The Building Inspections Division provides code inspections for all new residential and commercial construction that has applied for a permit, and issues plumbing, electrical and general construction permits alongside. The city also offers an expedited plan review option.

What requires a building permit in Independence?

Exempt lists, thresholds and fee schedules are set by whoever adopted the code, so an exempt list from a neighbouring municipality is not reliable and neither is one from the county. An exemption from a building permit is never an exemption from zoning, floodplain regulation, or an electrical or plumbing permit. Independence also gates the permit on two credentials rather than one: all general and trade contractors must hold both a contractor’s licence and a business licence before the permit is issued, and the contractor licence is administered through the city’s own online licensing system rather than at the building counter.

Who handles permitting in Independence?

Building Inspections, part of Community Development at Independence Municipal Commons, 20201 East Jackson Drive, provides code inspections for all new residential and commercial construction that has applied for a permit and issues plumbing, electrical and construction permits. The Regulated Industries Division of the same department handles business licences.

The commission structure is prescriptive about who sits on it, which is unusual enough to be worth knowing when an appeal is in prospect: three members must be licensed as a general contractor, commercial remodelling contractor, commercial or residential contractor, or residential contractor, one must be an architect or licensed engineer, and one must be a resident of Independence.

On the commercial side the licensing gate is doubled up with the business licensing regime. Businesses operating in Independence must obtain all required licences and permits before conducting business or making certain modifications to their facilities, and in most instances building permits require plans designed by a Missouri certified architect or engineer.

In 2025, building permits issued in Independence authorized 140 new privately owned housing units, 48 of them single-family homes, according to the U.S. Census Bureau Building Permits Survey.

Residential permits

Residential permits are required for any detached garage or carport greater than 120 square feet. Structures below that threshold need no permit but remain subject to the setback requirements, which is the trap: no permit does not mean no rules. Applications need a plot plan showing all proposed and existing structures with distances to all adjacent property lines, street locations and names, and the size, location and square footage of existing accessory buildings.

Commercial permits

Commercial work requires plan review for most tenant improvement projects, including interior renovations affecting structural, mechanical, electrical or plumbing systems. Floodplain development permits attach where work involves site work, filling or construction in the regulated floodplain, and a health department review fee applies to some proposed uses.

Licences, trade classifications and design professionals

Practically, three credential layers appear on Missouri projects: any local contractor licence or registration that applies where you are building; trade licences for electrical, plumbing or mechanical work (local, except that electrical can also be the optional state licence); and, on commercial and larger residential work, drawings sealed by a Missouri-licensed architect or professional engineer, whose licence is issued and enforced by the state. In Missouri the first cause of delay is filing with the wrong body — with the municipality where the parcel is unincorporated, with the county where the county never adopted a code, or with neither where a fire protection district holds the fire code. After that comes the edition question, because the jurisdiction chose its own edition and may be one or two cycles behind the current model code. Frequently asked questions

Is the licence surcharge still collected?

No. The City Council approved a moratorium on the New Construction Licence Surcharge on the first of October, 2018 under Ordinance 18939, and it remains in effect until repealed by Council action. The city’s April 2026 permit applications no longer ask for a surcharge form.

What licences does my contractor need?

Both a contractor's licence and a business licence, before the permit is issued. Contractor licences are handled through the city's own online licensing system. For the main building trades, Missouri has only one state licence: the optional statewide electrical contractor licence under RSMo sections 324.900 to 324.945, administered by the Office of Statewide Electrical Contractors, which began accepting applications on 1 July 2019. Under section 324.925 every political subdivision must recognise it in lieu of a local electrical licence; if one still refuses 30 days after the state notifies it of a complaint, its local sales tax revenue is held back until it complies. There is no state general contractor, plumbing or mechanical licence, so those credentials are local (city or county). Separately, where a city or county licenses construction contractors, section 287.061 requires it to obtain proof of workers’ compensation cover, or a signed exemption affidavit, before issuing the licence.

Which code does Independence use?

The 2024 International Building and Residential Codes and the 2023 National Electrical Code, adopted locally by the city with amendments. Missouri has no mandatory statewide building code for private construction. A code applies to a parcel only because some body adopted one — a county, fire protection district or municipality — usually by incorporating a published model code by reference under the procedure in RSMo section 67.280. A copy of the adopted code is filed with the clerk of that community and kept available for public inspection. So the edition, the amendments, the exempt list, the fee schedule and the permit validity period are all local questions, and in some parts of the state the answer is that no code was ever adopted at all.
