In the Town of Wappinger, building permits for land outside the Village of Wappingers Falls come from the Office of Code Enforcement at Town Hall, 20 Middlebush Road (845-297-6256), which handles both building and planning work. Each type of job has its own paper application on the town’s Forms page, and a new house costs a $150 application fee plus $0.75 per square foot of living space under the fee chapter of the Town Code.
What requires a building permit in Wappinger?
Chapter 85 of the Town Code requires a permit before anyone builds, enlarges, alters, improves, removes, relocates or demolishes a building, installs a solid-fuel appliance, chimney or flue, or does other work covered by the Uniform Code or Energy Code. The department’s own FAQ names the jobs that always need one: boilers, water heaters, central air, generators, pools, hot tubs, sheds and solid-roof gazebos.
Separate town applications
- New homes, manufactured homes and commercial buildings
- Additions, garages, decks and porches
- Renovation and repair, including basements
- Sheds and other accessory structures
- Above-ground and in-ground pools
- Electrical, plumbing and mechanical work
- Demolition and site work
- Sewer and water hookups, floodplain construction and wetland disturbance
- Change of commercial occupancy
No building permit under Chapter 85
- A one-story shed or playhouse up to 144 sq ft with no electric, heat or plumbing (a zoning permit is still needed)
- Playground equipment at a one- or two-family home
- Pools under 24 inches deep set entirely above ground
- Fences that do not enclose a pool
- Retaining walls that carry no surcharge
- Painting, wallpapering, tiling and carpeting
- Like-for-like equipment replacement and minor repairs that leave structure, egress and building systems alone
The shed rule is where the two town sources differ: the department FAQ lists sheds among jobs that always need a permit, while Chapter 85, the adopted law, exempts a small unserviced shed from the building permit but sends it to zoning under Section 240-108.1. Either way the town wants an application; an unserviced building of 72 sq ft or less costs $50.
What the town decides and what the state holds
Wappinger enforces the Uniform Code and Energy Code as written; a stricter construction standard would need Code Council approval. Its own local laws cover the rest: zoning and accessory apartments, the fee chapter, flood damage prevention (Chapter 133), freshwater wetland and watercourse protection (Chapter 137), soil erosion, stormwater, well testing and its short-term rental rules. The Town Board amended the building-permit section of Chapter 85 again on August 10, 2026 (Local Law 12 of 2026).
Wappinger building department: who handles permitting
The Office of Code Enforcement, headed by Barbara Roberti as Director of Strategic Planning and Municipal Codes, covers the town outside the Village of Wappingers Falls. Building inspectors, the fire inspector and the deputy zoning administrator share the office, so zoning and building review run through one counter.

Village of Wappingers Falls. The village straddles the town line: the Census puts 5,127 of its residents in the Town of Wappinger and 921 in the Town of Poughkeepsie. Every parcel inside the village goes to the village’s own Building Department, which has its own inspector, fee schedule and Planning Board, and asks for an appointment for every plan review.
Wappinger permit types and filing
Wappinger takes paper applications: each project type has its own fillable PDF on the Forms page, and the department asks for every field to be completed. When a contractor applies, the owner signs the town’s Owner Consent form; an owner doing the work signs a notarized statement instead. The application fee is paid at filing and the square-foot fees when the approved permit is picked up; checks over $500 must be certified. The Forms page warns that fees printed on some older forms are out of date and that the current figures are those adopted by Local Law 3 of 2023.
Residential permits
The new-home application, revised January 2026, asks for the Dutchess County 911 address form (the department sends it on), the recording page of the deed or a HUD-1 statement, four original preliminary plot plans with the grid number, elevations, setbacks, wetland delineation including the 100-foot buffer, septic or water and sewer lines, driveway grades, contours, erosion control and an engineer’s stamp, and two sets of construction drawings. A foundation as-built plot plan must be approved before framing continues, and town water or sewer connections need separate $250 applications. Pools need the pool alarm certification; gas and water piping need the pressure test verification affidavit.

Commercial permits
Commercial new construction, renovation and change of commercial occupancy each have their own form, and a new occupant also files the zoning narrative the department requires. Commercial projects that need site plan approval go to the Planning Board first; the Forms page carries the site plan and special permit checklist, architectural review applications (full and minor) and a conceptual review application. Fire alarm permits and the annual operational permits for businesses and multi-family buildings come from the Fire Inspector.

What comes before the building permit
Zoning review comes first: if zoning denies an application it must go to the Zoning Board of Appeals for a variance ($375 for a resident, $1,000 commercial). Site plans cost $1,500 plus $250 per 1,000 sq ft of floor area and $20 per parking space. Work in a mapped floodplain needs a $150 floodplain development permit with a $250 escrow, and wetland disturbance and grading have their own permits. Driveways and work in town roads need Highway Department permits; a lot without public sewer or water needs Dutchess County Department of Behavioral & Community Health approval for the septic system and well before the house permit.

Fees are set in Section 122 E.1 of the Town Code, as adopted by Local Law 3 of 2023 on July 24, 2023. All fees are non-refundable.

