In South Hadley, the Building Department (Inspectional Services) at Town Hall, 116 Main Street, issues building, wiring, plumbing and gas permits and certificates of inspection through its building, electrical, and plumbing and gas divisions, all directed by the Building Commissioner. Applications are filed and paid online through OpenGov (formerly ViewPoint Cloud), or printed and mailed with payment. One- and two-family work costs $7.50 per $1,000 of market-rate cost, with a $750 minimum for a new house, and new buildings follow the Stretch energy code that Town Meeting adopted in 2017.
What work requires a building permit in South Hadley?
South Hadley’s list of electronic permit applications reads as a practical list of what needs a building permit, and the fee schedules add a few items it does not name:
Building permit
- Building, altering, repairing or demolishing a house or commercial building, and additions
- Re-roofing and re-siding
- Residential pools and spas
- Kitchen and bathroom remodels
- Decks and porches
- Replacement windows and doors
- Air-sealing, insulation and weatherization
- Sheds (detached accessory structures over 200 sq ft are on the fee schedule)
- Wood, pellet and other solid-fuel appliances, chimneys and liners
- Fire suppression and fire alarm systems; signs and tents
Not on the permit list
- Fences under 7 feet: the fee schedule prices only fences over 7 feet, and the state guidance the department posts says no permit is needed below that
- Driveways and interior painting, per the same guidance
The state guidance sheet the department posts (revised April 26, 2018, for existing owner-occupied homes of one to four units) shows how the line usually falls: structural carpentry, decks, insulation and masonry tied to the building need both a permit and a licensed construction supervisor, while interior painting, routine landscaping and driveways need neither.
Under the department’s own rules (Chapter 418), it will not consider or issue a permit while a permit from another of its divisions may still be needed, and the Building Commissioner decides which divisions a job requires.
What South Hadley decides and what the state holds
The building code is 780 CMR, set by the state Board of Building Regulations and Standards. South Hadley’s choices are its fee schedules, its Zoning By-Law and Subdivision Regulations, the Stretch energy code (Chapter 120 of the general bylaws, adopted by the Annual Town Meeting on May 10, 2017), the local wetlands bylaw (Chapter 240) and its regulations, and the Building Department’s own procedures in Chapter 418.
South Hadley building department: who handles permitting
Jason Forgue is the Building Commissioner. The department has three divisions, building, wiring and plumbing (including gas), and its inspectors meet weekly with the Commissioner to review projects. Each inspector has a Town Hall extension.

South Hadley permit types and application documents
Residential permits
First-time OpenGov users create an account, then apply or renew and pay by debit or credit card; the system emails updates as the application moves, and in many cases the permit itself arrives by email. Applicants can also print the application and mail a payment. For those who prefer paper, the town posts one- and two-family forms for dwellings, detached accessory structures, decks and porches, re-roofing and re-siding, replacement windows and doors, weatherization, solid-fuel appliances, above-ground and in-ground pools and fire alarms. Supporting documents include the workers’ compensation insurance affidavit, a contractor confirmation letter, a plot plan form and a pool application guide. Because the department records a log-in number on each check, its procedures say no cash can be accepted for application fees.

Commercial permits
Multifamily buildings, apartments and condominiums have their own fee schedule at $9 per $1,000 (a $2,500 minimum for a new building, $90 for other work), and all other commercial uses pay $10 per $1,000 ($2,500 and $100 minimums). Design professionals file the initial, progress-checklist and final construction control documents, with the means of egress affidavit and the department’s fire protection guide. Buildings needing periodic inspection apply online for a certificate of inspection, $75 per building on the 110 schedule, with a separate guide for the process.
For tenant improvements and new commercial builds, Alliance handles commercial permit expediting through issuance. More on this: commercial building permits explained.
What comes before the building permit
- Zoning: the Planning and Conservation Department staffs the Planning Board, which reviews site plans, special permits and subdivisions under the Zoning By-Law and meets on the second and fourth Mondays at 6:30 p.m.; variances go to the Zoning Board of Appeals. Site plan review applies to new or expanded commercial and industrial buildings, parking expansions of 10 or more spaces, and educational and religious buildings. Unless the Building Commissioner orders otherwise, a building permit application must include plans in duplicate, drawn to scale with the lot’s dimensions and the exact size and location of every building; one approved copy is returned. Zoning violations carry a $300 fine for each day they continue.
- Wetlands: the Conservation Commission applies the state Act and the local wetlands bylaw, whose buffer zone covers land within 100 feet of wetlands, vernal pools, banks and water bodies; its regulations include tree removal and replacement rules.
- Health: the Public Health office (ext. 6184) keeps office hours on Wednesdays from 9 to 11 a.m. and otherwise by appointment; septic work falls to the Board of Health under Title 5.

