In the Town of Vestal, the Code Department at 133 Front Street reviews and issues construction permits, inspects the work and enforces the zoning chapter for the whole town. Its 2026 fee schedule, effective January 1, 2026, charges $350 for a new house of up to 2,500 square feet of building area. Review takes 2 to 4 weeks once the application, plans and fee are in, and every construction business working in Vestal needs a yearly town operating permit.

What requires a building permit in Vestal?

The department says building permits are issued for most projects, and its Code Department Q & A lists the work that needs one. It names several small projects outright, from storable pools to chimney relining.

Vestal permit list

  • New homes and new commercial work
  • Residential and commercial additions, alterations, remodeling and interior remodeling
  • Every deck or porch, open, enclosed, screened or roofed
  • Pools 24 inches deep or more, including storable pools
  • All roofing, including tear-offs and re-roofs
  • Garages, barns, pole buildings and open pavilions
  • Chimneys, woodstoves, fireplaces and inserts, and any chimney relining
  • Extensions or changes to any electrical or plumbing system
  • Fire alarm, sprinkler, smoke detection and commercial hood suppression work
  • All signs; fences over 8 ft 6 in; tents over 200 sq ft

Shed exception

A storage, garden or tool shed of 101 sq ft or less needs no permit only if all three conditions hold:

  • It serves a residential use
  • It has no electrical, plumbing or fueled-equipment connection
  • No dimension is over 20 ft (a 20 ft 1 in by 4 ft shed needs a permit)

What the town decides and what the state holds

The technical rules come from the state Uniform Code and Energy Code, which the Code Department enforces alongside the Code of the Town of Vestal, published on Municode. The town’s own choices sit in Chapter 5 of that code (permit display, operating permits for contractors and hazardous uses, fire inspections of existing buildings and signs) and in its zoning chapter, which sets property uses, setbacks, building heights and lot sizes. The town’s fee schedule and the shed and fence thresholds above are local; any local standard stricter than the Uniform Code itself needs state approval.

Vestal building department: who handles permitting

The Code Department, led by Code Enforcement Officer Lincoln Ellis, issues building permits, inspects construction, makes fire safety inspections of existing buildings and enforces local laws on zoning, litter, timber harvesting, signs and junk vehicles. Its office is separate from Town Hall, and the department invites owners to come in and look through the laws, codes and permit requirements kept at its front counter before a project starts.

Vestal permit types and applications

Residential permits

The forms page groups residential building permit information and applications in one place. Download them or pick them up at the front counter, follow the instructions and return the completed package with the fee. Stamped plans from a New York licensed architect or engineer are required for any work affecting structural components, costing more than $20,000 or covering more than 1,500 square feet. Fees for houses are figured on building area, which in Vestal counts every floor, the basement and any garage.

Commercial permits

Commercial applications follow the town’s Commercial Permit Application Checklist and will usually need engineer- or architect-stamped plans. New commercial buildings and additions of 3,000 sq ft or more pay a plan review fee on top of the permit fee. Existing commercial buildings also face the department’s routine fire inspections, and assembly spaces for 100 or more people, hazardous materials and hazardous processes need a $150-a-year operating permit.

What comes before the building permit

  • Zoning district check against the town zoning map; property uses, setbacks, heights and lot sizes are set by the zoning chapter.
  • Zoning Board of Appeals for variances: $100 for an area variance and $200 for a use variance on residential property; $200 and $500 in commercial districts.
  • Planning Board site review for new development ($100 up to 1,000 sq ft, $125 up to 2,500 sq ft, then $0.05 per sq ft, capped at $500) and for subdivisions ($250 plus $25 per lot).
  • Septic: on-site sewage systems are a Broome County Health Department matter, separate from the town permit.
  • Signs and special events: every sign is permitted separately, and festivals or street fairs need a $200 special event permit.

Vestal building permit fees

Fees come from the town’s Permit and Application Fee Schedule effective January 1, 2026. Plan review fees, where listed, are added to the application fee, and a renewal fee applies when a permit has to be renewed ($200 for a new house, $50 for an addition, $25 for a shed or deck).