Rather talk it over?
Call 1-855-478-4290 →So a new house with 2,000 sq ft of living space costs $150 plus $1,500, or $1,650, before garage and deck square footage, the $250 certificate of occupancy and any water or sewer connection applications. New commercial buildings are $250 plus $1.50 per sq ft up to 5,000 sq ft and $1 per sq ft above, and commercial renovations are half that.
Renewing a permit costs the base fee plus 10% of the estimated project cost the first time, 25% the second time and 50% the third. Work found without a permit carries a $250 residential compliance fee on top of the permit fee. Under Local Law 2 of 2026 (January 12, 2026), the separate residential legalization fee is waived for a first set of violations if the owner obtains every permit and closes it out, and is $250 for further violations on the same house within a year.
Trade permits and who may pull them
The town’s FAQ is direct: no license is required to work in the Town of Wappinger, and owners may do their own work with a notarized statement. Contractors must still file liability and workers’ compensation insurance certificates before any application is processed; a homeowner with no employees uses the state CE-200 exemption, and the Forms page links instructions for getting one.
Plumbing and mechanical work, electrical work and sewer or water hookups each need their own town building permit application. For electrical work, Chapter 114 makes it a violation to install or alter wiring until an application for inspection has been filed with the New York Board of Fire Underwriters or another inspection agency the town has approved. The Town Board’s approved list on the Forms page names 14 agencies, including Middle Department Inspection Agency, New York Board, Commonwealth Electrical Inspection Services, Z3 Consultants and State Wide Inspection Services. The town does not pay for these inspections, and the agency reports violations to the Chief Building Inspector.
Septic and wells. Dutchess County’s Department of Behavioral & Community Health (Environmental Health Services, 845-486-3404) approves wells and septic systems. On a lot without public sewer or water, the applicant fills in the top of the county’s SAN 34 form and the building inspector forwards it; the county confirms there is a valid engineered design and holds a pre-construction meeting on site before it tells the town it has no objection to the permit. A new house on a private well also needs a Part 5 State Sanitary Code water test on file, sent straight from a state-certified laboratory, before the certificate of occupancy.

Check that the parcel is outside the Village of Wappingers Falls; village parcels go to Village Hall on South Avenue.
Pick the application for the job from the town Forms page, plus the Owner Consent form if a contractor is applying.
Attach insurance certificates or the CE-200, plot plans and construction drawings, and the electrical agency application for wiring.
Bring or send the package to the Office of Code Enforcement at 20 Middlebush Road with the application fee.
Zoning checks the application first; a denial goes to the Zoning Board of Appeals for a variance before building review continues.
The department calls when the permit is ready; pay the square-foot fees and post the permit where it can be seen from the street.
Review, corrections and what causes delay
The department will not process an application with blank fields, without the owner’s consent form, or without the contractor’s insurance. On new houses, framing stops until the foundation as-built plot plan is approved and returned. Under Chapter 85 a permit lapses if work does not start within six months and expires 12 months after issue; renewals get dearer each time. An expired permit that is never closed can turn into a violation on the property, which then surfaces in any later municipal search.
Wappinger inspections and certificates
Chapter 85 puts the duty on the permit holder to tell the Code Enforcement Officer when each stage is ready, and work must stay exposed until it is inspected and accepted. The stages are the site before the permit, footing and foundation, slab preparation, framing, building systems including underground and rough-in, fire-resistant construction and penetrations, solid-fuel appliances and chimneys, energy-code compliance and a final inspection. The office number is 845-297-6256; inspections outside business hours cost $250, and re-inspections after earlier noncompliance cost $100 a visit from the third visit on.
When a permit is closed, the Code Enforcement Officer issues a Certificate of Occupancy or Certificate of Compliance and mails it; if none arrives, the town asks owners to follow up. For a new house, the certificate also waits on the well test and the county’s septic and well approval.
The department’s 2025 presentation for real-estate agents explains what a municipal search involves: a file review, an exterior inspection looking for unpermitted air conditioners, pools, sheds, decks, generators and EV chargers, and, on town sewer, an interior check that no sump pump is connected to the sewer. Searches take a few weeks, there are no rush orders, a well test (valid for three years) is required on private wells, and the town states there is no such thing as grandfathering.

Wappinger permit FAQ
Does the town issue permits in the Village of Wappingers Falls?
No. The village has its own Building Department at Village Hall, 2582 South Avenue (845-297-5277), for all village parcels, including the small part of the village in the Town of Poughkeepsie.
Do I need a licensed contractor in Wappinger?
No. The town has no license requirement and lets owners do their own work with a notarized statement, but every contractor must file insurance forms and electrical work must be inspected by a town-approved agency.
How much is a permit for a new house?
$150 plus $0.75 per square foot of living space, so $1,650 for 2,000 sq ft, with garages and decks priced separately and $250 for the certificate of occupancy.
Do I need a permit for a shed?
Plan on applying. The department lists sheds among jobs that always need a permit; Chapter 85 exempts an unserviced shed of 144 sq ft or less from the building permit but still requires a zoning permit. The fee is $50 up to 72 sq ft and $100 up to 200 sq ft.
What happens if work was done without a permit?
The owner files a permit application with the owner’s consent form and pays the residential application fee plus a $250 compliance fee; under Local Law 2 of 2026 a first residential legalization fee is waived once the permits are closed out. If zoning denies the work, a variance is needed.
How do I see permit records for a property?
File a Freedom of Information Law request on the town’s FOIL form, or order a municipal search ($250 for a house), which adds an inspection of the property.
Wappinger permit search and official resources
The building department’s files hold every permit issued and any open violation, and they can be seen through a FOIL request on the 2026 form from the Town Clerk’s forms. Title companies, lawyers and owners order municipal searches with a written request and the owner’s consent form; the results arrive as a clean letter or as an order to remedy with a notice to the abstract company.
Inspections are where schedules slip.
