In the City of Happy Valley, the Building Division reviews plans and issues structural, mechanical, plumbing, grading and demolition permits, all applied for and paid in the City’s HVWorks online portal. Electrical permits, fees and inspections are handled by Clackamas County. Under the fee schedule that took effect on July 1, 2026, the minimum building permit is $104, plan review is 65% of the permit fee, and the City adds the state surcharge of 12% of the permit fee.

The division works from Happy Valley City Hall at 16000 SE Misty Drive under Building Official Mark Ennis, PE, and answers on 503-783-3800. Happy Valley, entirely in Clackamas County, had 28,916 residents in the Census estimate for 2025. For a new house, the system development charges are far larger than the permit fee itself.

Addresses outside the city limits, including the unincorporated area around the city, are under Clackamas County for building permits; the City publishes a page explaining its limits.

What requires a building permit in Happy Valley?

The Building Division permits new buildings, additions, alterations and repairs under the state codes, and its fee schedule and checklists show the local rules around them.

City permits

  • New houses, which need building, electrical, erosion, mechanical, plumbing and sewer applications plus a Planning/Engineering review application
  • Decks, with their own submittal checklist; any deck 10 feet or more above grade needs engineering (policy POL 13-108)
  • Solar panel structural installations ($157 flat on the prescriptive path)
  • Demolition ($120 per building)
  • Grading of more than 25 cubic yards that is not part of a house foundation permit
  • Sewer connections and septic abandonment

No City permit

  • Grading of 25 cubic yards or less (no permit and no plan review fee)
  • Electrical work: no City permit, because the permit comes from Clackamas County
  • Work in the street: an Engineering right-of-way permit rather than a building permit

What the city decides and what the state holds

The code and its exemptions are statewide. Happy Valley sets its fees, adjusted every July by the West Coast consumer price index under Council Resolution 22-21, its HVWorks process, its submittal checklists and policies, its flood management overlay and land development code, and its construction hours.

Oregon’s building code and its exemptions are the same in Happy Valley as everywhere in the state, and an exemption from the building permit is not an exemption from zoning, land use or a trade permit. Site snow, wind and seismic values come from the state’s Oregon Design Criteria Hub. How Oregon’s statewide code works

Happy Valley building department: who handles permitting

The Building Division reviews residential, commercial and industrial plans and inspects. Planning handles land use under the Land Development Code, and Engineering issues right-of-way, grading and erosion control permits. Clackamas County runs the City’s electrical program. Sewer and surface water charges go to Clackamas County Water Environment Services (WES), and water service comes mainly from Sunrise Water Authority, with Clackamas River Water in parts of the city.

Permit types

Residential permits

The one- and two-family dwelling checklist (revised April 13, 2026) must be complete before the plan review start date. It asks for proof that land use actions are finished (plat recorded and signed off by Happy Valley Engineering and WES), zoning details such as setbacks, easements, flood plain and seismic soils designation, a soils report on steep slopes or fill, an erosion control plan, and a scaled site plan with 2-foot contours, finished floor elevations, the driveway slope, lot coverage, impervious area and any well or septic system. On a new house with a high deck, the deck engineering must be approved before the house framing inspection, because sloping lots here can put decks as high as 30 feet. Plans must use the City’s design values: roof snow load 25 psf, wind speed 95 mph with exposure B, and seismic design category D. Retaining or basement walls holding more than 4 feet of backfill or a surcharge need drawings and calculations stamped by an Oregon engineer. The City’s forms include a notice to owners about construction responsibilities.

Commercial permits

Commercial projects use the same valuation table, with valuation the greater of the ICC figure for the occupancy and construction type or the applicant’s stated value, plus a commercial fire and life safety review of 40% of the permit fee. Commercial mechanical permits are priced on the value of the mechanical work ($104 minimum) with a 25% plan review. Deferred submittals cost 65% of the structural fee for the deferred part, at least $273 an item, and phased construction review is $273 plus 10% of the total project permit fee. A pre-application consultation with two City staff members costs $164.

What comes before the building permit

For a new house, the plat must be recorded and the land use decision complete before the checklist is accepted. The WES sewer and surface water SDCs are paid to Clackamas County before the permit is issued, and the City’s transportation and parks SDCs are paid to the City. Engineering issues a Type 1 right-of-way permit for driveway approaches, sidewalks, dumpsters and portable toilets in the street, and Type 2 permits for utility work and paving. Inside the flood management overlay (Land Development Code chapter 16.35), new habitable buildings need a finished floor, and the bottom of any septic tank, at least one foot above the design flood height or the highest flood of record, whichever is higher. FEMA counts Happy Valley among participating flood insurance communities, on a map effective June 17, 2008.