Worked examples: a 2,800-square-foot house counted with its basement and garage pays $450. At 3,600 square feet it pays $450 plus two 500-square-foot portions at $125, or $700. A 400-square-foot residential remodel pays $125, and an 8-by-12-foot shed (96 sq ft) with a power line run to it is not exempt and pays $35. The town also charges $50 for each notice issued for failing to display a permit, and $50 a day (residential) or $300 a day (commercial) for occupying work before its certificate issues. Fire inspections the owner requests, such as for rental approval or before occupancy, cost $150 each, and a day care facility inspection is $125. Changing a Planning Board-approved plan before the certificate of occupancy costs $50 plus $0.02 per square foot of affected area, up to $250.

Trade permits and who may pull them

The licensing rule the Code Department describes is registration rather than a trade examination. Under § 5-30 of the Town Code, any business that builds, repairs, remodels or alters buildings or their systems must hold an annual operating permit, applied for in person at 133 Front Street.

Annual contractor operating permits (2026)
Contractor typeYearly fee
General contractor, residential / commercial$200 / $300
Electrical, plumbing/HVAC, roofing, pool, concrete/masonry, sign, fire alarm and other trades$75
Fire sprinkler / cooking hood suppression$100
Excavation$50

Electrical work is inspected by an approved third-party electrical inspector when the town inspector requires it, as the town’s inspection list puts it. Plumbing, mechanical, chimney and fire-system work is inspected by the department itself at the stages listed below.

How to apply for a Vestal building permit

1. Check the zoning district

Use the zoning map and information page, and book the ZBA or Planning Board first if the project needs a variance or site review.

2. Register the contractor

Make sure the builder and each trade hold a current Vestal operating permit.

3. Get the right forms

Residential or commercial building permit packet, sign application or fire inspection forms from the downloadable forms page or the counter.

4. Prepare plans

Stamped plans for structural work, jobs over $20,000 or areas over 1,500 sq ft; floor areas measured the way the fee schedule counts them.

5. File with the fee

Turn in the completed application, plans and fee at 133 Front Street; the 2 to 4 week review clock starts then.

6. Post the permit, inspect, close

Display the permit as Chapter 5 requires, book each inspection two business days ahead and obtain the certificate before using the space.

Review, corrections and what causes delay

The department quotes 2 to 4 weeks from the time the completed application, complete plans and fee are submitted, and calls its plan review detailed. The clock does not start until all three are in, so a package missing plans or the fee simply waits. Stamped drawings are needed for structural work and large jobs, and the trades on the job need current operating permits. Work begun before the permit doubles the fee.

Vestal inspections and certificates

The permit holder is responsible for calling for inspections. Appointments must be made at least 2 full business days before the inspection, by speaking with the office at 607-786-0980 ext. 203; voicemail requests are not accepted and do not guarantee an inspector.

  • Foundations: footer forms and steel, foundation forms and steel, post-hole depth and location, and perimeter drainage and damp-proofing before backfill.
  • Rough stages: below-grade plumbing, structural framing, roof construction and roofing installation, rough plumbing, insulation and fire separations, each before it is covered.
  • Systems: electrical by an approved third-party inspector where required, fireplaces and woodstoves, chimneys before, during and after relining, fire alarm, fire suppression and sprinkler testing.
  • Pools: the enclosure (fence or barrier) and pool alarm.
  • Final: every permit ends with a final inspection and a certificate of occupancy or compliance before the work is used.

New York building code

New York builds on one statewide code, the Uniform Code, outside New York City; the 2025 edition and 2025 Energy Code took effect on 31 December 2025 (the all-electric provisions remain suspended by court order). Cities, towns and villages administer it, and local standards stricter than the code need Code Council approval. The Uniform Code in New York

In Vestal, Chapter 5 of the Town Code carries the local rules the fee schedule cites: the permit-display rule (§ 5-24), operating permits for contractors and hazardous uses (§ 5-30) and fire inspections of existing buildings (§ 5-31).
