Three rivers run through the county. The St. Joseph and St. Marys rivers meet in Fort Wayne to form the Maumee. Inside Fort Wayne the Department of Planning Services oversees floodplain rules. What requires a building permit in Allen County?
Class 1 construction needs a state design release unless 675 IAC 12-6-4 exempts it, and local building permits are required as the local ordinance provides.

Which code edition applies
The Allen County Building Department enforces Indiana’s statewide codes, including the 2020 Indiana Residential Code, in Fort Wayne and the county, so one fee schedule and one contractor licensing and registration system apply. Zoning is separate: the joint Fort Wayne–Allen County Department of Planning Services handles zoning for Fort Wayne and unincorporated Allen County, and New Haven’s Planning Department issues improvement location permits in New Haven.

The Allen County Building Department issues building permits, contractor licences and registrations and certificates of occupancy, and carries out inspections, in the City of Fort Wayne and Allen County. It is at 200 East Berry Street, Suite 180, Fort Wayne (260-449-7131, Monday to Friday 7:00 to 5:00), and contractors apply through its Accela Citizen Access portal. The local building department issues the building permit and inspects the work. On a Class 1 structure the state design release, issued by IDHS or a certified local unit, must come before construction starts; IDHS has 10 business days to respond to a complete application and 20 for a plan review. Residential permits
One- and two-family dwellings and townhouses are Class 2 structures (IC 22-12-1-5), permitted by the Allen County Building Department under the 2020 Indiana Residential Code. The department publishes a residential permit guide and basement guidelines, and from November 1, 2026 new permit applications must show compliance with current handrail requirements.
Commercial permits
Commercial work is Class 1 and needs a state design release. Since January 2019 commercial plans have been submitted to the Allen County Building Department, which routes them to the other permitting departments for comment; in Fort Wayne the Fire Department’s Fire Prevention Bureau reviews them and witnesses final inspections and life-safety tests, which should be booked about five business days ahead.

Planning Services oversees floodplain inside Fort Wayne; the Surveyor’s Office issues floodplain permits in the county and its towns other than New Haven.

Inspections in Allen County
Contractors request inspections through the county’s Accela Citizen Access portal, logging in with their contractor licence number. Ask which inspection stages apply when the permit is issued.
Do not cover work before the required inspection has been approved. On Class 1 work the design release must be posted on site and a complete set of the released plans kept there until occupancy (675 IAC 12-6-19).

Does the county permit inside Fort Wayne?
Yes. The Allen County Building Department enforces the building codes in the City of Fort Wayne and Allen County, so Fort Wayne has no separate building department. Since November 7, 2025, permit applications for properties in Fort Wayne local historic districts follow a separate process that checks historic preservation requirements.
Are farm buildings exempt?

What is a Construction Design Release?
A state approval that must be issued before construction may be done on a Class 1 structure (675 IAC 12-6-3). It is issued by IDHS or by a city, town or county certified to issue releases (IC 22-15-3-1), and building a Class 1 structure without one is a Class C infraction (IC 22-15-3-7).
Which contractor licences does Indiana issue?
The state licenses plumbing contractors and journeyman plumbers (IC 25-28.5). It issues no electrical, HVAC or general contractor licence; any registration or licensing for those trades is set by the city, town or county, which may also require licensed plumbing contractors to register locally (IC 25-28.5-1-33).
