What requires a building permit in Elkhart County?

Class 1 construction needs a state design release unless 675 IAC 12-6-4 exempts it, and local building permits are required as the local ordinance provides.

Which work needs a local building permit is set by local ordinance, and the Class 1 work that needs no state design release is listed in 675 IAC 12-6-4. An exemption from a building permit is not an exemption from zoning, setbacks, floodplain rules, utility approval or a fire authority review. Which code edition applies

The county and the three city departments enforce Indiana’s statewide codes, and the county publishes its list of current building codes. Fees, submittal processes, zoning and contractor licensing are set separately by the county and each city; the county, for example, licenses electrical contractors under its Ordinance 03-119.

Before construction starts on a Class 1 structure — one used by the public, by three or more tenants, or by anyone working as another’s employee — Indiana requires a state Construction Design Release, unless the work is exempt under 675 IAC 12-6-4. Elkhart County Planning and Development issues building permits for the unincorporated county, and development in the towns of Bristol, Middlebury, Millersburg and Wakarusa also goes through the county planning department. It is at the Public Services Building, 4230 Elkhart Road, Goshen (574-971-4678), open Monday 8:00 to 5:00 and Tuesday to Friday 8:00 to 4:00. Building permits that need Health Department approval must be brought in 30 minutes before closing, and other building permits 15 minutes before closing. The cities of Elkhart, Goshen and Nappanee issue their own permits.

In 2025, building permits issued in unincorporated Elkhart County authorized 242 new privately owned housing units, all of them single-family homes, according to the U.S. Census Bureau Building Permits Survey.

The local building department issues the building permit and inspects the work. On a Class 1 structure the state design release, issued by IDHS or a certified local unit, must come before construction starts; IDHS has 10 business days to respond to a complete application and 20 for a plan review. Residential permits

The county’s building permit application covers one- and two-family residences, accessory structures, commercial and agricultural buildings, and asks whether the site is in a floodplain. An agricultural building is outside Class 1 only if it is not used for retail trade, apart from a farm-produce stand open eight months or less a year (IC 22-12-1-4).

Commercial permits

Commercial work is Class 1. The county’s application asks whether the state design release has been applied for, and commercial plans are sent to the department by email (Plans@elkhartcounty.com).

How to apply for an Elkhart County building permit

Inspections in Elkhart County

Schedule inspections with the department that issued the permit. The local department sets the inspection stages; ask for its list when the permit is issued.

Where a Class 1 project needs a design professional, the release application states that the work will be inspected at intervals by the design professional it names (675 IAC 12-6-6). Build that into the programme alongside the local inspections.

Do not cover work before the required inspection has been approved. On Class 1 work the design release must be posted on site and a complete set of the released plans kept there until occupancy (675 IAC 12-6-19).

What is a Construction Design Release?

A state approval that must be issued before construction may be done on a Class 1 structure (675 IAC 12-6-3). It is issued by IDHS or by a city, town or county certified to issue releases (IC 22-15-3-1), and building a Class 1 structure without one is a Class C infraction (IC 22-15-3-7).
