Inside Le Mars city limits, the Code & Building Department at City Hall, 40 Central Avenue SE (712-548-4972), issues building permits under the 2024 International Building, Residential and Energy Conservation Codes and the 2024 Uniform Plumbing Code, on paper or through the city’s online forms. Plan review takes at least three business days, a $300,000 house pays $1,540 on the January 2013 valuation table, and electrical work is permitted and inspected by the State of Iowa.

What requires a building permit in Le Mars?

Le Mars issues separate permits for buildings, fences, signs, demolition and moving a structure, and its building application covers new construction and additions, alterations or replacements for one- and two-family homes, multi-family buildings, commercial and industrial buildings, accessory buildings, detached garages and pools. The city’s contractor notice says plainly that in-ground swimming pools do require a building permit.

Permit needed

  • New houses, additions and remodels
  • Multi-family, commercial and industrial buildings
  • Detached garages and accessory buildings of 120 square feet or more
  • In-ground swimming pools
  • Fences ($45 fence permit)
  • Signs
  • Demolition and moving a building
  • A vacant building in the Downtown Historic District (vacant building permit)

No permit, but setbacks apply

  • Accessory buildings under 120 square feet: return the application with a site plan so the department can check setbacks and easements
  • Electrical work is not a city permit (state permit instead)

Accessory buildings in the R, RC, R-1, R-1A and R-2 districts are limited by the zoning rules printed in the packet. A private garage may have up to 850 square feet, plus 200 square feet for each 3,000 square feet of lot area above 7,500, but never more than 1,250 square feet or space for more than five cars. Accessory buildings may not go up before work on the main building has started, may not stand in front of it unless attached by a common wall, may not be lived in, may not cover more than 30% of the rear yard and may not sit in an easement. One placed within 10 feet of the house is treated as part of it and needs the house’s side and rear yards; one farther away may be 2 feet from a side or rear lot line but must be at least 60 feet from the front lot line, and a garage entered from an alley stays 10 feet back from it.

What Le Mars decides and what the state holds

The packet lists the codes the city currently enforces: the 2024 International Building, Residential, Existing Building, Fire and Energy Conservation Codes, the 2024 Uniform Plumbing Code, the 2024 International Mechanical Code with NFPA 58 and 54, and the State Fuel Gas Code. Le Mars also sets its own design values with no reductions allowed: 90 mph wind, a 35 psf ground snow load, seismic zone 1 and a 42-inch frost depth. Zoning, fences, signs and the vacant building rules sit in the city code; electrical permits, trade licenses and contractor registration are state matters.

Le Mars building department: who handles permitting

The Code & Building Department in City Hall does plan review and on-site inspections for new and remodelled homes and commercial buildings, and the Building Official also serves as zoning administrator and staff liaison to the Planning and Zoning Commission and the Board of Zoning Adjustment. Luke Bernhardt, Code Enforcement Officer and Building Inspector, is the department’s listed contact, and the city’s permit packets also carry the fire chief’s name.

The city permits only inside its limits. Farm and rural land around Le Mars falls under Plymouth County’s zoning, described in the Plymouth County guide, where the county issues land use permits without construction inspections.

Le Mars permit types

Each application states that it is not the permit itself: building, fence, sign and demolition requests take three business days to review and process, and a moving request takes seven. The online versions ask for the same details as the PDFs, including every contractor on the job.

Residential permits

For a house, the city wants an accurate site plan showing lot pins, property lines and lot dimensions, distances from the new structure to lot lines and other buildings, utilities and easements, driveways and sidewalks, and site drainage. One full set of plans goes with it: square footage of each floor, the basement, garage and decks; a foundation plan with every footing, which must be continuous, stepped where needed; floor plans with window, door and smoke detector locations and the house-to-garage separation (1/2-inch gypsum board on the garage side and a hollow metal or solid wood door); a wall section; energy documents; and elevations of all four sides. Hurricane clips are required, and the truss package must be on site.

The inspector’s notice to contractors adds the points most often missed: post the address during construction, run tracer wire on the water service, keep garage floor drains and sump pumps out of the sanitary sewer, fit dual-sensor smoke detectors and hard-wired carbon monoxide alarms with battery backup, and protect floor assemblies with at least 1/2-inch drywall.

Commercial permits

Commercial plans open with a cover sheet giving the occupancy type, use, occupant load and a code analysis, including any sprinkler, fire alarm or smoke removal system. Full structural, architectural, mechanical, plumbing and electrical sets follow, with fire-rated assemblies and occupancy separations detailed, plus full energy documents.

What comes before the building permit

  • Zoning. Check the parcel’s district on the 2023 zoning map. Variances go to the Board of Zoning Adjustment, which meets at 8:15 am as needed and heard five variance requests between April and September 2026; rezonings and plats go to the Planning and Zoning Commission, which meets at 4:15 pm as needed in the council chambers.
  • Floodplain. Ask the department whether the lot lies in a mapped flood hazard area before designing; FEMA’s current maps for the city date from October 27, 2022.
  • Downtown. A building left vacant in the Le Mars Downtown Historic District needs a $50 vacant building permit under Chapter 161, renewed each year with a re-inspection while it stays empty.

