In the Town of Wallkill, the Building & Code Enforcement office in Building A of Town Hall, 99 Tower Drive, Middletown, issues building permits, septic permits and certificates of occupancy. Chapter 83 of the Town Code requires work to begin within three months of issue and lets a permit run 12 months, and the 2026 application forms charge $0.85 per square foot for a new house or addition plus a $50 certificate of occupancy fee.
What requires a building permit in Wallkill?
Chapter 83 of the Town Code, adopted on December 15, 2022, requires a building permit for any work that has to meet the Uniform Code or the Energy Code, and it lists only two exemptions. The town’s 2026 application set shows the range of work the office permits.
Permit needed
- New one-family houses, on town water and sewer or on well and septic
- New multifamily buildings and their additions and alterations
- Residential additions and alterations (square-foot and flat-fee forms)
- Accessory structures and decks
- Pools, hot tubs and spas
- Wood stoves, pellet stoves and gas fireplaces
- Clearing, filling and grading
- Residential and commercial demolition
- New commercial buildings and commercial alterations
- Septic systems and water or sewer laterals
Exempt under Chapter 83
- One-story detached sheds, playhouses and similar buildings at one- or two-family homes, up to 144 sq ft
- Painting, wallpapering, tiling, carpeting and similar finish work
Under the zoning law a fence is not a structure, but its height is capped in the RA, RA-1, R-1 and R-2 districts at 6 feet in side and rear yards and 4 feet in front yards, or 3 feet in the front of a corner lot; the town also posts a Fence Requirements sheet. A pool deeper than two feet needs a permanent fence at least 4 feet high with a self-closing, self-locking gate, unless the pool sits more than 4 feet above ground and its steps can be raised and locked.
What the town decides and what the state holds
The state Uniform Code and Energy Code are the building standards, which Wallkill enforces through Chapter 83 and cannot make stricter without Code Council approval. The town’s own choices are its fee resolution, the zoning law (Chapter 249), the septic rules in Chapter 194, flood damage prevention (Chapter 127), stormwater management (Chapter 203), the qualifications it sets for electrical inspectors, and the deposit-protection rule for builders of new homes.
Wallkill building department: who handles permitting
Building & Code Enforcement, led by Building Inspector Al Vance, receives applications, issues permits, inspects work and issues certificates of occupancy for the whole town; the Building Inspector is appointed by the Town Board under Chapter 82. The Census Bureau lists no incorporated village inside the Town of Wallkill. The City of Middletown is a separate city with its own Department of Public Works, so a Middletown mailing address does not by itself say which office issues the permit; Middletown’s water and sewer systems also serve some neighboring parts of Wallkill.

Wallkill permit types and filing
The town issues a separate application for each kind of job, posted in its online Document Center. The residential folder holds 2026 forms for a new one-family house on water and sewer, a new house on well and septic, new multifamily buildings, multifamily additions and alterations, residential accessory structures, decks, pools, hot tubs and spas, indoor wood and pellet stoves and gas fireplaces, clearing, filling and grading, residential demolition, emergency water and sewer laterals, and two general forms priced either by square foot or at a flat fee. Commercial forms cover new commercial buildings, flat-fee commercial work and commercial demolition, and a water tap-in form covers new connections.
Residential permits
Chapter 83 asks for a written application signed by the owner or an authorized agent, with a description of the work, the tax map number and street address, the occupancy classification, and at least two sets of construction documents that show the work complies with the codes; a site plan must show existing and proposed buildings, any well or septic system and the distances to lot lines. A builder of a new house who takes a deposit from the buyer must post a bond with the Town Clerk or put the deposit in an interest-bearing escrow account, and must show proof before the building permit for the new home is issued (Chapter 95).

Commercial permits
New commercial buildings and commercial alterations use their own 2026 forms. Chapter 83 also covers operating permits for hazardous activities and places of assembly, fire safety and property maintenance inspections of existing buildings, and condition assessments of parking garages, all administered by the same office.
For tenant improvements and new commercial builds, Alliance handles commercial building permits through issuance. More on this: commercial building permits explained.

Zoning (Chapter 249) decides the use, setbacks and accessory-structure limits, with variances from the Zoning Board of Appeals and site plans and subdivisions through the Planning Board. A lot shown on a residential subdivision map that the Planning Board approved and that was filed with the Orange County Clerk is confirmed as a buildable lot under Chapter 82. In a flood hazard area, the Building Inspector or Commissioner of Public Works checks that new construction and substantial improvements are anchored against flotation and collapse and built with flood-resistant materials.
Wallkill building permit fees
Chapters 82 and 83 leave building permit, renewal and certificate fees to Town Board resolution, and the town prints the 2026 amounts on its application forms. Most residential permits add a $50 certificate of occupancy or compliance fee to the permit fee.
| Project | Fee |
|---|---|
| New single-family house or addition | $0.85 per sq ft ($95 minimum) + $50 certificate |
| New multifamily residence or addition | $0.95 per sq ft + $50 certificate |
| Interior or exterior alterations | $0.50 per sq ft ($95 minimum) + $50 certificate |
| Accessory structure | $0.70 per sq ft ($95 minimum) + $50 certificate ($145 minimum in all) |
| Deck | $95 per deck + $50 certificate |
| Above-ground pool or hot tub / in-ground pool | $95 + $50 = $145 / $250 + $50 = $300 |
| Electrical outlet only; oil tank (each) | $50; $75, each + $50 certificate |
| Septic tank only, retaining wall, solar array, window replacement or siding; other work | $95 each; other work $95 minimum; each + $50 certificate |
| Demolition | $175 + $50 certificate |
| Clearing; floodplain; crane | $125 each, no certificate fee |
| Water connection, standard 3/4-inch meter; tap-in; out of district | $509.83; $250; $500 |
| Inspection requested but work not ready | $75 surcharge |

