Winthrop’s Building Department / Inspectional Services, at 100 Kennedy Drive (617-846-4344), issues building, electrical, plumbing and gas permits, and applications are filed through the Town’s OpenGov permit portal. Under the 2022 fee schedule, a residential permit costs a $40 filing fee plus $16 for every $1,000 of construction value. About 45% of this coastal town lies in the 1% annual chance floodplain, so many projects also need Conservation Commission review and the Town’s flood resilience checklist.

What requires a building permit in Winthrop?

Winthrop is a coastal Suffolk County town of about 18,600 people. The department’s rule is broad: anyone who builds, alters or demolishes a structure, or puts up a sign, needs a building permit before work starts, and the permit must be posted prominently at the job site. The department’s submittal list and fee schedule name the common jobs:

Building permit

  • New one- and two-family homes
  • Additions and decks
  • Roofing, siding and interior rehabilitation
  • Attached and detached garages and sheds
  • Demolition
  • Signs
  • Condominium conversions
  • Mechanical and sheet metal work

Separate trade permits

  • Electrical work, by a Massachusetts licensed electrician
  • Plumbing and gas fitting, by licensed plumbers and gas fitters
  • Domestic hot water heaters ($30 permit)

The work must also comply with the Winthrop Zoning Ordinance, and the state access regulations apply to new construction, alterations and changes of use. The Town’s noise rules do not allow construction work before 7 am or after 7 pm.

What Winthrop decides and what the state holds

The building code, 780 CMR, is the state’s, written by the Board of Building Regulations and Standards, and Winthrop has no power to amend it. Winthrop is governed by a Town Council, its zoning rules are set out in the Winthrop Zoning Ordinance, and the Town sets its own permit fees and runs its own flood resilience review. The department’s pages do not say whether Winthrop adopted the Stretch or Specialized energy code, and the Town’s code of ordinances (hosted on Municode) could not be read for this guide, so ask the department which energy code applies before you design.

Winthrop building department: who handles permitting

The Building Department / Inspectional Services issues the building permit and the electrical, plumbing and gas permits, and its staff also include a chief of code enforcement and a health inspector. Albert Legee is the Commissioner of Inspectional Services. Inspections are carried out on request.

Town Hall, at 1 Metcalf Square (617-846-1852), houses the Town Clerk, which receives Board of Appeals filings, and the Board of Appeals office in Room 2A (ext. 1013). Town Hall is open Monday and Wednesday 8 am–4:30 pm and Tuesday and Thursday 8 am–7 pm.

Note that the contact box on the department’s web page shows Town Hall’s general address and number, while the Town’s staff directory places Inspectional Services at 100 Kennedy Drive, the Public Facilities Building, with its own line, 617-846-4344, and its own hours. The Conservation Commission also takes Notice of Intent filings at 100 Kennedy Drive.

Winthrop permit types and the approvals that come first

Applications go through Winthrop’s OpenGov portal, linked from the department’s page as “Online Permits Here”. Before any building permit issues, the department requires a debris removal form and sign-offs from the Board of Health and the Tax Department.

Residential permits

The department’s submittal list sets the paperwork by job:

  • Roofing, siding and interior rehabilitation: the application, the workers’ compensation affidavit and insurance certificates, copies of the contractor’s HIC and/or CSL cards, a floor plan of the work, and engineering affidavits for engineered products.
  • Additions and decks: all of the above, plus a certified surveyed plot plan, two sets of plans, an energy compliance report where applicable, and contact with Fire Prevention.
  • New one- and two-family homes: the same, with three sets of plans.

Permits go to state-licensed construction supervisors or to homeowners working on a one- or two-unit home where they live or plan to live, using the homeowner license exemption form. The department warns that an owner who pulls the permit may be liable for contractors on the property and loses the protection of the state home improvement contractor law.

Commercial permits

Commercial building, electrical, plumbing, gas and mechanical permits each cost $16 per $1,000 of construction value or fraction, with a $50 filing fee. Bed-and-breakfast and short-term lodging applications to the Board of Appeals need a signed inspection report from the Building Commissioner.

What comes before the building permit

  • Conservation Commission: wetland resource areas and their 100-foot buffer zones, areas of critical environmental concern, rare wildlife habitat and the AE and VE flood zones are all under the Wetlands Protection Act, and the Commission posts a list of every property in its jurisdiction. It meets the first Wednesday of each month by Zoom, with applications due by 10 am about three weeks earlier.
  • Board of Appeals: variances and special permits start with a denial letter from the Building Commissioner. Since January 1, 2025 only complete applications are accepted.
  • Board of Health: its sign-off is required on every building permit.
  • Fire Prevention: contact for additions, decks and new homes.

