In the Town of Lysander, building permits are issued by the Codes, Planning and Zoning office at Town Hall, 8220 Loop Road, Baldwinsville (315-638-1210, weekdays 9 am to 4:30 pm). Under the town’s 2023 fee schedule most permits cost $30 for the first $1,000 of project cost plus $5 for each additional $1,000. Parcels in the part of the Village of Baldwinsville that lies in Lysander go to the village’s own code office instead.

What requires a building permit in Lysander?

Chapter 122 of the Town Code, adopted in January 2023, requires a permit for work regulated by the Uniform Code and Energy Code. The town’s application and fee schedule show the usual categories:

Permit needed

  • New homes, additions, repairs, alterations and demolition
  • Garages, pole barns, porches and decks
  • Sheds over 144 square feet
  • Pools, priced like the matching type of construction
  • Solid-fuel and gas-burning devices, generators and solar arrays
  • Most fences (see the exemption)
  • Commercial construction
  • Fireworks displays

Exempt

  • One-story sheds and playhouses up to 144 square feet at a one- or two-family home or townhouse
  • Fences under 4 feet high set more than 6 feet back from the property line
  • Finish work such as painting, tiling and carpeting
  • Replacing equipment without changing its listing or original specifications
  • Repairs that do not affect fire and life safety: the structure, required exits or fire protection

Lysander’s fence law (Chapter 148, 2022) caps fences at 7 feet on residential property and 10 feet elsewhere, requires a fence in a residential front yard or along a road to be less than 50% solid, puts the finished side outward, and bans barbed wire and pointed fences under 3 feet.

What Lysander decides and what the state sets

The Uniform Code and Energy Code set the building standards. Lysander sets its own zoning (Chapter 320), flood damage prevention (Chapter 151), fence rules and fees by Town Board resolution. Its battery energy storage law (Chapter 102, 2020) allows Tier 1 systems of 600 kWh or less in every zoning district with a battery permit and no site plan review, while Tier 2 systems, larger or mixing battery technologies, need a special use permit and site plan approval and are allowed only in the Agricultural and AR40 districts. Two moratoria are in force in 2026:

⚠️ Moratoria. Local Law 4 of 2026 bars development or construction of data storage facilities until November 7, 2026; on October 1, 2026 the Town Board scheduled a public hearing for 6:30 pm on November 5, 2026 on extending it to May 9, 2027. Local Law 6 of 2026 extended the moratorium on Tier 2 battery energy storage systems to December 19, 2026.

Lysander building department: who handles permitting

One office handles building permits, zoning applications, code enforcement and the scheduling of fire safety inspections, and it supports the Planning Board and Zoning Board of Appeals. Tim Wolsey is the Code Enforcement Officer and Zoning Administrator. The office posts a monthly report of the building permits it issued.

The Village of Baldwinsville lies partly in Lysander and partly in Van Buren; its office requires a permit for any work that must meet state or local codes, and its list includes sheds, decks and fences, satellite dishes, open and enclosed porches, structural renovations such as roofs, new walls, doors and windows, finished basements, and plumbing and electrical work. The village office is open only in the morning. Many Lysander parcels outside the village also carry a Baldwinsville mailing address, so check the tax map before filing.

In October 2026 the town warned of a scam: residents received fake invoices by mail and email for permits and payments. If you receive a bill, call the Planning and Zoning office to confirm it before paying.

Lysander permit types and filing rules

Residential permits

The building permit application (revised May 6, 2024) covers new builds, additions, repairs and alterations, pools, fireplaces, solar and generators, and demolition, and asks whether the project includes plumbing, electrical work or a highway permit. Attach a plot plan or survey showing the lot, the buildings and the streets. The application asks for one set of drawings, but Chapter 122 (as amended by Local Law 6 of 2023) calls for at least two sets of construction documents, and the code governs. For a new home on a lot of 40,000 square feet or less, the site plan must be drawn by a licensed professional from an accurate boundary survey, with distances to lot lines, street grades, proposed finished grades and any flood hazard areas. Contractors and anyone hiring employees must carry workers’ compensation coverage, and liability insurance can be attached or kept on file.

By signing, the owner or agent accepts responsibility for getting each required inspection done before the work is covered.

Commercial permits

Commercial projects use the same application. The fee schedule’s valuation chart prices commercial space at $80 per square foot for estimating cost, and commercial fire inspections are charged by floor area. Site plans and controlled site uses go to the Planning Board, which meets the second Thursday of the month at 7 pm. Chapter 122 accepts construction documents only when they meet its content rules, including the seal of a New York architect or engineer where state education law requires one, and the accepted set must be kept on site.

