Clay County permit forms and the Planning Commission

The County posts 2026 versions of its forms on the Zoning page:

  • Clay County Building Permit: owner or agent, parcel ID and short legal description, type of development, a description with build plans attached, and the cost of construction. The form prints the minimum lot sizes and setbacks for each district.
  • New Home Building Permit: adds the house description and a section showing that the water and electrical utilities were contacted and approved service.
  • 911 Application: assigns a rural address; the County notifies Equalization, the 911 dispatcher and the post office and orders the address sign.
  • Plat, rezone and conditional use applications for the Planning Commission.

The County posts an application cut-off date about three weeks before each Planning Commission meeting (October 26 for the November 16 meeting, November 30 for December 21), and asks applicants to contact the Zoning Administrator by 9:00 a.m. on the Thursday before the meeting to be added to the agenda; if nothing is on the agenda the meeting is cancelled. Remaining 2026 County meetings are October 20, November 16 and December 21 at 5:15 p.m.; joint area meetings are November 23 and December 21 at 5:30 p.m.

Electrical, plumbing and septic in Clay County

The County’s permit form makes the applicant acknowledge that state wiring and plumbing inspections are required where they apply. Electrical permits and inspections come from the South Dakota Electrical Commission and plumbing from the South Dakota Plumbing Commission, both in the countryside and in the cities; Clay County is in the Plumbing Commission’s Southeast region (605-280-9243). The County’s 2011 building code ordinance for the joint area repeats that electrical and plumbing permits and inspections are obtained through the two state commissions.

In the Aquifer Protection Overlay zones the zoning ordinance requires new or replacement septic tanks and drain fields to meet the state rules (the ordinance names the former Department of Environment and Natural Resources, now the Department of Agriculture and Natural Resources).

What to bring for a Clay County permit

  • The completed County permit form (or the New Home form), with the parcel ID and short legal description
  • A description of the work and the build plans
  • A site plan showing the lot dimensions and the size, shape and position of the building, so setbacks can be checked
  • The estimated construction cost, which sets the fee
  • For a new house: confirmation from the water and electric utilities, and a 911 application if there is no address yet
  • For a new house in the A-1 Agricultural or NRC district: a Right to Farm Notice Covenant filed with the Register of Deeds before the permit is issued

In the joint area, someone applying for the owner may be asked for a sworn affidavit from the owner confirming the work is authorized.

1. Place the parcel

In the A-1 or NRC district, file the Right to Farm covenant before a new house permit can be issued.

6. Build on time

Start within 90 days, finish the bulk of the work within a year, and book the state electrical and plumbing inspections.

Inspections and expiry of County permits

A County permit expires if the work has not begun within 90 days or is not substantially complete within one year of issue. The County Assessor’s office may visit when the project is finished to review it for assessment.

In the joint zoning area the Zoning Administrator is charged with making the inspections needed to confirm compliance, and the County’s Ordinance 2011-05 adopted the 2009 International Building Code there, naming the City of Vermillion Code Compliance Office as the enforcement agency. Electrical work gets a state rough-in and final inspection; the Plumbing Commission asks for at least 72 hours’ notice.

Local Clay County details

Floodplain: the 2020 Flood Damage Prevention Ordinance (Ordinance 2021-01) makes the Zoning Administrator the Floodplain Administrator. The Zoning page also links FEMA guidance for homeowners after a flood.

Joint zoning with Vermillion: the joint area has its own zoning ordinance and map, adopted with the City of Vermillion, and its own Planning Commission meeting schedule. Building permits there still come from the County.

Right to farm: anyone building a new house in the A-1 or NRC district records a covenant acknowledging nearby farm operations, such as crop work, livestock production and spraying.

Wakonda timing: Wakonda’s permit requires construction to start within 60 days of approval, or a new application is needed.

South Dakota building code

South Dakota has no state-enforced building code: each city or county decides whether to adopt one. The state Electrical and Plumbing Commissions permit and inspect those trades, except in a few cities that run their own inspections. South Dakota rules