Happy Valley permit costs and fees

The Building Division fees are in the City’s Fiscal Year 2026–27 fee schedule, approved by the City Council and effective July 1, 2026. The City told the state Building Codes Division in May 2026 that the increase was 3.1%, the March-to-March change in the West Coast consumer price index, following 3.6% in August 2024 and 2.2% in August 2025. Valuation follows OAR 918-050-0100: for new houses and additions the ICC Building Valuation Data figure current on April 1 times the floor area, with carports, covered porches, patios and decks counted at 50% of the garage rate.

Worked example. An addition valued at $80,000 is in the $50,001 to $100,000 band: $628.39 plus 30 × $6.67 ($200.10) gives a permit fee of $828.49. Plan review at 65% is $538.52 and the state surcharge at 12% of the permit fee is $99.42, so the structural permit costs $1,466.43 before plumbing, mechanical, erosion control and the County’s electrical permit.

For new houses the City’s SDC page (rates set July 1, 2025) lists transportation $12,779, parks $10,479 and city storm drainage $216, plus WES surface water ($272) and sanitary sewer ($9,630 for a 2,500 sq ft house) and a Sunrise Water Authority water meter charge of $16,532. Metro’s construction excise tax is 0.12% of value on projects of $100,000 or more, and the school districts charge $1.70 per sq ft for residential space. The City’s own example for a 2,500 sq ft house with a 450 sq ft garage totals $62,599: $7,759 in building permit fees, $50,023 in SDCs and $4,816 in excise taxes.

Trade permits and who may pull them

Happy Valley issues plumbing and mechanical permits itself; a new house needs both, along with sewer and erosion applications. Electrical permits, fees and inspections are issued and regulated by Clackamas County, which administers the City’s electrical program. The City’s operating plan says a residential building permit is not issued until the related trade permits have been applied for and paid, and every application needs proof of a Construction Contractors Board license or the reason the work is exempt.

How to apply for a Happy Valley building permit

1. Finish land use first

Make sure the plat is recorded and any land use decision is final, and check the lot for the flood management overlay, easements and seismic soils.

2. Register in HVWorks

Create an account at hvworks.com; the same portal handles building, engineering and business license applications.

3. Complete the checklist

Work through the one- and two-family, deck or site plan checklist and gather the soils report, erosion plan and engineering it calls for.

4. Submit every application together

For a new house file the building, mechanical, plumbing, sewer and erosion applications and the Planning/Engineering review application, and apply to Clackamas County for the electrical permit.

5. Answer corrections

Highlight or cloud minor changes and notes on resubmitted plans.

6. Pay fees and SDCs

Pay City fees and the transportation and parks SDCs in HVWorks and the WES SDCs at Clackamas County before the permit is issued.

Review, corrections and what causes delay

The City’s 2022 operating plan sets out the review path for new houses: within three working days the applicant hears whether the application is complete and whether the house counts as simple or complex. A simple house is reviewed within 10 working days or the applicant is offered three registered third-party review firms, for an administrative fee of 10% of the normal plan review fee; complex houses and commercial projects take two to four weeks. If information is missing, the review can be delayed and then starts over, and the checklist must be complete before the review start date. A plan review by an architect or engineer acting as a certified plans examiner is allowed for houses for a $328 fee.

Any site that disturbs 500 sq ft or more of ground needs an erosion prevention and sediment control permit, with a gravel construction entrance at least 20 by 20 feet and inlet protection downhill. Wet-weather rules run from October 1 to April 30, when soil exposed for more than two days must be seeded or covered, and all exposed soil must be stabilized, with front yard landscaping and street trees in, before the building final.

Construction is allowed from 7 a.m. to 6 p.m. on weekdays and 8 a.m. to 5 p.m. at weekends, but on Sundays the City bars site clearing, earth moving, underground utility work, street or sidewalk paving, foundation framing or pouring, and structural framing.

Happy Valley permit search and official resources

Issued permits can be searched in the “Building Permits Issued” search of the HVWorks self-service site. Copies of files for closed permits are usually ready within five working days of a request, according to the City’s operating plan; ask the Building Division at 503-783-3800.
