Saratoga County has no building department of its own and is one of the twelve New York counties that the Department of State lists as having opted out of the enforcement of the Uniform and Energy codes. Every building permit therefore comes from a local office: the cities of Saratoga Springs and Mechanicville, the 19 towns for land outside their villages, and the nine villages for land inside them. Even a house septic system is usually a local matter here, because the county Health Department sends residential systems outside realty subdivisions back to the local building department. The county itself permits work in county road rights-of-way and reviews zoning referrals through its Planning Board.
What requires a building permit in Saratoga County?
Each town and village sets its own exemptions under the state code. The Town of Day requires a permit for all phases of building except an accessory structure under 100 sq ft, and does not require one for fences up to six feet. Clifton Park exempts sheds of 144 sq ft or less, while Moreau and Wilton have no shed exemption at all, and Ballston asks for a permit once a shed passes 120 sq ft. Galway reminds owners that most building projects need a permit and that 911 numbers must be visible from the road in both directions.
Local permit
- New houses, additions and alterations
- Sheds, garages, decks and pools on each place’s rules
- Septic systems for single houses, in most towns
- Demolition and changes of use
- Solar, generators and fuel-burning equipment where listed
County approvals
- Any work in a county road right-of-way: DPW permit under Highway Law 136
- Septic and water plans for realty subdivisions and regulated facilities: county Health
- Zoning, site plan, special use, variance and subdivision actions near county roads, town lines or farms: county Planning Board referral
What the municipalities decide and what the state holds
The construction standards are the state’s 2025 Uniform Code and Energy Code everywhere. Because Saratoga County opted out, it does not enforce the code in a city, town or village that has also opted out; there, the Department of State’s Code Inspection Unit provides code enforcement and administration in place of the local government and charges fees for it. The unit tells owners and contractors on private projects to contact their town, city or village office. Local law covers the rest: zoning, fee schedules, shed and fence rules, septic permits and moratoria such as Clifton Park’s cannabis moratorium, Milton’s solar and battery moratorium and Moreau’s storage-warehouse moratorium, each described in that town’s guide.
Saratoga County building department: who handles permitting
All 30 municipalities are below. Ballston Spa is split between Ballston and Milton; every other village lies inside one town. Several small towns share officers: the Town of Corinth and the Town of Hadley name the same code enforcement officer, and Schuylerville and the Village of Stillwater list the same officer’s number.

Call 1-855-478-4290 →What Saratoga County itself does
- Department of Public Works (3654 Galway Road, Ballston Spa; 518-885-2235; office 8 a.m. to 4:30 p.m.): permits for any work in a county right-of-way under Highway Law section 136, on separate forms for construction or reconstruction, utilities, driveways and special hauling. Working without one can cost up to $1,000 a day, and a driveway permit is approved only once every other agency involved has signed off.
- Department of Health (6012 County Farm Road, Ballston Spa; 518-584-7460): reviews new and repaired septic plans for regulated facilities and realty subdivisions, by email or drop-off, one plan set only, and takes septic complaints.
- Planning Department and Planning Board (50 West High Street, Ballston Spa): reviews referred actions within 500 feet of a municipal boundary, a state or county road or park, a county drainage channel, county or state public land, or a farm in an agricultural district; the board meets at 4 p.m. on the third Thursday of each month.
Saratoga County permit types and applications
Residential permits
Filing methods vary. Clifton Park takes applications only through Citizenserve, Saratoga Springs is moving to SmartGov in November 2026, Halfmoon wants three paper sets, and Malta takes checks or exact cash. In Ballston Spa the Building Department works downstairs at 66 Front Street with two part-time inspectors. On a lot that needs septic, most towns issue the septic permit with the building permit: Ballston, Moreau and Stillwater each run their own septic permits, and Moreau requires witnessed perc tests.

Commercial permits
Commercial projects add site plan review by the local planning board, a county referral where the site is within 500 feet of one of the listed features, and county Health review where the building is a regulated facility on its own septic system. Clifton Park charges commercial work $60 per 100 sq ft with a $400 minimum, and Halfmoon sets a $350 commercial minimum.

