What requires a building permit in Watervliet?

Chapter 127 of the City Code, replaced in full by Local Law No. 6 of 2022, makes a permit the rule for any work the state Uniform Code or Energy Code governs, from new buildings and additions to demolition and the installation of a wood stove, chimney or flue in a dwelling. Its exemption list is four items long, and the Building Department publishes its own checklist of common household jobs on each side of the line.

  • Roof replacement and new or replacement windows and doors
  • Kitchen and bath updates, and interior work that adds rooms

  • Above-ground and in-ground pools
  • Sidewalk and driveway replacement
  • Plumbing, electrical and exterior lighting additions or replacement
  • Furnace replacement, central heating or air conditioning, fireplaces and wood stoves
  • New basements and major exterior structural changes
  • Wall and ceiling replacement in buildings of two or more families

  • Repairing or replacing exterior trim
  • Minor repair of porches or steps
  • Repairing private sidewalks or driveways
  • Repairing or cleaning brick, stone or other masonry
  • Lawns and landscaping
  • Gutters and downspouts
  • Repairing existing fencing
  • Weather stripping, storm windows and storm doors
  • Repairing existing walls and ceilings; carpeting

In a historic district, or on a historic property anywhere in the city, every exterior improvement needs both a building permit and historic district review.

What the city decides and what the state holds

The building rules are the state’s Uniform Code and Energy Code; Chapter 127 is the city’s administration law and cannot loosen them. What Watervliet sets for itself is the procedure and the money: the six-month permit term, the fee table the City Council amended on July 10, 2025, its approved electrical inspection agencies in Chapter 145, its flood damage prevention law in Chapter 160, and the zoning ordinance in Chapter 272 that the Zoning Board of Appeals and Planning Board apply.

Watervliet building department: who handles permitting

The Building Department & Code Enforcement office, supervised by Building Inspection Supervisor Paul Laboissiere Jr., takes in every building permit, reviews plans against the Uniform Code, inspects the work and issues certificates of occupancy and compliance. Its officers are certified by the New York Department of State and also run rental inspections and property maintenance enforcement.

Watervliet permit types and filing requirements

Residential permits

One application, re-posted in January 2026, covers houses, additions, decks, roofs, pools, fences, sheds and demolition. It asks for the owner’s and contractor’s details, a description of the work, the front, rear and side setbacks, and the value of construction backed by a copy of the contract. The office checks off the insurance shown (liability, disability, workers’ compensation or an exemption) and the inspections the job will need. Chapter 127 also calls for two sets of construction documents and a scaled site plan, sealed by a New York architect or engineer where state law requires it. Landlords additionally file the Rental Dwelling Registry form.

Commercial permits

New businesses and other new development start with a zoning permit ($50 filing fee). Its instructions ask for the business’s owners, a detailed description including truck traffic and delivery routes, working hours, number of employees, planned interior and exterior improvements, trash storage and removal, a scaled plot plan with off-street parking, and a floor plan. Signs need a separate permit for each sign. The building permit for the fit-out then follows, priced at 1% of the cost with a $125 minimum.

What comes before the building permit

  • Zoning Board of Appeals: area variances ($100), use variances ($150), interpretations and some special use permits; the city posted new ZBA, area variance and use variance applications in July 2026.
  • Planning Board: site plan approval is required for all new land use activities, with exceptions listed in Article XI of the zoning law, and the board also approves subdivisions.
  • Historic review: exterior work on a historic property or in a historic district goes through historic district review alongside the permit; the City Clerk coordinates sidewalk café design with the Historic Resources Commission.
  • Stormwater: disturbing an acre or more of land requires a Stormwater Pollution Prevention Plan, arranged with the city’s Stormwater Program Coordinator.
  • Flood areas: Chapter 160 governs building in mapped flood hazard areas, and FEMA lists Watervliet as a participating community in the National Flood Insurance Program.
  • Sewer, streets and trees: a sewer connection needs its own permit, as do street openings and tree work in the public way.

