For property in the Town of Orchard Park outside the village, permits come from the town Building Department in the Municipal Center, 4295 South Buffalo Street (716-662-6430). Electricians and plumbers must hold a town license, every inspection needs 24 hours’ notice, and under the 2026 fee schedule (updated July 1, 2026) a new one- or two-family house costs $75 plus $0.35 per square foot.

What requires a building permit in Orchard Park?

Chapter 45 of the Town Code requires a building permit for work governed by the Uniform Code and Energy Code, and the department adds its own list of everyday projects that need one. Since January 2020 the town has also required separate permits for plumbing (all plumbing work), mechanical equipment, roofs and fire protection.

Permit required

  • All new construction, additions and garages
  • Decks and patios, gazebos and structural alterations
  • In-ground and above-ground pools
  • Tool sheds and fences
  • Roofing
  • Furnaces and air conditioning
  • Permanent generators, wood stoves and fuel-burning appliances
  • Additional plumbing fixtures and all other plumbing work
  • Fire protection systems
  • Excavation and fill, demolition and signs
  • Food trucks

No building permit (Section 45-10 exemptions)

  • Playground equipment at a one- or two-family home or townhouse
  • Pools under 24 inches deep installed entirely above ground
  • Retaining walls that carry no surcharge
  • Window awnings on a house
  • Partitions under 5 feet 9 inches
  • Painting, wallpapering, tiling and carpeting
  • Portable listed appliances and like-for-like equipment replacement
  • Repairs that leave structure, egress, building systems and fire protection alone

Orchard Park’s exemption list has no shed or fence item, which is why the department lists tool sheds and fences among permitted work. Fences must be built good side out (a rule in force since October 5, 2022), may not exceed 3 feet in a front yard or 6 feet in side and rear yards, may not stand in the public right-of-way or block drainage, and must keep the 50-foot sight triangle on corner lots clear between 2 and 6 feet above the road. Fences on non-residential property need Planning Board approval before the permit.

What the town decides and what the state holds

The Uniform Code and Energy Code set the construction standards, and Orchard Park adds no stricter construction rules without Code Council approval. The town decides permit scope and timing, zoning setbacks (Chapter 144), trade licensing, its fee schedule, floodplain development (Chapter 66), excavation and fill (Chapter 61) and historic preservation (Chapter 74).

Orchard Park building department: who handles permitting

The town’s Building Inspector / Code Enforcement office, led by Supervising Code Enforcement Officer Tom Minor, reviews plans, issues permits, inspects and issues certificates of occupancy for the town outside the village. Its office is in the Municipal Center on South Buffalo Street, which sits inside the village itself.

Village of Orchard Park. The village, with 3,079 residents, lies entirely within the town and has its own Building Inspector/Code Enforcement Officer, permit applications, fee schedule and Zoning Board of Appeals. Its permit list includes decks, sheds, fences, pools, signs, newly paved surfaces, any new or extended electrical circuit and generators, and since October 1, 2023 the village has charged a $500 fee for any permit obtained after work has started. Its 2026 zoning code revisions are posted only as a slide presentation, so ask the village office whether they are in force.

Orchard Park permit types and filing

The department posts separate applications for residential and commercial building permits, accessory structures, demolition, electrical work, fences, fire protection, generators and fuel-burning appliances, mechanical work, operating permits, plan review, pools, plumbing, roofs, signs and zoning verification letters. Before any application is reviewed, it must have the contractor’s information, insurance certificates, the property owner’s authorization, all application fees and, where needed, plans and a survey.

Residential permits

Building permits need two sets of drawings, stamped and certified by a New York architect or engineer when the project is worth more than $20,000: a site or plot plan on the survey, foundation, floor, electrical and plumbing, framing and HVAC plans, elevations, sections, door and window schedules, energy-code checklists and stamped plan review sheets. Accessory buildings may not sit in a front yard or required side yard, must keep their roofs 10 feet from a pool’s edge and stay 10 feet from other buildings (8 feet at minimum with one-hour fire protection); over 600 sq ft or over 10 feet at the eave they need frost-protected foundations, and over 600 sq ft a design professional’s stamp; trusses need a stamped truss certificate. In-ground pools, and above-ground pools whose top rail is under 48 inches, must be fenced at least 4 feet high with self-closing, self-latching gates, and pool alarms have been required since 2007.

Commercial permits

Commercial work starts with the plan review application (revised July 8, 2026). The 2026 schedule charges $1,000 to review new construction, $500 for an addition, $750 for a mercantile store build-out and $250 for an alteration, on top of the permit fee of $100 plus $0.50 per sq ft for new commercial construction. A site plan waiver costs $150, a change-of-use certificate of occupancy $75, and commercial mechanical and fire protection permits $100 for the first $1,000 plus $10 per $1,000 after.