Filing with the Conservation Commission

The Commission’s own process sheet sets out a Notice of Intent filing in Winthrop. The applicant sends a copy to MassDEP’s Northeast Regional Office in Woburn and the original plus seven copies to the Commission at 100 Kennedy Drive, splitting the state filing fee between MassDEP and the Town by the formula in the state instructions. The Assessor’s Office compiles the list of abutters within 100 feet, and the applicant notifies them by certified mail. The Conservation Agent drafts the legal notice for the Winthrop Sun Transcript, which wants a deposit before it publishes. New structures, erosion controls and stormwater features must be staked with labeled stakes or flags two weeks before the hearing, the Commission or its agent visits the site, and the applicant or a representative must attend the meeting. Projects inside mapped rare-species habitat must also send a copy of the filing to the state Natural Heritage program no later than the day it is filed.

Smaller jobs may qualify for a Request for Determination of Applicability or an Abbreviated Notice of Intent, and the Commission posts separate submittal requirements and an emergency application for each. The Town also posts MassDEP handouts dated February 26, 2024 on the Wetlands Protection Act rules for land subject to coastal storm flowage, including a comparison of performance standards and a flow path analysis.

Winthrop permit fees

The 2022 Building Permit Fees sheet is the current schedule on the department’s page. Construction value means fair market value of materials and labor, and the sheet bases the estimated cost of construction on set values per square foot.

Winthrop permit fees (2022 schedule)

Filing fee, every residential permit (building, electrical, plumbing, gas, mechanical, sheet metal)$40
Residential permit$16 per $1,000 of construction value
Commercial filing fee$50

Domestic hot water permit$30

Construction value used for fees
WorkValue per square foot
New construction / attached garage$200
Remodeling / detached garage$150
Deck with a roof / deck without a roof$150 / $100
Shed$50

Example: a 200-square-foot open deck is valued at 200 × $100 = $20,000, so the building permit costs $40 + 20 × $16 = $360. An older “Fees by Department” list still on the page shows $12 per $1,000; the 2022 sheet is the newer schedule.

Trade permits and who may pull them

Winthrop issues electrical, plumbing and gas fitting permits only to Massachusetts licensed electricians, plumbers and gas fitters, so a homeowner cannot take out a trade permit even on their own house. Residential trade permits are charged the same way as building permits: the $40 filing fee plus $16 per $1,000 of value; commercial trade permits are $16 per $1,000 with a $50 filing fee. A domestic hot water permit is a flat $30.

For building work, the department asks for copies of the contractor’s Construction Supervisor License and/or Home Improvement Contractor registration with the application, plus proof of workers’ compensation coverage. The 2022 sheet groups mechanical and sheet metal permits with the others under the same filing fee.

How to apply for a Winthrop building permit

4. File in OpenGov

Submit the application online with every attachment.

Review, corrections and what causes delay

Under 780 CMR 105.3.1, the building official must act within 30 days of filing. The outside steps add time: Conservation hearings run monthly, and the Board of Appeals takes only complete applications and may cap the number heard at each meeting. New material asked for at a continued ZBA hearing must reach the clerk 7 days before the next date. An unrecorded variance or a missing Board of Health or Tax Department sign-off will also hold a permit back.

Inspections in Winthrop

Inspections are made on request; call the department at 617-846-4344 when work is ready. Work must start within six months of the permit date and then continue steadily to completion. A failed inspection or code violation costs $50 to re-inspect. For decks and stairs, the department’s FAQ gives the guard heights it applies: a 36-inch guard on a one- or two-family deck more than 30 inches above grade, at least 34 inches where the guard also serves as the handrail on open-sided steps, and 42 inches for other building types.

A certificate of occupancy is issued for new and converted units, at $200 per apartment or condominium conversion. The department also performs certificate-of-inspection visits for buildings that need them ($200 residential; $150 commercial plus $50 per unit) and real estate walk-throughs for $75.

Building code and flood rules in Winthrop

Winthrop enforces 780 CMR, 10th edition. Flood rules matter here: the Town’s flood resilience addendum puts about 45% of Winthrop’s land in the 1% annual chance floodplain, and the department posts flood maps dated March 16, 2016 covering Main Street, River Road, the Highlands, the Beach, Point Shirley, Court Road and the Center. The Town’s flood resilience checklist (last updated April 1, 2021) should be submitted with permit applications for residential new construction, substantial improvements and utility upgrades; it asks for the flood zone, base flood elevation and expected sea-level-rise flood depth at the property. FEMA lists Winthrop as a participating community in the National Flood Insurance Program, with flood maps effective July 3, 2024, newer than the 2016 maps on the department page.

Massachusetts has one State Building Code, 780 CMR, for every city and town; towns cannot rewrite it, though many opt into a stricter energy code. The trades run under their own state codes. Massachusetts rules