Watervliet building permit fees

The current building fees are in § 127-20, amended by Local Law No. 2 of 2025 on July 10, 2025. They replace the older square-foot table that the city’s general fee chapter (§ 279-1, last fully revised in 2019) still prints for new dwellings, which charged $150 to $575 by floor area; the newer local law is the one to budget from. New-construction fees include the interior plumbing, but the service connection takes its own permit. If the work turns out to cost more than the estimate on the application, the department bills the additional fee, which is due immediately.

Trade permits and who may pull them

Electrical. Electrical additions and replacements are on the city’s permit list, and Chapter 145 sets how the work is inspected. Five agencies are approved to inspect electrical work in Watervliet: Middle Department Inspection Agency, Commonwealth Electrical Inspection Service, The Inspector LLC, Northeast Electrical Inspections LLC and New York Atlantic-Inland. Wiring may not begin until an application for inspection has been filed with one of them, and new wiring may not be connected to power until that agency has issued a temporary or permanent certificate of compliance. The City Code has no electrician-licensing chapter.

Plumbing. Plumbing additions or replacement need a permit; for new buildings the interior plumbing is covered by the building permit fee, while a sewer connection is a separate $15 residential or $20 commercial permit and inspection. Chapter 216 keeps the city’s earlier plumbing ordinances in force but does not print their text online.

Heating. Furnace replacement, new central heating or air conditioning, fireplaces and wood stoves or fireplace inserts all appear on the permit list. Contractors’ insurance is checked on the application, which has boxes for liability, disability and workers’ compensation coverage or an exemption.

How to apply for a Watervliet building permit

1. Settle zoning first

Call ext. 113 about zoning; new businesses file the zoning permit, and variances or site plan go to the ZBA or Planning Board before the building permit.

2. Complete the application

Fill in the January 2026 building permit form with owner, contractor, work description and setbacks.

3. Attach the contract and plans

Include a copy of the contract for the value, two sets of plans and a site plan, plus insurance certificates or an exemption.

4. File in Room 8

Bring the package to the Building Department in City Hall, weekdays 8:00 am to 4:00 pm, and pay the fee from § 127-20.

5. File the electrical inspection

Before any wiring starts, the electrician applies to one of the five approved inspection agencies.

6. Inspections and certificate

Call for each inspection checked on your permit, then receive the certificate of occupancy or compliance.

Review, corrections and what causes delay

Review starts with the plans, dimensions and other project information in the file, and zoning is the hold-up the city itself describes: a plan that needs a variance is denied until the Zoning Board of Appeals acts. Historic district review runs alongside the permit for exterior work in those areas. A missing contract copy or insurance certificate also stops the file, because the value of construction and the coverage boxes are both on the form.

Watervliet inspections and certificates

Section 127-5 requires work to stay exposed until the Code Enforcement Officer or an authorized inspector accepts it, and the permit holder must notify the office when each stage is ready. The application form lists the stages the office may require: setback, footings, foundation, framing, plumbing, electrical, insulation, demolition, grading or stormwater, and a final inspection. The code adds fire-resistant construction, solid-fuel appliances and chimneys, Energy Code items and manufactured buildings, and allows a remote inspection where it is as reliable as a site visit.

When the final inspection passes, the city issues a Certificate of Occupancy and Compliance under § 127-7. Permits must be started within six months and expire six months after issue, with one six-month renewal available on application and fee. Construction work is allowed from 7:00 am to 6:00 pm on weekdays and 8:00 am to 5:00 pm on weekends. Rental units are inspected every three years for a residential occupancy permit and again between tenants, at $40 per unit.

New York building code

New York builds on one statewide code, the Uniform Code, outside New York City; the 2025 edition and 2025 Energy Code took effect on 31 December 2025 (the all-electric provisions remain suspended by court order). Cities, towns and villages administer it, and local standards stricter than the code need Code Council approval. The Uniform Code in New York

Watervliet’s administration law is Chapter 127, Building Construction and Fire Prevention, adopted in full on December 8, 2022, with its fee section amended on July 10, 2025.
