied, the department also performs fire safety inspections of commercial and multi-family buildings, and a change of occupancy or tenancy in an existing building is filed on its own form with a $50 fee.

New York building code

New York builds on one statewide code, the Uniform Code, outside New York City; the 2025 edition and 2025 Energy Code took effect on 31 December 2025 (the all-electric provisions remain suspended by court order). Cities, towns and villages administer it, and local standards stricter than the code need Code Council approval. The Uniform Code in New York
