Building permits anywhere in Orange County, including inside the towns of Orange and Gordonsville, are issued by the County’s Development Services Department. Its Permit Center at 128 W. Main Street, Orange (540-672-4574) takes applications at the counter, by email and through the online Application Portal for Plans & Permits. Under the FY27 fee schedule a new house costs $0.25 per square foot plus $150 for plan review and a 2% state surcharge.

What needs a permit in Orange County?

The County’s short answer is that new residential and commercial construction needs a permit, with exemptions for small detached structures and ordinary repairs. Its FY27 fee schedule shows how widely “construction” is read, because each of these has its own permit fee:

Residential

  • Stick-built, modular and manufactured dwellings
  • Additions, alterations and finished or heated basements
  • Decks, porches and ramps
  • Garages, carports, sheds, docks and gazebos
  • Fences and retaining walls
  • Above-ground and in-ground pools and hot tubs
  • Fireplaces, chimneys and gas logs
  • Generators, irrigation systems, water and sewer lines
  • Roof and ground solar panels
  • Demolition and storage tanks

Commercial

  • New construction, additions and alterations
  • Re-roofs and accessory structures
  • Signs and cell towers
  • Tents over 900 sq ft or 50 people
  • Temporary construction offices
  • Range hoods, hood suppression, furnaces and gas lines
  • Fuel dispensing pumps and backflow prevention
  • Pools, hot tubs and spas
  • Amusement ride inspections

The County publishes the code’s exemption list as “When is a Permit Required?”. It includes one-story detached tool or storage sheds and playhouses of up to 256 sq ft, most fences, and retaining walls holding back less than 3 ft of fill. Farm buildings on a working farm are exempt from the building code, and the County has a Farm Buildings or Structures Exemption Form for them, but the exemption does not reach a building used as a restaurant, and farm brewery, winery or distillery buildings and structures in the 100-year floodplain still need zoning approval.

Who issues building permits in Orange County?

The Building Inspections unit of Development Services reviews plans and inspects construction in Orange County and its two towns. Michael Guidry is the Building Official. The Permit Center, in the same office, is the front desk for building, zoning, erosion and sediment control, site plan and plat applications.

Town of Orange: the Town’s own FAQ says building permits are obtained from the Orange County building office, after you get a zoning permit from the Town’s Community Development Department at 235 Warren Street (540-672-6917). The Town requires a zoning permit whenever a building or structure is erected, reconstructed, structurally altered, enlarged or moved.

Town of Gordonsville: the Town handles zoning from its office at 112 South Main Street (540-832-2233, weekdays 8:00 a.m. to 4:30 p.m.), with separate zoning permit forms for commercial lots and for R-1, R-3 and AG lots, plus a Historic Overlay District and its own floodplain ordinance. Building permits and inspections for Gordonsville come from the County.

Orange County permit applications and the online portal

Applications can be started in the County’s online Application Portal for Plans & Permits or handed to Permit Center staff, who will work out which forms the job needs. For a house that normally means three applications reviewed together: building, zoning and land disturbance.

Forms and guides posted by Building Inspections:

  • Building Permit Application and Trade Permit Application
  • Authorized Agent / Owner / Contractor Affidavit
  • Residential and Commercial Plan Submittal Checklists
  • Items Needed to Apply for a Building Permit (revised January 16, 2025)
  • Duct Leakage and Blower Door Combined Form and Energy Efficiency Certificate
  • Farm Buildings or Structures Exemption Form
  • Third Party Inspection Form and the list of Approved Third Party Inspectors

Contractors are licensed by the state, not the County. Bring a copy of the contractor’s state licence with the application.

Permit costs and fees in Orange County

These figures are from the building section of the County’s FY27 Tax and Fee Schedule. Inspections are included in the permit fee. A 2% state surcharge is added to permit and inspection fees when you apply, and staff calculate the final amount once the plans are in.

Plan review is $200 under 5,000 sq ft, $250 from 5,000 to 50,000 sq ft and $300 above that. Trade permits in Orange County

Trade work is filed on the County’s Trade Permit Application and issued by the same Building Inspections unit. The FY27 schedule charges residential electric, mechanical, plumbing, alarm, fire suppression and gas permits at $0.15 per sq ft with a $100 minimum, and electric to an accessory structure at the same rate. Commercial trade permits, including solar fields, are $0.20 per sq ft with a $150 minimum.

Some small jobs have flat fees: $50 for a residential water or sewer line, $150 for an irrigation system, $75 for a fireplace, chimney or gas logs, and on commercial jobs $100 each for an electric upgrade, gas line, furnace or backflow preventer.

