What requires a permit in Swain County?

The department reviews plans, issues building and trade permits, inspects construction and issues Certificates of Occupancy. It also enforces the County’s soil erosion and sedimentation rules and issues floodplain permits. Septic and well approvals come from the Health Department’s Environmental Health section, and new addresses from Emergency Medical Services.
Bryson City, the county’s only incorporated town, publishes no building permit office. The County’s permit checklist accepts a letter from the Town of Bryson City authorizing connection to the Town’s sewer in place of a septic permit, so County permits cover property in town. The Town has its own Planning Board and sign ordinance and posted a notice on June 2, 2026 about establishing a buildings and building regulations ordinance; ask Town Hall whether a Town zoning approval is needed.

Documents and plan requirements
To issue a permit, the County needs:
- Septic paperwork: an authorization to construct or a waiver for an existing system from the Health Department, or the Bryson City sewer connection letter
- The tax ID card and parcel number from the Tax Office, and an address from EMS
- Plans that meet the County’s plan review checklist
- The completed application, workers’ compensation certification and the licensure affidavit
- A Soil Disturbance Permit
- A lien agent letter, and a list of every contractor with names, phone numbers and signatures
Plans must show the elevation, setbacks from streams and lakes, footing and pier sizes, foundation and slab details, floor joists and girders, deck details, wall and roof systems, bedroom egress window sizes, the heat source, the electrical panel and the R-values of floor, ceiling and walls.
Sealed plans: log homes, post-and-beam homes, non-traditional systems such as panelized or SIP houses, and commercial buildings over $30,000 need drawings sealed by a North Carolina architect or engineer. Engineered designs are also required for footings on soft soil or fill, foundation walls over 9 ft, decks over 20 ft high, retaining walls 4 ft or taller and engineered beams, joists and trusses.

How to apply for a Swain County building permit
File the land development application; disturbing an acre or more needs an erosion control plan, a waterway site needs Corps of Engineers approval, and grading waits for its permit.

Request a 911 address from EMS and get the PIN from the Tax Office.
Prepare plans to the County checklist and complete the building and trade forms, lien agent letter and contractor list with signatures.

Inspections in Swain County
The portal handles inspections as well as permits, and the office can be reached at 828-488-9134. Engineered designs for footings on poor soil, tall foundation walls, high decks, retaining walls and engineered framing members must be on hand before that part of the work is inspected. A failed inspection costs $100 to repeat on a residential job and $125 on a commercial one, and an inspector’s consultation visit is $100. The department issues the Certificate of Occupancy when the work is finished.
