The City of Fair Oaks Ranch Building Department at 7286 Dietz Elkhorn issues and inspects permits inside the city limits, and applications are emailed to bcodes@fairoaksranchtx.org. A new home costs $0.60 per square foot with inspections included, and a complete new home application normally takes 10 business days.

What requires a permit in Fair Oaks Ranch?

The City publishes a separate application and permit packet for each of these kinds of work:

  • Gutters, screens, awnings and alarm systems
  • Storm doors and windows, unless the size changes
  • Non-structural flatwork such as patios and sidewalks, and driveway replacements
  • Landscaping and decorative stone up to 18 inches high
  • Prefabricated pools under 24 inches deep, and play equipment

Even exempt work in easements, rights-of-way or setbacks may need approval from the property’s restrictions committee.

Who handles permitting in Fair Oaks Ranch?

The Building Department permits and inspects buildings and other construction inside the city limits, enforces the City’s adopted codes and registers contractors. Fair Oaks Ranch straddles Bexar, Kendall and Comal counties, but the City handles permits for the whole incorporated area.

Fair Oaks Ranch permit fees

Fees come from the City’s Building Permit Fees schedule effective June 20, 2025. Inspection costs are included in the permit fee. Remodels, additions, detached buildings and miscellaneous permits add a fixture fee for each item installed.

Fixture fees are $2.50 for each light fixture, receptacle, switch, sink, toilet, tub or shower, smoke or CO detector and similar item; $5 for each electric panel, EV charger, generator, water heater, water or sewer line and water softener; and $10 per ton of HVAC capacity. A 2,500 sq ft new home costs $1,500. Starting work before the permit doubles the fee, occupying a building before its Certificate of Occupancy costs $600, a 60-day extension of an expired permit costs half the original fee, and cancelling an issued permit costs 20%.

Electrical, plumbing and mechanical work

The City’s application list has no separate electrical, plumbing or mechanical permit: those items are priced as fixture fees on the building, remodel, addition or miscellaneous permit, and water heaters and softeners have their own permit packet. The general contractor, electrician, plumber and mechanical contractor must each be registered with the City for one year at a time; plumbers and electricians are exempt from the $75 fee, and a Texas-licensed contractor qualifies by showing a current licence with the registration form. Call 210-698-0900 to check that your contractor is registered before applying.

For new homes the City requires an electrical diagram showing each breaker, wire size and the equipment it feeds, signed and dated by the person who prepared it. Inflatable test balls may not be used for drain, waste and vent water tests; use a glued cap, a wing-nut test plug or a mechanical or pneumatic clean-out plug instead.

New home submittal checklist

  • New Home Permit Application, signed and dated
  • A Contractor Registration Form for each contractor
  • The City’s construction guidelines, signed and dated
  • Owner’s Letter of Approval to Build (not needed for a spec home)
  • Plot plan with setbacks, easements, any floodplain, utility lines, drainage arrows, water meter and fire hydrant
  • Electrical diagram
  • Engineered foundation plans sealed by a Texas professional engineer, with the slab at least 15 inches above scraped grade
  • Floor plans, preferably at 1/4 inch = 1 ft, and exterior elevations
  • Energy worksheet (REScheck or similar)
  • Deck or framing plans, where they apply
  • A SWPPP for lots of 1 to 5 acres, and the TCEQ Notice of Intent where one is required

A complete new home package is normally processed in 10 business days, according to the August 2026 packet. The City’s Permits Process page gives 5–7 business days for other residential permits and 14–16 for commercial permits. Incomplete packages are set aside until the missing items arrive, and permits are handled first in, first out.

How to apply in Fair Oaks Ranch

1. Get HOA approval first

Owners must obtain deed-restriction and architectural review committee approval before construction, and check for easements on the lot.

2. Settle any variance

A required variance must be approved before the permit can be issued.

3. Register the contractors

File the Contractor Registration Form for the general, electrical, plumbing and mechanical contractors.

4. Email the complete package

Send the signed application and every attachment to bcodes@fairoaksranchtx.org.

5. Pick up and sign the permit

The City calls when the permit is ready and tells you the amount due; the permit is not valid until both you and the City sign it.

6. Post it and start work

Display the permit where it is visible from the street before any work begins.

Inspections and closeout

The contractor named on the permit books inspections through the City’s online scheduling link or by calling City Hall at 210-698-0900, and must be present for each one. The Inspections page asks for at least 48 hours’ notice, while the August 2026 new home packet says 24 hours. After each visit the inspector emails an approval or disapproval form, and any item marked for correction must be fixed and re-inspected before work continues. The fee schedule sets re-inspections at $60; the new home packet says a re-inspection fee applies once a phase has failed twice.

A new home is inspected at plumbing rough-in, foundation (with a stamped form survey), framing with electrical and mechanical, plumbing top-out, water and sewer lines, and final; an insulation certificate replaces the insulation inspection. Missing an inspection carries a penalty: $400 for a rough-in, framing, top-out or utility line inspection, $500 for pouring a foundation without inspection (plus an engineer’s certification within 14 days or removal of the slab), and $600 for occupying a house before the final. New home permits last 12 months and driveway permits 9 months.

Local Fair Oaks Ranch rules

Construction hours: under Ordinance 2021-07, permitted work may run from 7:00 a.m. to 7:00 p.m. Monday to Friday, from 8:00 a.m. on Saturday and from 9:00 a.m. on Sunday. Residential foundation pours may start at 6:00 a.m.

Job sites: new construction sites need a dumpster with four sides and a bottom by the start of framing, a chemical toilet of at least 45 gallons if there is no plumbing, staked side and rear property lines and protected curbs. Fresh cuts on oak trees must be painted within 30 minutes, and burning is not allowed during construction.

Driveways: approaches are 12 to 20 ft wide and at least 4 inches thick. Where a curbless street has a drainage channel, any culvert must be at least 18 inches, designed by a professional engineer and approved by Public Works.
