Benton County has adopted neither a building code nor planning and zoning, so there is no county building permit for unincorporated land. The county’s own steps are a 911 address from Central Dispatch, a septic permit from the Benton County Health Department and floodplain review by Emergency Management. Since August 10, 2026 a Commission moratorium on data centers has been in place. Warsaw, Lincoln and Cole Camp each require building permits inside their limits; in Warsaw a new house costs $0.25 per sq ft of finished living space with inspections included.
Benton County building department: who handles permitting
No county office issues building permits. Commission minutes record the question coming up repeatedly: in January 2024 the commissioners said adopting the International Building Code had merit but would be very costly, and from February 2025 to September 2026 the Presiding Commissioner told residents asking for planning and zoning that, on the advice of the county’s counsel, it would have to be approved by a vote of county residents. The Commission meets on Mondays from 9:00 a.m.; to get on the agenda, call the County Clerk at 660-438-7326. The Commission’s own number is 660-438-7406.

Commercial valuations are worked out from building valuation data, the 2003 Missouri modifier and the floor area. A Warsaw permit lasts one year, and the Code Enforcement Officer can extend it by up to 180 days for unavoidable delays. In Cole Camp, plans must be drawn to scale and show the distances to every lot line; its residential guidelines limit houses to 2½ stories or 35 ft, require 25 ft front and rear yards and 10 ft side yards, and cap lot coverage at 30%.

Call 1-855-478-4290 →Septic systems: the Missouri Department of Health and Senior Services lists the Benton County Health Department, 1238 Commercial, Warsaw (660-438-2876), as the permitting authority under the county’s own onsite wastewater ordinance, which may add requirements beyond the state minimum.
Floodplain: Benton County is in the National Flood Insurance Program on flood maps dated June 2, 2009, and SEMA lists the county’s floodplain administrator at the Emergency Management office, 1231 Hirsch Parkway, Warsaw (660-438-9555). Commission minutes from March and April 2025 discuss new flood maps that FEMA and SEMA have proposed for the county. Warsaw and Lincoln also take part in the program; FEMA lists Cole Camp as not participating.