The department’s building fee schedules for one- and two-family homes, multifamily buildings and commercial uses carry no printed adoption date; each charges a rate per $1,000 of cost, which must be calculated at market rate. The trade schedules are dated July 1, 2019.
| Work | Rate | Minimum |
|---|---|---|
| New principal building | $7.50 per $1,000 | $750 |
| Detached accessory structures over 200 sq ft (garages, sheds, gazebos, pergolas) | $7.50 per $1,000 | $75 |
| Additions, including second stories and sunrooms | $7.50 per $1,000 | $75 |
| Repairs, renovations, remodels, conversions of garages, attics or basements | $7.50 per $1,000 | $75 |
| Decks or porches (not sunrooms); re-roofing, re-siding, re-decking | $7.50 per $1,000 | $75 |
| Replacement windows and doors; insulation and weatherization | $7.50 per $1,000 | $75 |
| Above-ground or in-ground pools; solar, roof or ground | $7.50 per $1,000 | $75 |
| Stoves, chimneys, liners and vents; sheet metal and mechanical | $7.50 per $1,000 | $75 |
| Fences over 7 feet; foundation only; demolition | $7.50 per $1,000 | $75 |
| Re-inspection of uncorrected violations | $50 | $50 |
| Tents and temporary structures (inspected every 30 days, 180 days at most) | $75 with first inspection; $50 after | $75 |
| Work begun without a permit | Double fee | $150 |
Worked example. A house built for a market-rate cost of $450,000 pays 450 × $7.50 = $3,375. A $12,000 deck works out to $90; a $6,000 window replacement comes to $45 and is charged the $75 minimum. Other miscellaneous fees: a certificate of occupancy inspection for a new business or change of use is $75, an annual commercial pool inspection $75, and vacant property registration $100 to $300 a year.
Trade permits and who may pull them
Wiring, plumbing and gas permits each have their own OpenGov application and inspector. Gas permits are issued only to licensed contractors, and wiring and plumbing permits are filed by state-licensed electricians and plumbers; building work on homes needs a licensed construction supervisor, with home improvement contractor registration for existing owner-occupied homes, unless the owner uses the homeowner exemption. Replacing a gas water heater takes both a gas and a plumbing permit.

780 CMR 105.3.1 sets 30 days from filing for the building official to act on an application. In South Hadley a common reason for a slower answer is the department’s own rule that no permit is issued while another division’s permit may still be needed, so wiring, plumbing and gas applications should be filed at the same time as the building permit. Board approvals from the Planning Board or Conservation Commission, which meet on fixed schedules, also have to be in hand.
Inspections in South Hadley
Inspections are requested from the inspector for each division: building through the Building Commissioner’s office (ext. 6112) or the main line (ext. 6186), wiring at ext. 6111, and plumbing and gas at ext. 6108. Re-inspections of uncorrected violations cost $50 for building work and $55 for wiring; plumbing and gas re-inspections are $50. Temporary tents and structures are re-inspected every 30 days for as long as they stand, up to 180 days, at $50 per visit after the first. A new business or change of use needs a $75 certificate of occupancy inspection, and buildings on the periodic schedule apply for their certificate of inspection through OpenGov.
The Zoning By-Law adds its own occupancy step. No new or altered building, and no building changing use, may be occupied until the Building Commissioner issues a certificate of occupancy confirming it complies with zoning. The owner applies on the Commissioner’s form once the work is finished, with a surveyor’s certificate stating that the building or addition as completed matches the building permit, and the Commissioner must act within 10 days of filing.
Energy code and local bylaws in South Hadley
South Hadley’s energy code is the Stretch code. Article 22 of the May 10, 2017 Annual Town Meeting incorporated it into the general bylaws as Chapter 120, “including any future editions, amendments or modifications”, applying to residential and commercial buildings and enforced by the Inspector of Buildings or Building Commissioner; the bylaws list no later energy-code change. The local wetlands bylaw, Chapter 240, adopted at the January 11, 2017 Special Town Meeting, protects freshwater wetlands, vernal pools, banks, the water and land under lakes, ponds, reservoirs, rivers and streams, and the land within 100 feet of them, and the Conservation Commission’s regulations add tree removal and replacement rules. The Conservation Commission can be reached at ext. 6187.
Massachusetts has one State Building Code, 780 CMR, for every city and town; towns cannot rewrite it, though many opt into a stricter energy code. The trades run under their own state codes. Massachusetts rules