Le Mars permit costs and fees

Building permit fees come from the city’s valuation table, marked effective January 2013. Valuation means the full value of the work, rounded to the nearest dollar, covering equipment, materials, labor, overhead and profit; sign permits use the same table on the cost of the sign.

Worked example: a new house valued at $300,000 falls in the $100,001 to $500,000 band, so it pays $690 plus 200 × $4.25, or $1,540, before water and sewer charges. The bands do not join up exactly: the formula for the $501 to $2,000 band gives $59 at $2,000, yet the next band starts from $50, and the same kind of step appears between each later pair, so always price a project inside its own band. A $500 fine may be charged to an owner who moves belongings into a new house before the final inspection and certificate of occupancy.

Trade permits and who may pull them

Le Mars does no electrical inspections. The electrician must contact the State of Iowa before the job begins, and all electrical work is inspected by the State of Iowa. The city packet prints the electrical code as the “2024 National Electrical Code with State of Iowa changes.” DIAL’s electrical page says House File 2800, in effect since it was signed on June 2, 2026, removed the state amendments and that Iowa has reverted to the unamended 2023 NEC, with only the exclusions and amendments written into HF2800.

  • Plumbing and mechanical: the 2024 Uniform Plumbing Code and 2024 International Mechanical Code apply, with rough plumbing, mechanical and gas checked at the framing inspection; the application names each plumbing and HVAC contractor, who must hold the state license for the trade.
  • Water and sewer: water pumps, filters, softeners and tanks must be protected against backflow, softeners may not connect directly to the sanitary sewer, and sump pumps discharge through permanent piping to the outside.
  • Contractors: the packet tells contractors to register with Iowa Workforce Development every two years; DIAL’s contractor registration page says contractors earning at least $2,000 a year from construction must register with DIAL.

For demolition, the permit holder must notify every affected utility, have the disconnected water and sanitary sewer lines plugged, capped or removed and inspected by the Water and Wastewater Superintendents before the hole is filled, and remove all debris including foundation walls, footings and basement floors. Moving a building requires a route, a moving contractor, answers on insurance and a $500,000 bond, and five business days’ notice to the police department (712-546-4113) if traffic control is needed.

How to apply for a Le Mars building permit

1. Check the zoning

Find the district on the 2023 zoning map and confirm setbacks and any variance need with the department.

2. Find the lot pins

Pins must be located for the site plan; for a fence they must be visible to the inspector.

3. Prepare the plan set

Follow the residential or commercial guidelines in the permit packet, including energy documents.

4. Apply

Submit the fillable PDF or the online form with the valuation, contractors and site plan.

5. Pick up the permit

After at least three business days of review, you are notified and collect the permit at City Hall.

6. State electrical permit

The electrician contacts the State of Iowa before any wiring starts.

7. Book inspections

Call the department a day ahead for each stage.

Review, corrections and what causes delay

Review needs at least three business days, and moving permits seven, so allow that time before a crew is booked. The approved plans, truss engineering and energy information must stay on the job site through construction. A fence on a shared line needs signed agreement from each adjoining neighbor first, and the inspector may require missing lot pins to be re-set by a licensed surveyor.

Inspections in Le Mars

Inspections are booked with the Code & Building Department at least 24 hours in advance. The required stages are footing and foundation (after excavation and forms, with reinforcing in place, before concrete), concrete slab or underfloor (after in-slab piping and conduit, before concrete or subfloor), framing (roof, framing, fire-stopping and bracing done, wind clips in place, together with rough plumbing, mechanical and gas), drywall (before joints are taped), final before occupancy, and a final grading check against the developer’s grading plan before seeding, sod or landscaping.

The final inspection checklist covers GFCI outlets in the garage, utility room, kitchen counters and bathrooms, the fire-rated garage separation, a garage floor drain that does not reach the sanitary sewer, dual-sensor smoke detectors in halls and bedrooms, furnace clearances, the water meter with tracer wire visible and a rigid sump discharge pipe to the outside, required even if no pump is installed yet. No one may move belongings in until the certificate of occupancy is issued. Wiring is inspected separately by the state electrical inspector.

Iowa building code

Le Mars enforces the 2024 International Building, Residential, Existing Building, Fire and Energy Conservation Codes, the 2024 Uniform Plumbing Code and the 2024 International Mechanical Code, with electrical work left to the state. FEMA’s Community Status Book lists the City of Le Mars as participating in the National Flood Insurance Program, with its current flood map effective October 27, 2022.

Iowa lets most cities and counties adopt the state building code, another code or none (a city of more than 15,000 must enforce at least the state code), but the energy, accessibility, fire, plumbing, mechanical and electrical rules apply statewide. Iowa rules

Le Mars permit search and official resources

Le Mars has no public online permit search; ask the Code & Building Department at 712-548-4972 about permits and inspections on file for an address, or file a records request with City Hall. Board of Zoning Adjustment, Planning and Zoning and council agendas and minutes are posted in the city’s Agenda Center, and the full city code is published by American Legal Publishing.