What comes before the building permit

Zoning setbacks for accessory buildings and other structures come from Chapter 144; variances go to the town Zoning Board of Appeals, whose application is posted with the building forms. Excavation and fill need their own permit. Exterior sewer and water line repairs and replacements are handled by the town Engineering Department, not the Building Department. Lots on septic need Erie County Department of Health approval, and the survey for an accessory structure must show the septic system or grinder pump and any easements.

A new 2,000 sq ft house therefore costs $75 plus $700, or $775, for the building permit. A $20,000 addition is $75 for the first $1,000 plus $152 for the remaining $19,000, or $227. The electrical and plumbing permits are separate, and the electrical inspection agency bills its own fee.

Starting work before the permit doubles the fee. Multifamily buildings are $100 plus $0.45 per sq ft, and fire inspections of multifamily dwellings cost $75 per building.

Trade permits and who may pull them

Since January 2020 Orchard Park has required electricians and plumbers to hold a town license before working in the town. The license application covers master electricians and residential electricians ($100 a year each), master plumbers ($100) and journeyman plumbers ($50). A new license needs proof of insurance and Prometric test results with a score of 75 or better; someone already licensed by another New York municipality can get a reciprocity license with proof of insurance and that current license. The town posts lists of its licensed electricians and plumbers, last updated May 21, 2026.

Every plumbing job needs a plumbing permit ($75 plus $10 per fixture), and furnaces and air conditioners need a mechanical permit. Electrical work is inspected by third-party agencies the town approves, under Section 45-4; the department’s contact list for them was updated in January 2026, and the agency’s fee is separate from the town’s $75 electrical application fee. The town posts the electrical wiring requirements for permanently installed pools.

Contractors must give the department their workers’ compensation and disability insurance documents with the application, or the state exemption form if they believe they are exempt; no permit issues without them. Demolition follows the State Labor Department’s lead and asbestos rules and needs its own town permit.

Roofs and mechanical equipment. On a roofing permit the contractor schedules the inspections with 24 hours’ notice, must follow the state asbestos rule (Industrial Code Rule 56) and must dispose of the debris legally; the town does not collect contractors’ construction debris. A mechanical permit for a furnace or air conditioner needs two copies of a sketch showing where indoor equipment goes, or two copies of the property survey marking outdoor units, and installation must follow the manufacturer’s instructions and the electrical code. If the contractor fails to book the inspection in time, the town holds the property owner responsible.

Septic. Where a lot is not on public sewer, the Erie County Department of Health (716-961-6800) issues the construction permit for an onsite wastewater system designed by a licensed design professional, then a completed-works approval; repairing or replacing a system needs a county application and a $300 fee.

How to apply for an Orchard Park building permit

1. Town or village

Confirm the parcel is outside the Village of Orchard Park; village parcels go to the village code office.

2. Choose the form

Download the application for the work from the department page, plus its additional-information sheet.

3. Hire licensed trades

Use a town-licensed electrician and plumber, and pick an approved electrical inspection agency.

4. Submit a complete package

Contractor details, insurance, the owner’s authorization, plans, a survey and the fees, at the Municipal Center.

5. Clear zoning and planning

Non-residential fences and commercial projects need Planning Board or plan review approval first; variances go to the ZBA.

6. Book inspections in order

Give 24 hours’ notice for each stage and obtain the certificate of occupancy before moving in.

Review, corrections and what causes delay

The department does not begin review until every required document and fee is in, so a missing insurance certificate or owner authorization stops the file at intake. Changes to the approved scope must be reported and approved before they are built, and revised drawings may be needed. Under Section 45-10 a permit becomes invalid if work does not start within six months and expires 24 months after issue.

Orchard Park inspections and certificates

Call 716-662-6430 at least 24 hours before each inspection and give a contact phone number, which is mandatory. Emergency work takes precedence over scheduled visits, and non-compliant results or a same-day cancellation bring an additional inspection fee ($50 per extra inspection on the 2026 schedule). The department’s inspection sequence for a building permit is: foundation stake-out before excavation, footing and foundation excavation, floor framing with drain tile, plumbing and floor insulation, building systems (plumbing, HVAC and electrical), rough framing before insulation, fire-resistant construction and penetrations, insulation before drywall, and a final with all trades complete.

Do not move to the next stage until the previous one has been inspected: the town can order work removed, at the owner’s or contractor’s cost, so it can see what was covered. No new building or addition may be occupied until the Building Inspector issues a certificate of occupancy. The permit gives no right to encroach on town property, and every building must display its house number where emergency crews and inspectors can see it.

New York building code

New York builds on one statewide code, the Uniform Code, outside New York City; the 2025 edition and 2025 Energy Code took effect on 31 December 2025 (the all-electric provisions remain suspended by court order). Cities, towns and villages administer it, and local standards stricter than the code need Code Council approval. The Uniform Code in New York
