Tioga County does not issue building permits. Each of its nine towns has a code enforcement officer for land outside its villages, and the six villages, from Waverly to Owego, enforce the code inside their own limits. The county’s permits are the ones that sit around a building project: a Tioga County Public Health permit for any new or repaired septic system, and Highway Department permits for driveways and work on county roads. Fees are local: in the Town of Owego a new house is a flat $250 under the 2026 schedule.
What requires a building permit in Tioga County?
The towns and villages enforce the Uniform Code under their own local laws, and the clearest statements come from the town pages. The Town of Barton says permits are required for all stages of work, needs blueprints for any home over 1,500 sq ft and has every electrical job inspected by a third party. The Town of Owego guide sets out that town’s own requirement sheets for new houses, decks, roofs, pools, generators, solar and work in the floodplain.
Local building permit
- New houses, additions, garages and decks
- Manufactured homes and mobile home additions
- Roofs, pools, generators and solar where the town lists them
- Electrical work, with a third-party inspection
- Development in a mapped floodplain
- Demolition and commercial buildings
County permits
- New or repaired septic system: Public Health
- Driveway onto a county road: Highway Department
- Other work in a county road right-of-way: county work permit
Small sheds and minor repairs are often exempt, but each town draws its own line; the Owego guide, for example, gives that town’s shed and fence rules. Ask the code officer before relying on a neighboring town’s exemption. Villages publish their own material too: Newark Valley posts its swimming pool requirements beside its code enforcement page, and Spencer posts a village building permit application.
What the towns and villages decide and what the state holds
The 2025 Uniform Code and Energy Code apply everywhere in the county. Each town or village board sets permit fees, decides on zoning and floodplain administration and appoints its code officer; the Town of Nichols, for instance, gives its code officer the floodplain administrator’s role as well. The county’s pages show no building code office, so the county sets no building permit fees or exemptions.
Tioga County building department: who handles permitting
The table covers every town and village the Census Bureau counts in Tioga County, matching the county’s own list of nine towns and six villages. A village address is permitted by the village, not by the surrounding town; the Village of Newark Valley, for example, lies in the Town of Newark Valley, not in Owego.

What Tioga County itself does
- Public Health, Health and Human Services Building, 1062 State Route 38, Owego (607-687-8600): septic system permits for new construction and for repairs of existing systems, designed to the state Health Department’s residential wastewater standards, with an online application; it also enforces drinking water rules for public and private supplies, while the state Department of Environmental Conservation regulates well drillers.
- Highway Department: driveway permits for entrances onto county roads and work permits for other activity on county routes, on the forms posted under Public Works.
- County Planning Board: reviews local actions referred under General Municipal Law 239; in April 2026 it reviewed a Village of Owego site plan and area variance and a Village of Waverly site plan and special use permit. The board posts its agendas, meeting materials and minutes, which show the staff recommendation on each county case.
Tioga County permit types and applications
Residential permits
Applications come from the town or village clerk or the code officer’s page: Barton posts a fillable building permit application, Tioga a combined building and mobile home permit application, and the Village of Spencer its own building permit application. Bring a plot plan, construction drawings (blueprints for larger homes) and the workers’ compensation forms; on a lot without public sewer, the county septic permit comes first.

Commercial permits
Commercial work usually needs local site plan approval before the building permit, and site plans, special use permits and variances near county or state roads or municipal boundaries are referred to the County Planning Board. Barton charges commercial permits per unit plus a rate per square foot; Owego charges $250 plus $0.10 per sq ft.

What comes before the building permit
- Zoning: zoning approval, variances or site plan review where the town or village has zoning.
- County referral: certain actions go to the County Planning Board, which meets monthly and makes a recommendation to the local board.
- Septic: Tioga County Public Health permit for any new or repaired system.
- Driveway: county driveway permit for a new entrance onto a county road.
- Floodplain: all nine towns and six villages take part in the National Flood Insurance Program, on maps dated April 17, 2012; Owego asks for a benchmark 2 feet above the base flood elevation.
Building permit fees in Tioga County
Each town and village sets its own fees by board resolution. The Town of Owego’s schedule was approved on January 6, 2026; Barton’s sheet dates from 2009 and was last updated on November 16, 2022, and the town warns that fees can change without notice, so call to confirm.

Rather not deal with the Tioga County building department?
Get a free quote →Barton’s sheet also sets out what is free: handicap ramps, low decks, small sheds and demolition by a homeowner carry no charge, and a swimming pool holding 24 inches of water or more must have an alarm. Worked example: a new house of any size in the Town of Owego pays the flat $250. Barton’s sheet does not say whether its $0.10 rate for homes over 1,500 sq ft applies to the whole floor area or only the area above 1,500 sq ft, so ask the code officer for the figure before budgeting. Septic permits and county road permits are charged separately by the county.
Trade permits and who may pull them
Tioga County’s pages show no county license for electricians, plumbers or home improvement contractors, and the town code pages describe none either. Electrical work is the trade with the firmest local rule: Barton requires every electrical job to be inspected by a third-party agency, and its clerk and code officer give out the names of accepted inspectors; Owego keeps its own short list of approved electrical inspection agencies. Plumbing and heating work go on the building permit. Septic installation is controlled through the county Public Health permit rather than a contractor license. Any applicant must show workers’ compensation and disability insurance, or the state exemption form for an owner doing the work.

Several offices here work by appointment, so leave a message with the town clerk and expect a call back. Applications stall when the septic permit has not been issued, when a home over 1,500 sq ft arrives without blueprints in Barton, or when a project needs a county planning referral and the local board must wait for the county’s recommendation at its monthly meeting.
Inspections and certificates
The code officer who issued the permit carries out the inspections and issues the certificate of occupancy or compliance; book by phone, giving the officer as much notice as possible where the office works by appointment. The third-party electrical certificate must be in hand before the final. Septic systems are checked against the county Public Health permit, and floodplain projects in Owego need the surveyor’s elevation paperwork before the work is signed off.
New York building code
New York builds on one statewide code, the Uniform Code, outside New York City; the 2025 edition and 2025 Energy Code took effect on 31 December 2025 (the all-electric provisions remain suspended by court order). Cities, towns and villages administer it, and local standards stricter than the code need Code Council approval. The Uniform Code in New York
In Tioga County each town and village enforces the Uniform Code under its own local law; the county’s own construction permits are its septic and highway permits.