What comes before the building permit
- County referral: the local board cannot finish acting on a referred site plan, special permit, variance or subdivision until the county Planning Board has reviewed it.
- County road access: the DPW driveway or work permit for any county right-of-way.
- Local zoning and wetlands: town and village ZBAs and planning boards; Clifton Park routes wetland questions to its Environmental Conservation Commission.
- Flood zones: every Saratoga community listed by FEMA participates in the National Flood Insurance Program (Edinburg and the Village of Galway do not appear in its book); the Town of Corinth’s Building Department doubles as the town’s flood administrator.
Building permit fees in Saratoga County
Each municipality sets its own fees, and most towns here price a new house by floor area. The table gives the main house rule in the places with finished guides on this site.
| Municipality | New house fee rule | Schedule |
|---|---|---|
| City of Saratoga Springs | $225 plus $0.50 per sq ft | 2026 city fee schedule |
| Town of Clifton Park | $40 per 100 sq ft | Town Code 103-16 (Local Law 7 of 2025) |
| Town of Ballston | $0.25 per sq ft, $100 minimum, certificate of occupancy included | Resolution 26-14, Jan. 14, 2026 |
| Town of Malta | $0.45 per sq ft, $148 minimum | 2026 fee summary (Schedule A) |
| Town of Milton | $100 plus $0.20 per sq ft | Resolution 22-2026, Jan. 28, 2026 |
| Town of Moreau | $0.23 per sq ft, $150 minimum | 2025 fee schedule |
| Town of Stillwater | $100 plus $0.25 per sq ft | Fees printed on town forms |
| Town of Wilton | $0.20 per sq ft, $50 minimum | Town Code Chapter 63 |
For a 2,000 sq ft house: Ballston charges 2,000 times $0.25, or $500; Milton $100 plus $400, or $500; Malta 2,000 times $0.45, or $900; Clifton Park 20 times $40, or $800; Saratoga Springs $225 plus $1,000, or $1,225. Each town measures floor area by its own definition, so the totals are for comparison only. The county charges nothing for a building permit; its DPW permit forms carry their own terms.

Saratoga County’s departments list no contractor or trade licensing program. The usual local rule is a third-party electrical inspection: Galway says electrical inspections are done by a third-party inspector, Moreau requires a New York-certified electrical agency, and Ballston and Wilton list approved agencies. Saratoga Springs requires a city master plumber certificate for plumbing in the city. Every office needs proof of workers’ compensation and disability coverage, or the state exemption form for an owner doing the work, before a permit issues.
How to get a building permit in Saratoga County
Use the tax bill; Ballston Spa, Round Lake, South Glens Falls and the other villages have their own offices.
Ask whether the planning board or ZBA must act and whether the county Planning Board must review first.
For a single house, apply for the local septic permit; for a subdivision or regulated facility, file plans with county Health.
File the county DPW driveway or work permit for a county road, or the town’s for a town road.
Submit the application in the format the office takes, with plans, insurance proof and fee.
Book inspections with notice and obtain the certificate of occupancy.
Review, corrections and what causes delay
Delays usually come from part-time hours, a pending county referral, septic designs and perc tests, and missing insurance forms. Malta quotes about two weeks and Wilton allows up to 28 business days for some reviews.
Inspections and certificates
Notice rules differ: Greenfield has required 48 hours’ notice for every inspection since May 30, 2023, Galway at least 24 hours with confirmation from the inspector, and Stillwater 48 hours since April 27, 2026. In Hadley it is the owner’s or contractor’s job to call the inspector for each required inspection. The final step is the certificate of occupancy or compliance from the local office.
New York building code
New York builds on one statewide code, the Uniform Code, outside New York City; the 2025 edition and 2025 Energy Code took effect on 31 December 2025 (the all-electric provisions remain suspended by court order). Cities, towns and villages administer it, and local standards stricter than the code need Code Council approval. The Uniform Code in New York
