Otsego County runs its own code enforcement office. The Code Enforcement Office at 140 County Highway 33 West, Cooperstown (607-547-4214), administers the Uniform Code and Energy Code for every municipality that opted out of local enforcement, which today is all of the county except the Town of Milford, the City and Town of Oneonta, and the Town and Village of Otego. A new house costs $20 per 100 square feet of floor area, with a $200 minimum, and permits are generally issued 7 to 10 business days after a complete application.

What requires a building permit in Otsego County?

The county’s fee schedule doubles as its list of permits. It covers new houses and additions, manufactured and modular homes, garages, carports and storage buildings, sheds of 145 square feet or more, commercial buildings, septic systems, replacement heating units including wood and pellet stoves, pools and hot tubs, electrical work and solar panels, demolition, and agricultural buildings, which need a permit but pay no fee. Sheds of 144 square feet or less need no permit.

County permit needed

  • New homes, additions, alterations and conversions
  • Garages, carports, storage buildings and sheds of 145 sq ft or more
  • Septic systems and replaced septic parts
  • Replacement furnaces, boilers and wood or pellet stoves
  • Pools, hot tubs and their enclosures
  • Electrical work and solar arrays
  • Farm buildings (no fee)

No county permit

  • Sheds of 144 sq ft or less
  • Work in the Town of Milford, Oneonta (city or town) or Otego (town or village): ask that local office instead

What the county decides and what the towns keep

The construction standard is the state’s 2025 Uniform Code and Energy Code. The county enforces it under Local Law No. 3 of 2023, adopted on July 5, 2023 to amend Local Law No. 1 of 2011, and its fees are set by the county Board of Representatives. Zoning stays local: the county office says it will not issue its permit until any required town, village or city permit, such as a zoning permit, special permit or variance, is in place. Otsego County is not among the twelve counties the Department of State lists as having opted out of the enforcement of the Uniform and Energy codes; it took the work on instead.

The exceptions are the places that kept their own code enforcement: the City of Oneonta, the Town of Oneonta around it, the Town and Village of Otego, and the Town of Milford. The county’s list names the Town of Milford but not the Village of Milford, so the village falls to the county office. Roseboom moved to county enforcement on January 1, 2023. Cooperstown is split between Middlefield and Otsego and keeps its own village zoning, which the county office checks before issuing a permit.

What else Otsego County does

  • Code Enforcement Office: plan review, permits, inspections, certificates, complaints and stop-work orders under the local law; open Monday to Friday 8:30 a.m. to 4:30 p.m., and 9 a.m. to 3:30 p.m. in July and August. It asks for applications by email, fax or mail where possible and reviews them in the order received.
  • Reference lists: the office posts a list of qualified electrical inspectors (updated March 14, 2025), a zoning contact list for each town and village, and lists of architects and engineers, blower-door testers, fire equipment services and water test laboratories.
  • State health office: environmental health in Otsego County is handled by the NYSDOH Oneonta District Office, 28 Hill Street, Suite 201 (607-432-3911), which also serves Delaware and Greene counties.

Otsego County permit types and applications

Residential permits

Every county application goes through plan review. Send it by email, fax or mail if you can; the office is open for drop-offs and payments, reviews files in the order received and contacts the applicant by phone or email with questions. Have the local zoning approval in hand first: the county will not issue the building permit until it knows that required local permits are in place.

Manufactured and modular homes have their own line in the schedule: $100 per section, whether the home is new or used, a replacement or a relocation, and whether it sits inside or outside a mobile home park. Additions to a section add $20 per 100 square feet, and finishing the second floor of a modular home adds $100 for each 1,000 square feet. A foundation built on its own costs $60 for a house, at the code officer’s discretion.

Commercial permits

Commercial buildings, places of assembly, business, mercantile and multiple dwellings are charged $26 per 100 square feet of work area, with a $200 minimum for occupied space and $100 for non-occupiable items such as ramps, doors or lighting. Utility buildings at communication towers, wind towers or gas wells pay $100 each, and petroleum storage tanks $100 per tank. Fireworks permits cost $150 per event or $500 for a season. Temporary tents and membrane structures from 400 to 5,999 square feet are free and larger ones cost $60, and public events cost nothing under 1,000 people and $60 above that.

What comes before the building permit

  • Local zoning: where the town or village has zoning or site plan review, its approval comes first; Morris, Pittsfield, Roseboom, Burlington, Cherry Valley and the Town of Unadilla are listed with none.
  • Septic: the county septic permit ($60) with the building permit on an unsewered lot.
  • Floodplain: a county floodplain permit ($60 residential, $100 commercial) when no building permit is involved.
  • Change of occupancy: a $100 county approval when no construction is needed.

Agricultural buildingPermit required, no fee

Worked example: a new house with 1,600 square feet of living space, a 500-square-foot attached garage and a 200-square-foot deck has 2,300 square feet of total floor area, so the fee is 23 × $20 = $460. Starting without a permit doubles the application fee, a missed inspection costs $100 unless cancelled 24 hours ahead, and the second and third follow-up inspections after a failure cost $50 and $100. In Oneonta, Milford and Otego the local office’s own fees apply instead; the City of Oneonta charges $45 for the first $1,000 of work plus $2.50 per further $1,000.

Trade permits and who may pull them

Otsego County does not license trades. For electrical work it charges a $60 permit and posts a list of qualified third-party electrical inspectors; the March 2025 list names inspectors from Atlantic Inland, Commonwealth, Northeastern Electrical, NY Electric, SAS Electrical Inspection and The Inspector, LLC. Heating equipment and septic systems carry their own county permits.

The City of Oneonta is the exception: it licenses master electricians, plumbers and HVAC technicians by examination and issues plumbing permits through its Code Enforcement Office. Everywhere, proof of workers’ compensation and disability coverage, or the state exemption form, goes with the application.

How to get a building permit in Otsego County

1. Check the municipality

Milford town, Oneonta and Otego use their own offices; everywhere else uses the county.

2. Local approvals

Get any town or village zoning, site plan or variance approval first.

3. Prepare the file

Application, plans for review, insurance proof and the fee from the 2023 schedule.

4. Submit

By email, fax or mail to the county office, or drop it off in Cooperstown.

5. Permit issued

Usually 7 to 10 business days after the file is complete.

6. Inspections and certificate

Book each inspection; cancel at least 24 hours ahead to avoid the $100 fee.

Review, corrections and what causes delay

The review clock starts only when the application is complete, so missing plans or a local zoning approval still pending will hold a permit past the usual 7 to 10 business days. Summer hours are shorter in July and August.

Inspections and certificates

County code inspectors carry out the building inspections. Wiring is checked by a third-party electrical inspector, and the county posts its list of qualified inspectors for owners and electricians to choose from. The first follow-up after a failed inspection is free; the second costs $50 and the third $100.

The county issues the certificate of occupancy at the end. A temporary certificate of occupancy costs $100 for each three-month period and must be renewed as needed.

New York building code

New York builds on one statewide code, the Uniform Code, outside New York City; the 2025 edition and 2025 Energy Code took effect on 31 December 2025 (the all-electric provisions remain suspended by court order). Cities, towns and villages administer it, and local standards stricter than the code need Code Council approval. The Uniform Code in New York

In most of Otsego County that code is administered by the county itself rather than by each town and village.
