Building permits in Fauquier County are issued by the county’s Building, Permitting & Inspections division of Community Development, at 16 Courthouse Square in Warrenton. The Town of Warrenton runs its own building department; the county enforces the code in The Plains and Remington.
This guide covers the department and how to reach it, the local conditions that survive state preemption, what permits cost and who may pull them, and how inspections are booked. Rules that apply everywhere in Virginia are summarized in each section, with a link to the full statewide explanation.
This guide covers work inside Fauquier County.
A conservation easement can stop a building the code and the zoning would both allow. Easements are private restrictions recorded against the deed and held by a land trust or public body — the building department does not administer them. Check the title for easements before design.

Who handles permitting in Fauquier County?
Fauquier borders Loudoun and Prince William Counties. Conservation easements protect land across the county; the county’s purchase of development rights program alone had protected over 12,900 acres by March 2021.
An easement is a private restriction held by a land trust or public body, recorded against the deed. It is not a building code provision, it is not a zoning ordinance, and the building department does not administer it — but it can prohibit outright a structure that the code and the zoning would both allow. On a rural Fauquier parcel, check the title for easements before design.
The county contains three incorporated towns: Warrenton, The Plains and Remington. A Virginia town remains part of its county. The Town of Warrenton runs its own building department (21 Main Street, 540-347-2405), while the county enforces the building code in The Plains and Remington; the state’s online directory of building officials lists both under Fauquier County.
Agricultural land brings the § 36-99 farm building exemption into play, along with the conditions that attach when the public is invited into a farm building for agritourism where farm products are displayed, sampled or sold.

The permit is a lien document in Virginia
On a one- or two-family dwelling, Fauquier County’s building department prints the mechanics’ lien agent on the permit itself. Virginia Code § 36-98.01 requires that a building permit issued for any one- or two-family residential dwelling unit contain, at the time of issuance and at the applicant’s request, the name, mailing address and telephone number of the mechanics’ lien agent as defined in § 43-1. If the applicant does not request a designation, the permit must state, in those words, “None Designated.”

How to apply for a Fauquier County building permit
An easement is a private restriction the building department does not administer, and it can prohibit what the code allows.
Warrenton permits its own work; the county permits The Plains and Remington.
The Marshall Historic District and local floodplain rules survive state preemption.
Licensed restaurants are not exempt, flood-proofing still applies, and an agritourism building that displays or sells farm products needs posted signs.
Zoning and conditions on rezoned land are administered locally.
Keep the permit posted and an approved set of plans available on site.
If Fauquier County denies an application it must explain the reasons in writing (§ 36-105), and a full re-review of the resubmission is lawful. Appeals go to the local Board of Building Code Appeals before the State Building Code Technical Review Board. Denials, corrections and appeals in Virginia

Frequently asked questions
Does a building permit override a conservation easement?
No. A conservation easement is a private restriction recorded against the deed and held by a land trust or public body. The building department does not administer it, and an easement can prohibit a structure that both the building code and the zoning would allow.
Who enforces the code inside Warrenton?
The Town of Warrenton, which runs its own building department at 21 Main Street (540-347-2405). Warrenton remains part of Fauquier County, but the county permits only The Plains and Remington among the towns.
Inspections are where schedules slip.
Get a free quote →Which building code applies in Fauquier County?
The 2021 Virginia Uniform Statewide Building Code. Under § 36-98 the statewide code supersedes local building codes, so the county does not adopt its own edition; what varies locally is zoning, rezoning conditions, historic districts and floodplain rules.
Are farm buildings exempt from the building code?
Under § 36-99, yes, with limits. The exemption turns on the use of the building. A farm building operated as a licensed restaurant is not exempt, exempt buildings in a flood plain remain subject to flood-proofing regulations, and a building where the public is invited in for agritourism and farm products are displayed, sampled or sold must have extinguishers, a written emergency plan and a posted exemption sign of at least 24 by 36 inches.
What happens when a farm adds an events business?
The agritourism conditions can attach. Inviting the public into a farm building for recreational, entertainment or educational purposes, where the building is also used for the display, sampling or sale of farm products, triggers the extinguisher, emergency plan and posted sign requirements even though the building itself remains exempt from the code.
What if my application is denied?
Section 36-105 requires the department to give a written explanation detailing the reasons. On a revised application the department is encouraged, but not required, to limit its review to the portions previously found inadequate, so a full re-review remains lawful.
