For land in the Town of Wawarsing outside the Village of Ellenville, the town Building Department at 108 Canal Street, Ellenville (845-647-7800 ext. 5), issues building permits and certificates, taking applications through its MuniCollab portal. The town hall sits inside the village, but village properties are permitted by the Village of Ellenville’s own Building Department on Elting Court.
What requires a building permit in Wawarsing?
Chapter 42 of the Town Code, adopted by Local Law 1 of 2023, administers the Uniform Code and Energy Code in the town and requires a permit before any work they cover, including building, enlarging, altering, improving, removing, relocating or demolishing a structure, and installing a solid-fuel heating appliance, chimney or flue. The Building Department also posts its own applications for fences, signs, swimming pools, demolition, logging and site development.
Permit needed
- New houses, additions and alterations
- Swimming pools, hot tubs and spas deeper than 24 inches
- Permanent fences and walls, other than livestock fencing
- Signs (town application form)
- Any change of land use, even with no construction
- Demolition
- Site development and logging (town permits)
- Wood stoves, chimneys and other solid-fuel equipment
- Short-term rentals (town law and application)
No building permit (Chapter 42)
- One-story detached sheds or playhouses of 144 square feet or less at houses and townhouses
- Stage sets and scenery
- Window awnings on houses and townhouses
- Partitions under 5 feet 9 inches
- Painting, wallpaper, tile, carpet
- Listed portable appliances and like-for-like replacements
- Repairs that do not affect the structure, exits or fire protection
The zoning law adds its own rules. Its general provisions say a building/zoning permit is needed to change a use, make permanent structural improvements or move, alter or enlarge a use or building, even where no construction is involved; only agricultural harvesting and tilling are exempt. Residential fences and walls may be at most 6 feet high and commercial ones 8 feet. A pool with water deeper than 2 feet needs a permit, may not sit in a front or side yard, must be at least 10 feet from side and rear lot lines, and, if less than 4 feet above ground, must be enclosed by a fence at least 4 feet high with gates kept locked when the pool is not in use. The application also reminds owners that the zoning law allows one primary residence per building lot, although an existing accessory building on a single-family lot may become an accessory dwelling if it meets the setbacks, the health and building codes and the zoning law’s standards for such units.

The construction standards are the state’s. Wawarsing’s Town Board sets local land use through the zoning law (Chapter 112, adopted October 21, 2021), flood damage prevention, historic preservation, rules for hotels, boardinghouses and bed-and-breakfasts, the short-term rental law, electrical inspector standards and the fee schedule, which it adopts by resolution at a regular meeting. A construction rule stricter than the state code would need Code Council approval.
Wawarsing building department: who handles permitting
The town Building Department, with Building Inspector John Unverzagt (ext. 253), works from the Town Building at 108 Canal Street, which is inside the Village of Ellenville. That location can mislead: the town office covers the rest of the town outside the village, roughly 8,250 of the town’s 12,448 residents, while the 4,201 people of Ellenville are served by the village.
The Village of Ellenville runs its own Building Department at 2 Elting Court with a building inspector and a housing inspector; anyone planning to build, remodel or repair a structure inside the village is asked to call 845-647-7080 first to find out whether a permit is needed.

Wawarsing permit types and filing
Building permits, inspections and certificates now run through the town’s MuniCollab portal; the 2026 building permit application and the other forms are also posted on the department page. A property owner authorization form covers applications filed by someone else, since the owner, or an agent, engineer or lessee with the owner’s affidavit, must apply.
Residential permits
Attach a survey showing the proposed building, a copy of the deed, the zoning district and tax map number, and two complete sets of plans with specifications, materials, plumbing, heating, electrical, fixture, bedroom and energy code details. All work over $20,000 must be stamped by a New York engineer or architect. Report the total cost of construction, not counting land; if the final cost runs over the estimate, the town may charge more before the certificate. A pool, hot tub or spa uses the separate pool application, which asks for depth, capacity, distances to lot lines and the electrician and designer.

