Inside Liberty, permits come from the City’s Building Division, not Clay County, and every structural, electrical, plumbing and mechanical job needs one. Applications are filed online in SmartGov and checked against the 2018 International Building and Residential Codes and the 2017 National Electrical Code; the City’s posted fee sheet charges by project value, for example $337 in the $90,001–$100,000 band, plus plan review.

What requires a building permit in Liberty?

City Code requires a permit from the Building Inspection Division to build, enlarge, alter, repair, move, demolish or excavate for any building, structure, sidewalk, driveway or utility, and for electrical, plumbing and mechanical installations. Ordinary repairs, maintenance and minor alterations are exempt, and emergency work may start first if the permit is applied for within 72 hours.

Permit needed

  • New buildings, additions and remodels
  • Decks more than 30 inches above grade, and every attached deck
  • Accessory buildings over 200 sq ft
  • Pools and hot tubs more than 2 feet deep
  • Lawn irrigation systems
  • Satellite dishes over 1 meter
  • Demolition

No building permit

  • Fences up to 6 feet (zoning and corner sight rules still apply)
  • Ordinary repairs and maintenance
  • Detached accessory structures of 200 sq ft or less (zoning limits still apply)

In Liberty’s historic districts, a Certificate of Appropriateness is needed before construction begins, and a structure designated historic needs one before a demolition application can be started.

Liberty building department: who handles permitting

The Building Division of the Planning & Development Department receives and reviews plans, issues permits, schedules and performs inspections, and administers the Residential Rental Occupancy Code and Dangerous Building Code. Jeremy Adams is the Chief Building Official. Clay County Planning & Zoning issues permits only outside city limits.

Applying in Liberty: SmartGov and submittals

Building permit applications are submitted online through the City’s SmartGov portal, which also handles business and contractor licences. Fees can be paid by card online, or by check, cash or card at City Hall. Every contractor on the job must be licensed with the City before a permit is issued.

  • Residential: one electronic or paper set of construction plans and a site plan where applicable.
  • Commercial: one electronic set and two paper sets of plans, plus a site plan.
  • New house or duplex: a plot plan sealed by a Missouri-licensed land surveyor, showing setbacks, easements, finished grades, basement and garage floor elevations, the sewer stub and erosion control. Plot plans missing any listed item are returned as deficient.
  • Structural details on the plans: footing and foundation design, pier locations, joist, beam and header sizes, stud spacing and roof framing.

The City also publishes summary guides for decks, accessory structures, pools, solar, roofing ice barriers and mobile homes. A demolition permit requires proof that the property owes no delinquent taxes or liens, a right-of-way damage report and verification that all utilities are disconnected; it is valid for 30 days.

Liberty permit fees

City Code sets permit fees by the schedule of fees approved by the City Council and kept by the deputy city clerk. The building fee sheet the City posts is dated July 1, 2018. Fees are based on project value, and the application asks for the construction, electrical, plumbing and mechanical values to be listed separately.

The full sheet has 24 value bands up to $100,000. Work started without a permit pays double. The sheet also lists water system charges and sewer connection fees by tap size, but its figures are inconsistent (the 1-inch charges are exactly ten times the 3/4-inch ones), so ask the City for current tap charges. Public works permits for sewer, water main and street work are 5% of construction cost, land disturbance permits run from $150 (1–5 acres) to $750 (over 20 acres), and right-of-way permits are $45 per parcel or $200 per block.

Electrical, plumbing and mechanical work in Liberty

Trade work is permitted and inspected by the Building Division, and the fee is figured from the value listed for each trade. Anyone installing, remodeling or repairing electrical, plumbing or heating and air-conditioning work needs a City craftsman’s licence, which requires a proficiency exam; a firm keeps its licence only while the person who passed the exam stays with it. City Code makes craftsman licences due July 1 each year; the City’s licence page says licences run for one year from the month of issue.

For the contractor business licence, electrical, plumbing and mechanical firms must show a proficiency test dated 2003 or later with a score of at least 75%, or a master-level certificate from Kansas City, Missouri or Johnson County for that trade. All contractors need general liability insurance and workers’ compensation or a signed exemption. Lawn irrigation must be installed by a licensed contractor, and heads within 11 feet of the curb also need a right-of-way permit and a notarized release.

A homeowner may obtain a permit for work on the single-family home he or she owns and lives in, provided the owner buys the materials and does all the labor personally.

How to get a Liberty building permit

1. Check zoning first

Call a City planner for setbacks, accessory building limits and historic district rules.

2. License the contractors

Make sure the general contractor and every trade subcontractor hold current Liberty licences.

3. Apply in SmartGov

Enter the project value by trade and upload the plans, site plan and, for a new house, the sealed plot plan.

4. Answer plan review

Staff review the plans against the adopted codes and the City’s zoning rules.

5. Pay the fees

Pay online by card or at City Hall; the invoice shows each fee.

6. Book inspections

Call the recorded line or use SmartGov at least 2 hours ahead, and pass the final before occupying.

Liberty inspections

All required inspections are printed on the permit. Request them through SmartGov or on the recorded line, 816-439-4541, leaving your name, phone number, job address and permit number, at least 2 hours ahead. Inspections run Monday to Friday, 8 a.m. to 4:30 p.m., and are made within 24 hours of the request. Rough-ins must be approved before anything is covered, and the first re-inspection is free.

A 30-day temporary occupancy permit can be issued for a new building or commercial tenant finish once all life-safety items are done; new buildings also need Planning and Engineering sign-off, and the term can be extended for exterior work delayed by weather.

Local Liberty rules

Rental housing: the Residential Rental Occupancy Code applies to every residential building that is not owner-occupied. Units are inspected under a systematic inspection program, and tenants can request an inspection if a landlord leaves deficiencies unrepaired. Call 816-439-4541 to schedule one.

Floodplain: Liberty is in the National Flood Insurance Program on Clay County maps dated August 3, 2015. The City Engineer administers the floodplain rules and issues floodplain development permits. In the floodway fringe, the lowest floor, including the basement, must be 1 foot above the base flood elevation, and an elevation certificate is required for construction in or next to a floodplain buffer.

Accessory buildings: they must sit in a side or rear yard, at least 5 feet from lot lines and 10 feet from other structures, with footprints capped by lot size (800 sq ft on lots under half an acre). Buildings over 400 sq ft need frost footings, and metal panels are not allowed as siding.

Demolition: the Utilities Department (816-439-4778) must inspect the capped water and sewer services, foundations must be removed to 18 inches below grade, and the state Department of Natural Resources must be notified 10 working days before asbestos-related demolition.

Missouri building code

Missouri has no mandatory statewide building code for private construction: a county, fire protection district or municipality may adopt one (usually by reference under RSMo 67.280), and in parts of the state none has. Building codes in Missouri