New homes need the Duct Leakage and Blower Door Combined Form and an Energy Efficiency Certificate, and the County keeps a list of approved third-party inspectors for work that uses one. Wells and septic systems are permitted by the Orange County Health Department, part of the Rappahannock-Rapidan Health District, at 450 N. Madison Road, Orange (540-672-1291).

Application documents for Orange County

To apply (residential)

  • Building permit application completed for the project
  • 2 sets of building plans, one to scale and one at 11 x 17 inches, plus the ACCA Manual J heating and cooling calculation
  • As-built drawing of the drain field, well and house area, for new construction, additions, accessory buildings and garages
  • Copy of the contractor’s state licence
  • Zoning permit for new construction, additions, decks and porches
  • Recorded plat showing the setbacks on all four sides
  • For a new dwelling, the Agreement in Lieu of an Erosion and Sediment Control Plan application

Before the permit is released

  • Zoning permit, if one applies
  • Health Department permit, if one applies
  • Erosion and sediment permit and its completed inspection
  • 911 address for new construction

If you have no as-built of the septic system and well, the County can ask the Health Department for a walk-over inspection. An older County FAQ still asks for one set of plans; the January 2025 list asks for two.

What the plans must show: the Residential Plan Submittal Checklist is written to the 2021 Virginia Residential Code and asks for design criteria on the drawings: 90 mph wind, 30 lb snow load, exposure B and seismic design category B. It also asks for braced wall design, footing, framing, deck and insulation details, and a shrink-swell soil report where the lot is in or within 1,000 ft of a high expansive soil area. Options that will not be built must be crossed off the plans.

Commercial: the commercial checklist adds a cover sheet, 2 copies of the site plan, use group, occupant load and construction type, fire-rated assembly design numbers, a fire protection system plan and asbestos testing results before renovating an existing building.

How to apply: 6-step Orange County process

1. Start with zoning

In the Town of Orange or Gordonsville get the town’s zoning permit; elsewhere the County zoning permit is part of the Permit Center package.

2. Get Health Department permits

Well and septic permits from the Orange County Health Department must be in place before a building permit is issued.

3. Submit plans and applications

File the building, zoning and land disturbance applications with 2 plan sets and the recorded plat, in the portal or at 128 W. Main Street.

4. Request the 911 inspection

Install the driveway, mark the 4 house corners, then call 540-672-4574; no permit is released until the address is assigned.

5. Pay when the permits are ready

Fees are calculated from the reviewed plans and are payable when the permits are ready to issue.

6. Book inspections

Schedule each inspection with the Permit Center by phone, email or portal through to the Certificate of Occupancy.

Inspections and completion in Orange County

Permit Center staff schedule inspections by phone (540-672-4574), by email or through the online portal. The inspections themselves are covered by the permit fee; a repeat visit is $50 on a residential job and $75 on a commercial one, and an investigative or specially requested inspection costs the same.

Before a Certificate of Occupancy for a house, the County checks four things beyond the final inspection:

  • The site is clean.
  • The address is posted on the house, and by the road if the house cannot be seen from it.
  • All approvals to use the well and septic system have been issued.
  • There is a way in and out for emergency crews, such as a sidewalk or walking path, through a hinged 3 ft door.

A temporary occupancy permit is $50 for a residence and $125 for a commercial building.

Local Orange County details that matter

Land disturbance: disturbing 10,000 sq ft or more needs an approved erosion and sediment control plan, a Land Disturbance Permit and a bond. The threshold drops to 2,500 sq ft inside either town and on any residentially zoned property. For a detached single-family house the program administrator may accept an Agreement in Lieu of a plan ($100), but the permit and bond are still required, and every permitted site needs a certified Responsible Land Disturber. The Land Disturbance Permit is $250 plus $25 per acre. The County runs this program for both towns as well.

Stormwater: Virginia DEQ, not the County, administers stormwater management here. Sites disturbing 1 acre or more apply to DEQ directly, and DEQ approval has to come before the County approves a site plan or subdivision.

911 addresses: the County does not assign addresses to vacant land. The address is assigned from a site visit once a dwelling permit is applied for and the driveway and corners are in place.

Zoning fees: the FY27 schedule sets a zoning permit at $100 for a residence, $50 for a non-commercial accessory structure and $150 for a commercial project, with an administrative site plan included. A floodplain permit or LOMR review is $250.

Airport approach zones: farm structures in the approach zones of the Orange County Airport or the Gordonsville Municipal Airport are not exempt from zoning.

Virginia building code

Every Virginia locality enforces the Uniform Statewide Building Code, 2021 edition, in effect since 18 January 2024. No Virginia locality can adopt its own building code or amendments, so what varies locally is zoning conditions, historic districts and flood plain rules. How Virginia’s statewide code works