Commercial permits
Commercial projects use the same application and the same plan, insurance and approval list, and plans for any work over $20,000 must carry a design professional’s stamp. Hotels, motels, boardinghouses and bed-and-breakfasts also fall under the town’s own Chapter 71.
For tenant improvements and new commercial builds, Alliance handles commercial permit filing through issuance. More on this: commercial building permits explained.
What comes before the building permit
A new house needs the Ulster County Department of Health’s permit to construct the septic system, and inside the New York City watershed the application also lists New York City Board of Water Supply approval of the sewage disposal system. Property in the flood plain needs a flood plain application and permit, and a new driveway needs an access permit from the town Highway Department, Ulster County DPW or the state DOT, depending on the road. Variances go to the Zoning Board of Appeals on the town’s ZBA application.
Steep land has extra limits under section 112-22. Any building permit, site plan, subdivision or other approval that disturbs slopes of 15 to 25 percent carries conditions on erosion control, drainage, tree cutting and driveway grades, with engineering review paid from the applicant’s escrow, and no certificate of occupancy issues until the required erosion and drainage work is done. No development, grading or stripping of vegetation is allowed on slopes of 25 percent or more, and plans must show contours at 2-foot intervals.
Wawarsing permit fees
Under section 42-18 the Town Board sets building fees by resolution, and under Chapter 17 the current schedule is kept on file in the Town Clerk’s office. The Building Department posts the schedule as a document dated May 2026 (“Building Dept Fees 5-26”), and the fee for each permit comes from that schedule.
Rather talk it over?
Call 1-855-478-4290 →| Item | Rule |
|---|---|
| Building permit, amended permit or renewal | Fee due when the application is submitted |
| Inspections | Any inspection fee is paid before or at the inspection |
| Basis on the application | Total cost of construction, excluding land |
| Final cost above the estimate | Additional fee may be charged before the certificate |
| Fees unpaid 30 days as of October 1 | Added to the next property tax bill with a $25 late fee |
| Current amounts | Building Department schedule dated May 2026; copy on file with the Town Clerk |
Because the fee is tied to cost, a realistic estimate on the application avoids a second charge at the end of the job. Unpaid building fees do not simply lapse: section 42-18 lets the Code Enforcement Officer send them to the assessor so they become a lien collected with the town tax. Ask the department for the amount for your project before you file in the portal.
Trade permits and who may pull them
Electrical. The town posts the Ulster County Electrical Licensing Board’s notice that county master electrician licenses are required to obtain building permits for electrical work; the board asked municipalities to enforce the rule fully from January 1, 2022. The county law (County Code Chapter 185) limits the electrical contracting business to licensees and the people they employ and supervise; owners of a detached single-family house more than a year old may do some of their own wiring, except pools and spas, generator transfer switches and sale-related repairs. Under Town Code Chapter 51 the Building Inspector accepts electrical inspections from qualified private inspectors, and the application requires a certificate of approval from an acceptable electrical inspection agency before any certificate of occupancy or compliance.
Plumbing. Wawarsing’s code has no plumber licensing chapter. The application asks you to name the plumber and electrical contractor and to say whether the building uses trusses.
Insurance. The application spells out the workers’ compensation and disability proof the state requires. An owner of an owner-occupied one- to four-family house doing all the work, or paying helpers less than 40 hours a week in total, files the BP-1 exemption; a business or contractor files a CE-200 exemption, a C-105.2 or U-26.3 certificate with a DB-120.1, or self-insurance forms. ACORD certificates are not accepted.

Review, corrections and what causes delay
The Building Inspector issues the permit with an approved set of plans, which must stay on the property. Any change to those plans must be reported through a change order from the design professional. Missing county health, watershed, driveway or flood approvals and an ACORD form in place of state insurance proof are the gaps the application warns about.
Wawarsing inspections and certificates
The required inspections are checked off on your permit, and it is the homeowner’s job to make sure they are scheduled, with at least 24 hours’ notice to the office. Chapter 42 lists the work site before the permit issues, footings and foundation, slab preparation, framing, structural, electrical, plumbing, mechanical and fire-protection systems, fire-resistant construction and penetrations, solid-fuel appliances and chimneys, Energy Code items, the assembly of manufactured homes and a final. Work that fails is cited to the specific code section and stays open until it passes, and the inspector may accept a remote inspection where it shows the work as well as a visit. Any inspection fee in the town schedule is paid before or at the inspection itself.
No building may be occupied or used, in whole or in part, until the final inspection has been passed and the Building Department has granted a certificate of occupancy; obtaining it is also the homeowner’s responsibility. Permits lapse if work has not begun within six months and expire after 12 months, with renewal on application and payment of the fee.
New York building code
New York builds on one statewide code, the Uniform Code, outside New York City; the 2025 edition and 2025 Energy Code took effect on 31 December 2025 (the all-electric provisions remain suspended by court order). Cities, towns and villages administer it, and local standards stricter than the code need Code Council approval. The Uniform Code in New York