Call 1-855-478-4290 →For example, a 400 sq ft addition to a house is 400 × $0.85 = $340 plus the $50 certificate, or $390, and a 16 by 20 foot garage (320 sq ft) on the accessory structure form is $224 plus $50, or $274. Under Chapter 83 the fee is paid with the application, half is refunded if the application is refused before work starts and none after; electrical inspection fees go to the inspection agency at rates the Town Board approves; and a builder of a new home posts a bond or escrows buyers’ deposits before the permit issues.
Trade permits and who may pull them
Electrical. Wallkill has no electrician license of its own, but Orange County’s Department of Consumer Affairs states that an electrical license is required to do electrical work anywhere in Orange County and keeps the list of licensed electricians and inspectors (845-862-9500). Inspections are made by private electrical inspectors the town has approved. To get on the list an inspector must hold a New York State electrical engineer’s license or the International Association of Electrical Inspectors certificates for one- and two-family, general and plan-review inspection, file insurance and pay an annual fee; residential inspectors receive an EIR number and commercial and multifamily inspectors an EIC number. The approved list is kept at the Building Inspector’s office and the Town Clerk’s office, the town posts a 2026 list of electrical inspectors, and applicants may pick any inspector on it.
No electrical inspection may start until a building permit has been issued, unless the Building Inspector allows work to proceed without one. Inspection fees are paid to the inspector, not up front, and their rates go to the Town Board for approval. The inspector issues a certificate of compliance only when the work is fully complete, sends a copy to the Building Inspector, and authorizes a power permit to the utility only once the work for it is done.
Plumbing and contractors. The Town Code has no plumber or home-improvement contractor license, and the county says it requires no license other than for electricians. Plumbing, wood stoves and gas fireplaces are reviewed through the building permit forms.
Septic. Under Chapter 194 no septic tank, leaching pit or other sewage system may be installed until the Town Building Inspector issues a building permit, and the system plans must be approved first. Every part of the system must be more than 10 feet from property lines and building foundations and more than 25 feet from any lake, stream or watercourse, and at least 200 feet from a well on the direct line of drainage, or 75 feet otherwise. The town posts A Guide to Septic Systems, and Orange County Environmental Health reviews realty subdivisions of five or more lots under five acres.

Make sure the parcel is in the Town of Wallkill and not the City of Middletown, and check its zoning district.
Site plans and subdivisions go to the Planning Board and variances to the Zoning Board of Appeals before the building application.
Pick the form for the job from the town Document Center: new house, accessory structure, deck, pool, stove, grading, demolition or commercial.
Two sets of construction documents plus a site plan showing buildings, well, septic and distances to lot lines; septic plans need approval before the permit.
Submit the signed application and pay the fee at Building A, 99 Tower Drive.
Begin within three months, book inspections and the electrical inspector, and obtain the certificate of occupancy.
Review, corrections and what causes delay
The Building Inspector reviews each application and its plans within a reasonable time, stamps both sets “approved” and keeps one on file. Chapter 83 is short on time: a permit becomes invalid if work has not begun within three months and expires 12 months after issue, and renewal needs a new application and fee. A new-home permit waits for proof of the buyer-deposit bond or escrow, and a septic lot waits for approved system plans. Work that departs from the approved plans can bring a stop order.
Wallkill inspections and certificates
Chapter 83 lists the stages the office inspects where they apply: the site before the permit, footings and foundation, slab preparation, framing, structural, electrical, plumbing, mechanical and fire-protection systems, fire-resistant construction and penetrations, solid-fuel heaters and chimneys, energy-code items such as insulation and air leakage, installation of factory-built and manufactured homes, and a final inspection. Work must stay exposed until it is accepted, and the inspector may use a remote inspection where it gives the same quality as an on-site visit. Request each inspection by e-mail to inspectionrequest@townofwallkill.com, with the permit number in the subject line, by 3 p.m. for the next business day; inspections run from 9 a.m. to 4 p.m., and a visit to work that is not ready costs $75. Under Chapter 82 a building inspector who shows proper credentials may enter a building or site at any reasonable hour to carry out these duties.

New York building code
New York builds on one statewide code, the Uniform Code, outside New York City; the 2025 edition and 2025 Energy Code took effect on 31 December 2025 (the all-electric provisions remain suspended by court order). Cities, towns and villages administer it, and local standards stricter than the code need Code Council approval. The Uniform Code in New York