What comes before the building permit

  • Zoning Board of Appeals, first Monday of the month at 7:30 pm as needed: area variances $50, use variances and specific use permits $75 each.
  • Planning Board: a $75 application fee for every action, $125 for final subdivision approval, and escrow deposits ($1,000 for a controlled site use; $2,000 each when a subdivision adds roads, town water or public sewers).
  • Recreation land: subdivisions pay a fee in lieu of land for public use, $250 per lot for a minor subdivision, $500 per lot for a major one and $500 per apartment unit, before final plat approval.
  • Stormwater: a SWPPP acceptance form where a stormwater plan is required, and a $200-per-acre escrow deposit for stormwater management on subdivisions.
  • Flood plain: Lysander takes part in the National Flood Insurance Program, with a current flood map dated November 4, 2016.
  • Septic: Onondaga County Health Department review where there is no public sewer.

Lysander permit fees

The town’s posted 2023 Permit Fee Schedule charges most work by the estimated project cost. The schedule tells contractors to estimate a project’s cost with its per-square-foot valuation chart.

For example, a new 2,000 sq ft house is valued at 2,000 × $60 = $120,000; the fee is $30 for the first $1,000 plus 119 × $5 = $595, or $625. A 300 sq ft deck is valued at $3,600, so the fee is $30 plus 3 × $5 = $45 (the last $600 counts as a portion of a thousand). Plumbing is billed separately by the county, starting at $225 for a new one- or two-family home with up to 20 fixtures.

Trade permits and who may pull them

Plumbing. Onondaga County’s Department of Water Environment Protection, through Plumbing Control, licenses plumbers and issues and inspects every plumbing permit in Lysander. Licensed plumbers file the county permit; an owner-occupant of a single-family home may apply in person for a homeowner permit and do the inside work personally, but not water services or building sewers. A water heater installation permit is $15. On the county’s 2026 fee sheet a new one- or two-family home costs $225 for up to 20 fixtures and $250 above that, a new sanitary sewer connection $150 and a new water service $100. Homeowners applying for their own permit bring proof that they own and live in the single-family house, the state WC/DB-100 affidavit and a plan of the drain and vent piping, and should expect questions on materials and fittings.

Electrical. The town application flags electrical work and makes the permit holder responsible for having it inspected by an appropriate inspector before it is covered; the town’s pages and code show no town electrician license.

Septic. The county Health Department’s Bureau of Public Health Engineering reviews individual sewage system designs and repairs and works with Plumbing Control and town code officers.

How to apply for a Lysander building permit

1. Confirm town jurisdiction

Make sure the parcel is outside the Village of Baldwinsville.

2. Check zoning and the moratoria

Ask the office about setbacks, fence rules and whether the data center or battery storage moratorium affects the site.

3. Prepare the drawings

A plot plan or survey and at least two sets of construction documents, as Chapter 122 requires; a professional site plan for a new home on a lot of 40,000 sq ft or less.

4. File the application

Bring the signed form and insurance proof to Town Hall; the application lists zoning@townoflysander.org for questions.

5. Pay the fee

The fee follows the estimated cost from the town’s chart; call the office if any invoice looks unfamiliar.

6. Inspections and certificate

Get each stage inspected, then obtain a certificate of compliance or occupancy before using the space.

Review, corrections and what causes delay

The application lists what the office needs to review a new home: a site plan with lot-line distances, street grades, proposed finished grades and any flood hazard areas, plus insurance attached or on file. A permit becomes invalid if work has not started within six months and expires 12 months after issue; it can be renewed on application and payment of the fee. Lifting a stop work order costs $75 for a first residential offense.

Lysander inspections and certificates

The permit holder must make sure the required inspections are done before work is concealed. Chapter 122 lists the stages: the site before the permit is issued, footings and foundations, slab preparation, framing, structural, electrical, plumbing and mechanical systems, fire-resistant construction and penetrations, solid-fuel appliances, chimneys and vents, Energy Code items such as insulation and air leakage, manufactured home installation, and a final. The code lets the officer accept a remote inspection instead of a site visit when that is adequate. The fee schedule charges $75 for each second inspection or re-inspection. Plumbing is inspected by the county, and septic work by the county Health Department. No building may be occupied until the town issues a certificate of compliance or certificate of occupancy.

A temporary certificate of occupancy may be issued for part of a building that can be occupied safely before the whole job is finished. The office also schedules fire safety inspections, which the code requires every 12 months for assembly spaces, schools and colleges and every 36 months for multiple dwellings and other nonresidential buildings; multi-occupancy residential buildings pay $35 for common areas and each additional unit, and commercial buildings $50 to $150 depending on floor area.

New York building code

New York builds on one statewide code, the Uniform Code, outside New York City; the 2025 edition and 2025 Energy Code took effect on 31 December 2025 (the all-electric provisions remain suspended by court order). Cities, towns and villages administer it, and local standards stricter than the code need Code Council approval. The Uniform Code in New York
