Niskayuna’s Building Department, One Niskayuna Circle (518-386-4522, weekdays 8 am to 5 pm, open through lunch), issues the combined building and zoning permit required for any new structure, addition, alteration or change of use in the town. A new house is charged $0.30 per square foot of floor area, smaller jobs start at $70, plumbers must be registered with the Town Clerk, and electrical work goes to a third-party inspection agency.
What requires a building permit in Niskayuna?
Section 220-66B of the zoning law says no one may alter or add to a structure, build a new one or change a building’s use without a valid zoning and building permit from the building inspector. The department’s own list is broad.
Permit needed
- New houses, additions, structural changes and finished basements
- Decks, pools, sheds and detached garages
- Fences of any height
- Roofing, siding and door or window replacement
- Lawn irrigation and sprinkler systems
- Drainage systems and grading
- Generators, EV chargers, solar and emergency alarm systems
- Portable storage units and bulk waste containers
- Demolition and keeping chickens
Separate permits
- Interior plumbing: a plumbing permit from the Building Department
- Water and sewer service lines: Water & Sewer Department
- Electrical work: a third-party underwriter permit
- Septic systems: Schenectady County
- Work in a town road: town highway permit
Accessory buildings may not be taller than 15 feet. A shed of 120 square feet or less can sit 5 feet from the side and rear lines; anything larger must meet the district setbacks, which run from 15 feet (side) and 20 feet (rear) in the R-2, R-3 and R-P districts to 35 and 40 feet in R-R, and no accessory building may sit closer to the street than the house. On smaller lots total accessory coverage is capped: 2,250 sq ft on an R-1 lot under 18,000 sq ft and 1,350 sq ft on an R-2, R-3 or R-P lot under 9,000 sq ft. Fences may stand on the property line, up to 6 feet in the rear yard and 4 feet in side and front yards, and no more than 30 inches inside a 30-foot triangle at a street corner.
What Niskayuna decides and what the state sets
Building standards come from the state Uniform Code and Energy Code. Niskayuna adopted the stricter NYStretch energy code, in force from March 1, 2022; the town says the 2025 Energy Code absorbed those requirements, so permits filed from December 31, 2025 are checked against the 2025 Energy Code alone. Fees, zoning (Chapter 220), plumber registration (Chapter 155), electrical inspection arrangements (Chapter 87) and flood damage prevention (Chapter 117) are local.
Niskayuna building department: who handles permitting
The Building Department interprets and applies the zoning ordinance, issues building, zoning and plumbing permits, inspects construction and handles fire safety and code enforcement. Laura Robertson, AICP, is the department head; two building inspectors and an information processing specialist, who also staffs the Zoning Board of Appeals, make up the office. Niskayuna has 24,211 residents (Census 2025 estimate) and no villages, so the department covers the whole town.

Niskayuna permit types and filing rules
Residential permits
One Application for Building and Zoning Permit (May 2026 edition) covers new buildings, additions and alterations, signs, drainage, excavation, fill and grading, and demolition; it goes in with three copies of the plans. Project supplements, revised in September 2026, cover accessory structures, finished basements, decks, fences, swimming pools, solar, EV charging equipment, lawn sprinklers and backyard chickens. An owner applying for their own property does not need the application notarized; anyone else must swear that the owner authorized the work, as Section 75-5B requires.
Insurance is checked on every application. Contractors file general liability, workers’ compensation and disability certificates naming the Town of Niskayuna as certificate holder, or the state’s CE-200 exemption; homeowners doing their own work file a CE-200, which is valid for one permit only. The deck supplement sets frost footings at least 42 inches deep and 8 inches across, and the single-family package asks for a grading and plot plan prepared by an architect, engineer or land surveyor.
| District | Minimum lot | Lot coverage | Front / side / rear setback |
|---|---|---|---|
| R-R | 80,000 sq ft; 200 ft wide | 10% | 55 / 35 / 40 ft |
| R-1 | 18,000 sq ft; 100 ft wide | 25% | 35 / 20 / 25 ft |
| R-2, R-3, R-P | 9,000 sq ft; 80 ft wide | 30% | 30 / 15 / 20 ft |
Setbacks are measured from the property line, not the edge of the pavement or the center of the road, and houses may be no taller than 35 feet. For houses built before July 1, 1971, the front setback may instead follow the average of the other houses on the street under Section 220-16E(2).

