Yankton County, South Dakota Building Permit Guide

Yankton County Planning & Zoning issues building permits for unincorporated land and its townships, with applications filed online; the City of Yankton covers its city limits and one-mile extraterritorial area, Gayville, Mission Hill and Irene issue their own, and Lesterville, Utica and Volin lie outside County zoning.

In unincorporated Yankton County, including the organized and unorganized townships, building permits come from the County Planning & Zoning Office, 321 W 3rd Street, Suite 209, Yankton ((605) 260-4400, option 9). The fee is $50 plus $3 per $1,000 of valuation; in September 2026 the County charged $947 for a $300,000 house, and a permit taken out after construction costs an extra $500.

What needs a county building permit?

Section 1721 of the County zoning ordinance requires a permit from the Zoning Administrator before construction starts on any building or structure that is:

Permit needed

  • Erected, partly erected, moved, added to or structurally altered
  • Changed significantly in its use
  • In need of extra land or area for the improvements, whatever the cost
  • A sign (the County’s online application covers signs)

Exceptions (amended October 18, 2022)

  • Remodeling, improvements or maintenance with no structural change and no extra land or space
  • Concrete slabs on grade
  • Fences, corrals and windbreaks (visibility rules still apply)
  • Semi-portable agricultural structures
  • One accessory building of up to 120 sq ft without a sub-grade foundation

The County’s FAQ is broader than the ordinance: it says all buildings, structures, exterior remodeling and signs need a County permit. State law (SDCL 11-10-15, 2026) also bars a county from requiring a permit for the repair or substantially similar replacement of same-size doors and windows, downspouts, fascia, fence panels or posts, gutters, nonstructural siding and soffits on an owner-occupied detached single-family house.

Who issues building permits in each part of Yankton County?

The County zoning ordinance applies to the unincorporated county, organized and unorganized townships included, but not to the seven incorporated communities or to the City of Yankton’s extraterritorial jurisdiction.

County applications, all filed online

Yankton County takes its Planning & Zoning applications through online forms linked from the department page:

  • Building Permits/Signs Application, with an elevation drawing, a floor plan and a site plan showing the structure and its distance from every property line
  • Floodplain Development Permit Application for work in mapped flood hazard areas
  • Drainage Permit Application and drainage public hearing application under the County Drainage Ordinance
  • E911 Address Request for a new building site
  • Conditional Use, Variance and Plat Approval applications for the County’s boards

The online forms do not work in Internet Explorer. Once issued, the permit must be posted along the property’s road frontage, visible from the nearest public access, within five working days and kept there until the work is finished; a property with no road frontage posts it on the nearest available right-of-way and on the site.

Yankton County permit fees

The County Commission approved the current Planning & Zoning fee schedule on November 5, 2019, effective November 27, 2019. All fees are paid with the application, are non-refundable, and checks are made payable to Yankton County.

Yankton County Planning & Zoning fees
ItemFee
Building permit, value up to $1,000$50
Building permit, value $1,000 and above$50 plus $3 per $1,000 of valuation

Variance / rezone or amendment$450 each
Conditional use$300

The County’s monthly permit reports show how the rate is applied: in September 2026 a $300,000 house and accessory building was charged $947, a $500,000 house $1,547 and a $5,000 deck $62, which matches $50 plus $3 for each $1,000 above the first $1,000.

Town fees: Gayville charges a flat building permit fee by construction cost, from $50 for work up to $25,000 to $500 above $400,000, and $100 for a zoning variance. Mission Hill’s building permit is $20.

Electrical, plumbing and septic systems

County Planning & Zoning issues no electrical or plumbing permits. Wiring is permitted and inspected by the South Dakota Electrical Commission, and plumbing by the South Dakota Plumbing Commission; Yankton County is in the Plumbing Commission’s South Central region (605-295-1233), which asks for at least 72 hours’ notice of an inspection.

For individual septic systems on lots of one acre or less, or wherever the Zoning Administrator decides the density of development calls for it, section 1513 requires soil suitability, a percolation test and the system’s effect on nearby systems to be assessed before the lot is built on. The site plan for any building permit must also show the planned utility and sewer connections, central or individual.

Site plan and drawings for a County permit

Every building permit application needs an elevation drawing, a floor plan and a scaled site plan. Section 1723 lists what the site plan shows:

  • The location and topography of the structure, nearby landowners and the distance to state, federal, county, township or city roads
  • A north arrow
  • The real dimensions and shape of the lot
  • Existing buildings and the size and position of the new building or alteration
  • Property lines and the square footage of the new structure
  • All easements and rights-of-way
  • The road and walkway plan
  • Utility and sewer plans, with the proposed connection to central or individual services
  • Site drainage and the effect on culverts

Applications must be signed or approved in writing by the owner of record; a buyer with a binding purchase agreement contingent on the permit may apply instead. If the County refuses a permit, the Zoning Administrator gives the reasons in writing.

How to get a Yankton County building permit

1. Confirm County jurisdiction

Check that the land is outside the incorporated towns and outside the City of Yankton’s extraterritorial area.

2. Check zoning and flood maps

Look up the district, setbacks, the 66-foot right-of-way corridors and the 2025 flood maps for the parcel.

3. Get side approvals

Apply for any variance, conditional use, floodplain, drainage, entrance or E911 address approval the project needs.

4. Apply online

Submit the Building Permits/Signs Application with the elevation, floor plan and site plan, and pay at application.

5. Post the permit

Place it along the road frontage within five working days and keep it up during construction.

6. Build on schedule

Start within 180 days, finish within two years, and book state electrical and plumbing inspections.

Permit expiry and enforcement

A County building permit expires if work has not started within 180 days of issue or is not completed within two years. When unforeseen circumstances arise, the Zoning Administrator can grant one six-month extension. A permit authorizes only the use and construction shown in the approved plans; anything different is a violation.

Violations of the zoning ordinance carry penalties of up to $200 per violation, up to 30 days in jail, or both, and starting without a permit adds the $500 post-construction fee. The zoning ordinance sets no inspection stages for a County permit; electrical and plumbing work is inspected by the state commissions.

Local Yankton County rules

Floodplain: the 2025 Flood Prevention Ordinance appoints the County Floodplain Administrator, and the County posts National Flood Insurance Program and FEMA flood maps for the organized and unorganized townships.

Drainage: under Ordinance 19, the 2026 County Drainage Ordinance, a drainage permit is needed before excavating, installing or changing a drainage project, though routine maintenance of a permitted drain is exempt.

Right-of-way corridors: no structure may sit in a 66-foot corridor centered on each quarter and sixteenth section line where the ordinance applies.

Lakeside Commercial District: design guidelines added on December 16, 2025 govern new development that needs a building permit in that district.

Pending: data centers. On October 15, 2026 the office posted a proposed Article 30 that would require a conditional use permit for data centers, limit them to commercial and agricultural districts and cap them at 25 MW.

Gayville sidewalks: Gayville requires new or relocated buildings on lots without a sidewalk along the street to install one within 30 days after the building permit expires.

South Dakota building code

South Dakota has no state-enforced building code: each city or county decides whether to adopt one. The state Electrical and Plumbing Commissions permit and inspect those trades, except in a few cities that run their own inspections. South Dakota rules
