Clay County Building Department, 345 Courthouse Drive, Suite 1, Hayesville (828-389-0274), permits and inspects construction throughout the county and takes applications online through iWorQ or in person during set morning and afternoon hours. A 1,500–1,999 sq ft house costs $652 for building, electrical, plumbing, mechanical and fuel piping together.

What requires a permit in Clay County?

The permit types in the County’s iWorQ application and its fee schedule show what the Building Department permits:

  • Electrical service changes and low-voltage or alarm work
  • Plumbing, mechanical change-outs and fuel piping
  • Commercial buildings, shells, additions and remodels
  • Change of use or occupancy
  • Signs and communication towers
  • RV and manufactured home parks
  • Repairs after fire or flood damage

The accessory-building fees start at 145 sq ft, and repairs after a commonly recognized natural disaster still need permits, but they are issued free.

Who handles permitting in Clay County?

The Clay County Building Department enforces the state building codes and the County’s own building-related ordinances, including a Building Height Ordinance and a Solar Farm Ordinance. Its director, Anthony Stillwell, is also the County’s floodplain manager and deputy fire marshal. The office is open 8:00 a.m. to 5:00 p.m. on weekdays, closed for lunch from noon to 1:00 p.m.; mail goes to PO Box 118, Hayesville, NC 28904, and the fax is 828-389-9875.

Hayesville. Clay County’s only incorporated town is Hayesville. The County’s requirements page tells applicants inside Hayesville’s town limits or its extraterritorial jurisdiction (ETJ) to get a valid zoning permit from the Town before applying; the building permit itself still comes from the County. Hayesville’s Zoning Administrator is at Town Hall, 56 Sanderson Street (828-389-1862, zoning@townofhayesville.com).

Applying in person or through iWorQ

The Building Department links an online application in the iWorQ portal, where you pick the permit type (residential or commercial building, accessory, addition, remodel, mobile home, single trade, generator, solar and others), the kind of work and the construction type. The same portal searches past permits by number, date, owner or address. Inspection requests can also be made online.

Paper residential applications are taken at the office only between 8:00 and 9:00 a.m. and between 1:00 and 2:00 p.m. Plans may be emailed as PDFs. Applications are reviewed first come, first served, and you are told by phone, fax or email when the permit is ready to issue. The Department also posts a Subcontractor Verification Form and the energy-code forms used at the end of a job.

The posted Permit Fee Schedule took effect on January 5, 2012. A new home is priced by square footage, with one total covering building, electrical, plumbing, mechanical and fuel piping:

Remodels inside the original footprint are charged at 75% of the new-home total for the same size band (for example $489 at 1,500–1,999 sq ft). Other residential fees:

  • Mobile homes: $100 single-wide, $200 double-wide, $300 triple-wide. Modular homes: $0.20 per sq ft.
  • Detached accessory building without trades: $50 for 145–299 sq ft, $80 for 300–599 sq ft, and $80 plus $0.10 per sq ft over 600; add $25 each for electrical, plumbing or HVAC.
  • Decks, porches and similar miscellaneous permits: $70. Pools: $70 in-ground, $50 above-ground.
  • Water heater $60; residential generator $130; solar up to 32 kVA $150; demolition $30; floodplain development permit from $60.
  • NC Homeowners Recovery Fund: $10. Re-inspection or consultative visit: $50. Starting work without a permit: $150 penalty.

Commercial buildings start at $380 for under 500 sq ft (all trades), and a change of use is $0.25 per sq ft. A permit that has gone void for inactivity is not renewed; a new permit for the unchanged plan is issued at 50% of the current fee.

Plumbing in an accessory building needs septic or sewer approval first. The application lists the company name and state licence number of the electrician, plumber, HVAC installer and fuel-piping installer. The County Fire Marshal works from the same Courthouse Drive office and phone number.

What the application needs

  • Address confirmed with 911 Addressing, since an incorrect address holds up review.
  • One set of plans at least 11 x 17 in, drawn to scale (PDFs may be emailed), with a floor plan in which every room is labeled by use ("Bonus Room" or "Other" is not accepted), a foundation plan and a wall and roof section. Interior remodels and additions normally do not need sealed plans.
  • Engineer or architect design for homes over 4,500 sq ft, homes with more than two separate living areas, manufactured metal buildings, log buildings, post-and-beam buildings and all commercial work. Commercial plans also need the NC Building Code Appendix B checklist.
  • Contractor licence number and a contact phone, or, for an owner who owns the land and will live in the home for one year after completion, the owner as contractor.
  • Structure and cost: number of storeys and bedrooms, square footage by category (finished basements count as heated area) and the total price; owners doing their own work include materials plus the market value of their labor.
  • Utilities: valid well and septic permits, or the Water and Sewer letter of availability. On a septic system, additions or added bedrooms need an Environmental Health site evaluation, as does any new structure outside the house footprint near the existing septic system.
  • Lien agent appointment where state law requires one.

How to apply for a Clay County building permit

1. Hayesville zoning, if it applies

Inside town limits or the ETJ, get the Town’s zoning permit from 56 Sanderson Street first.

2. Septic, well or water and sewer

Get Environmental Health permits or the Water and Sewer availability letter; they must be presented with the application.

3. Check the flood map

In a FEMA AE zone, file a Floodplain Development Permit Application and a FEMA Elevation Certificate with the building permit.

4. Prepare plans and sub list

Scale drawings at least 11 x 17 in, sealed where the size or building type requires it, and the licence numbers of each trade.

5. Apply

Submit online in iWorQ, or at 345 Courthouse Drive between 8:00 and 9:00 a.m. or 1:00 and 2:00 p.m.

6. Pick up the permit and book inspections

Wait for the call, fax or email that the permit is approved, then request inspections online or by phone.

Inspections in Clay County

Inspections can be requested online through the County’s iWorQ link or by calling 828-389-0274. The County’s General Requirements for Inspections list the usual steps for a single-family home on a basement: footer, poured or block wall, wall waterproofing, slab plumbing, slab prep, rough-in, insulation, electrical system and final. A crawlspace home skips the slab steps and needs a wall inspection only for walls over 4 ft; a slab home needs a footer inspection only where subgrade footers are required.

All trades are inspected together at rough-in, and asking for separate trade inspections may cost extra. Mobile homes get footer, marriage wall (double and triple wides) and service connection inspections, and need one set of permanent steps before the certificate of occupancy is issued. Each re-inspection is $50.

Floodplain: the Building Department administers the County’s 2008 Flood Damage Prevention Ordinance and publishes no-rise guidance with its floodplain permit application. AE-zone projects need the floodplain permit and an elevation certificate at the time of the building application.