Commercial permits
New commercial buildings and apartments are $0.31 per square foot; other commercial work is $150 for the first $1,000 of cost plus $15 for each additional $1,000. Site plan review costs $200 plus $50 for each 1,000 sq ft of new building, a special use permit $300 and a tenant change with no site changes $100. Home occupations need a $75 permit and $25 a year after that. Commercial roofing runs from $187 for jobs under $10,000 to $625 for jobs of $100,000 or more.
For tenant improvements and new commercial builds, Alliance handles commercial permit filing through issuance. More on this: commercial building permits explained.
What comes before the building permit
- Town Engineering review: permits that need a referral to the Engineering Department carry an added fee: $250 for a new house, $350 for new commercial construction and $160 for pools, drainage, grading, sump pump discharge lines and easement agreements.
- Zoning Board of Appeals: $100 for an area variance on a one-family home, $200 for other appeals, plus $50 or $100 if you ask to reschedule a hearing.
- Planning Board: subdivisions, special use permits and site plans.
- Flood zones: Niskayuna takes part in the National Flood Insurance Program; its current flood map is dated January 8, 2014.

Rather talk it over?
Call 1-855-478-4290 →For example, a 2,400 sq ft house with a 480 sq ft attached garage and a 200 sq ft deck counts 3,080 sq ft, so the permit is $924, plus $250 if the plans are referred to Town Engineering. A $40,000 kitchen addition is $70 plus 39 × $10, or $460. Permits last one year; each renewal needs a new application, lasts only six months and costs twice the one before it.
Trade permits and who may pull them
Plumbing. Plumbing needs its own permit from the Building Department, and the plumber must hold a Niskayuna plumber’s registration from the Town Clerk. Under Chapter 155 the registration goes to holders of a master plumber license issued by any New York municipality and runs to the next January 1. Residential plumbing permits are $75 plus $10 a fixture for one- and two-family homes and $100 plus $15 a fixture for multiple dwellings. Exterior water and sewer service lines are permitted by the Water & Sewer Department: $250 each for a residential water or sewer service, $150 for a sewer tap inspection, and $800 and $1,000 for commercial services; water meters cost $400 or $550 and are installed by the Water Department.
Electrical. Electrical work needs a permit from a third-party New York underwriter agency, not the town. Chapter 87 deputizes the agencies approved for this service area and makes it a violation to install wiring before applying to one. The town’s May 2026 list names Commonwealth Electrical Inspection Service, The Inspector and Middle Department Inspection Agency; call the agency before starting and again when finished.
Septic. Where a property needs a septic system, Schenectady County, not the town, issues the engineering plan approval and the construction permit for installing or repairing it.
Contractors. Niskayuna registers plumbers but has no general contractor or electrician license; contractors prove insurance on each permit.

Review, corrections and what causes delay
The department reviews applications for completeness in the order they arrive and has said that step can take up to two weeks; an application missing insurance, surveys, grading plans or adequate drawings is marked incomplete and gets a new date only when the gaps are filled. Projects referred to Town Engineering add a separate review and fee, and anything needing a ZBA variance waits for a hearing.
Niskayuna inspections and certificates
Call the Building Department to book. The office tries to fit inspections in the same day but does not promise it: morning requests must be in before 9 am and afternoon requests before 1 pm, and inspectors visit between 10 am and noon or between 2 and 4 pm. The permit placard lists the inspections your job needs; for a house they usually run footing, foundation and backfill, rough plumbing, rough framing, insulation, final plumbing, final building and final grading, with the rough and final electrical done by the third-party agency.
The list ends with the agency’s final electrical inspection and the town’s final plumbing, final building and final grading inspections. For underground sprinkler systems, the backflow device must be certified before the final plumbing inspection.
New York building code
New York builds on one statewide code, the Uniform Code, outside New York City; the 2025 edition and 2025 Energy Code took effect on 31 December 2025 (the all-electric provisions remain suspended by court order). Cities, towns and villages administer it, and local standards stricter than the code need Code Council approval. The Uniform Code in New York
