In unincorporated Dakota County, building and zoning permits are issued by the county Planning and Zoning office (402-632-5006), under zoning regulations that require a permit before any building is erected, moved, enlarged or structurally altered at a cost above $1,000. Since October 2021 the regulations have set a $100 fine for starting construction without a building permit, and each further day counts as a separate offense. South Sioux City, Dakota City, Homer and Emerson permit work inside their own zoning areas.

What needs a county permit in Dakota County?

Section 510 of the county zoning regulations bars erecting, moving, adding to or structurally altering any building or structure costing more than $1,000 without a permit from the official the regulations call the Building Inspector. Other county approvals sit alongside it:

Permit needed

  • New houses, additions, garages and other non-farm buildings
  • Farm buildings: since Resolution 23C-035 took effect on October 16, 2023, building or altering one needs a zoning compliance permit
  • Any development or substantial improvement in the Special Flood Hazard District (a separate floodplain development permit)
  • A temporary mobile home lived in while a house is built
  • A second home for a relative on agricultural land (an annual consanguinity permit from the Planning Commission)
  • Conditional uses, such as recreational vehicle parks and livestock feeding operations

Defined by the county

  • A farm building is one used for agriculture on a farmstead of 20 acres or more that produces at least $1,000 of farm products a year
  • Houses and other buildings meant for people to live in are never farm buildings
  • Before the 2023 change, farm buildings needed no zoning permit; the 2006 regulations on the county website still show the old wording

Who issues permits in Dakota County?

The county Planning and Zoning office, led by Planning and Zoning Administrator Joe O’Neill, takes building and zoning permit applications for the unincorporated county and supports the volunteer Planning Commission and Board of Adjustment. The regulations define the building code as the current Uniform Building Code adopted by Dakota County, and they direct permit fees to the County Treasurer.

The towns decide permits inside their own zoning jurisdictions, and the county regulations do not apply where a city or village exercises extraterritorial jurisdiction. When a parcel straddles the line, the location of the proposed structure decides whose rules apply.

Applying for a county permit

Application forms come from the Planning and Zoning office (402-632-5006). Under Section 511 every application comes with plans drawn to scale that show:

  • the actual shape and dimensions of the lot;
  • the size and position of any buildings already on it;
  • the location, dimensions and use of the proposed building or alteration;
  • any other details the office asks for, such as the number of families or rental units and conditions on the lot.

One copy of the plans comes back marked approved or disapproved and signed, and a refusal is explained in writing. A permit lapses if work has not begun within 90 days of issue, and the work must be substantially finished within two years. Permits cannot be transferred: a new owner needs a new permit, although its cost may be reduced for inspections already made.

A temporary mobile home permit lets a family live on site while the house is built. The mobile home may stay until 30 days after the house is finished or two years, whichever comes first, and the Planning Commission can grant one one-year extension.

Dakota County permit fees and penalties

The County Board of Commissioners sets the fees for building permits, zoning compliance permits, appeals and zoning changes, and the regulations say the schedule is posted in the Building Inspector’s office, where the current amounts can be obtained. Fees are paid to the County Treasurer, and appeal and rezoning forms count as filed only once their fees are paid.

Electrical, septic and driveway rules

Electrical: the State Electrical Division lists a local inspection program for single-family homes only in South Sioux City, Dakota City, Homer and Jackson, where South Sioux City’s inspector (402-494-7529) does the work. Electrical permits and inspections everywhere else in the county, and for other building types, come from the Division.

Septic systems: state onsite wastewater rules (Title 124) apply, and only a state-certified professional may install, repair, pump or inspect a system; county or city requirements come on top of the state rules.

Driveways: on agricultural land a building permit is not issued for a lot whose driveway reaches a state or federal highway until the state road permit has been granted, with a copy filed with the Zoning Administrator.

Local Dakota County rules that shape a project

Agricultural lots: since September 2018 the minimum lot for a principal use in the AG district is 2.5 acres (it was 5 acres). Each lot needs legal access to a county gravel road, driveways must be at least 200 feet apart with no more than 10 per mile, and buildings sit at least 90 feet from the road center line or 50 feet from the property line, whichever is greater. No house is allowed within 200 yards of a public hunting area, and no house, livestock feeding operation or well within 1,000 feet of a public supply well.

Relatives’ homes: a consanguinity permit allows a home for a relative on agricultural land, renewed each year by letter. If the arrangement ends, the home must be split off on its own 2.5 acres or removed, and a building permit is still needed before construction.

Floodplain: in the Special Flood Hazard District the Zoning Administrator issues a separate development permit, and a new or substantially improved home must have its lowest floor, basement included, at least 1 foot above the regulatory flood elevation.

Energy and utility projects: the county has adopted a Solar Energy Overlay District and commercial solar rules (2025), wind energy rules and pipeline rules (2022). In 2026 the Planning Commission has been drafting battery storage, light pollution and data center rules; its October 20, 2026 agenda includes a public hearing on a new Section 900.5 on light pollution.

Meetings: the Planning Commission meets at 7:00 p.m.; its 2026 meetings have fallen on the third Tuesday of the month, and its recommendations go to the County Board for a final vote.

Nebraska building code

Nebraska's state building code applies by default where a city, village or county has adopted none; local codes must conform generally, and the energy code is mandatory statewide. Nebraska rules
