The state capital runs the most distinctive occupancy regime in Minnesota. Finishing construction produces one certificate; keeping the building in use requires a second, renewed on inspection for as long as the building stands. Almost every building in the city is caught by it.

The Department of Safety and Inspections handles building, trade and fire approvals from Jackson Street, with applications through the city’s permitting system and a project facilitator available as a single point of contact on larger projects.

What requires a building permit in Saint Paul?

Minnesota runs one building code and only one. The Minnesota State Building Code is the standard that applies statewide to the construction, reconstruction, alteration, repair and use of buildings, and it supersedes the building code of any municipality. A city administers and enforces it; it does not get to rewrite it. That makes Saint Paul far more predictable than a jurisdiction in a local-option state — the edition, the exemptions and the technical provisions are the same ones in force across Minnesota.

What is actually local, and what is not

Local government decides fees, submittal formats, counter hours, inspection scheduling, zoning and land use — and nothing about the technical code. A municipality must not require building code provisions different from the state code, whether by ordinance or through a development agreement. The single exception is an ordinance that is more restrictive, justified by geological conditions, and approved by the state building official. Separately, agricultural buildings sit outside the code almost entirely, and a city that requires exterior work to be finished within a set period cannot demand completion earlier than a hundred and eighty days after the permit issues. Saint Paul is also one of the few Minnesota cities to license contractors itself: the city licenses residential building contractors in addition to the state requirement, covering anyone performing general building or remodeling on a structure with fewer than four dwelling units, including detached garages — a municipal credential sitting on top of the state licence rather than in place of it

Rental property has its own route into the system. One and two unit rental dwellings registered as rentals receive a provisional fire certificate of occupancy, a document that temporarily permits continued occupancy pending inspection of the existing structure. The city publishes a pre-inspection checklist and recommends owners work through it before the scheduled inspection date rather than after.

Some technical requirements are set out with unusual precision. On stucco work the city points to the requirement for two layers of grade D building paper over wood-based sheathing and states plainly that tar or felt paper is not acceptable for that application, with a lath inspection required after all lath is installed but before any cement or plaster goes on.

Residential permits

Residential work on structures with fewer than four dwelling units requires the city contractor licence in addition to the state one, and detached garages count. Owner-occupied single family houses and duplexes are the only buildings exempt from the ongoing fire certificate requirement.

How Minnesota contractor licensing works

Minnesota licenses the trades centrally, which removes the city-by-city credential problem entirely. The Department of Labor and Industry licenses residential building contractors and remodelers, residential roofers, electricians and plumbers, and those licences are valid across the state. The licence is issued to the business entity, with a named qualifying person who must pass a written examination and be an owner, officer, member, partner, chief manager or actively engaged managing employee.

A pooled fund instead of a bond. Rather than requiring each contractor to post a surety bond, Minnesota operates the Contractor Recovery Fund, which every licensee pays into and from which homeowners may be compensated. An unpaid judgment against the fund bars further licensure until it is reimbursed. Note also that a contractor providing services in more than one special skill area must be licensed, while a specialty contractor providing only one special skill generally need not be — except residential roofers, who must be licensed regardless.

Commercial permits

Commercial projects run through the building certificate first and then into the fire certificate cycle, with renewal frequency set by use type. Commercial and multi-family swimming pools additionally require approval from the state health department, and barbed wire fencing is tightly restricted, requiring an application to the building official and a certificate of insurance indemnifying the city.

Mechanical work, and where the state reviews plumbing directly

Mechanical and heating contractors are the exception to statewide licensing: there is no state mechanical contractor licence, but a contractor must file a twenty-five thousand dollar bond with the department to contract for gas, heating, ventilation, cooling, air conditioning, fuel burning or refrigeration work. On the plumbing side the state reviews plans directly for public and commercial buildings and for residential buildings of five or more units, unless the municipality holds a plan review agreement with the department — around seventy cities do.

How to apply for a Saint Paul building permit

2. Check whether the fire certificate applies

All buildings except owner-occupied single family houses and owner-occupied duplexes must have and maintain one.

3. Get the city contractor licence as well

Where a municipality holds a plan review agreement and its inspectors are licensed master or journeyworker plumbers, the municipality inspects instead.
