Banks County’s Building Department, part of Planning & Zoning at the County Annex, 150 Hudson Ridge, Suite 4, Homer (706-677-4272), says all construction in Banks County requires permitting, including every shed or barn regardless of size. Residential permit packets are filed with the Planning Office, building permits are valid for 180 days, and the office accepts only cash or check.

What requires a permit in Banks County?

The County states that all construction requires a permit, and its packets spell out where the line falls for smaller jobs:

The County will not permit a remodel, renovation or addition to a mobile home, because mobile homes are built to the federal HUD code and altering one would invalidate its certification.

The Building Department checks new construction, additions and alterations against the Georgia State Minimum Codes the County has adopted, and the building official issues certificates of occupancy. The County’s Code Enforcement office serves the unincorporated areas. The County lists six incorporated places: the Cities of Baldwin, Lula and Maysville and the Towns of Alto, Gillsville and Homer.

Electrical, plumbing and mechanical permits

On a new home, the Residential Building Permit Application covers the electrical, plumbing and mechanical permits, with the contractor for each trade listed on it. On a renovation or addition, each trade change is permitted as part of the job; work on an existing electrical, plumbing or mechanical service alone needs its own stand-alone application.

A homeowner can act as general contractor or do their own electrical, plumbing or mechanical work with a signed, notarised affidavit, committing to live in the home for at least two years; any work the homeowner does not do must be done by a licensed contractor. If you will not live in the home, a licensed contractor is required.

On commercial jobs, fire suppression plans are part of the digital plan submittal.

A renovation needs the application, proof of ownership or the owner’s approval, a septic re-evaluation if applicable (Environmental Health is the contact when bedrooms or bathrooms are added), and sketches of the current and new floor plans. A new manufactured home needs the purchase agreement and dealer statement; a pre-owned home must first pass the relocation inspection. House plans may be emailed as a PDF or brought as an 8.5 by 11 inch copy.

How to apply: 6-step Banks County process

1. Perc test and septic permit

Get a soil evaluation (perc test) and apply to Banks County Environmental Health for the septic permit.

2. Prepare the site

Establish and flag the driveway entrance, install a permit (construction) box and put erosion controls such as silt fences in place.

3. Draw the site plan

Get a copy of the plat (a new survey if other homes share the tract) and draw the house, septic tank, well, easements, driveway and existing buildings on it.

4. Submit the packet

File the application, plat, house plan and septic permit with the Planning Office or by email.

5. Address and payment

During review the County requests your 911 address, then contacts you to pay (cash or check) and issues the permits.

6. Build and book inspections

Call before 4:00 p.m. for each next-day inspection; the certificate of occupancy follows the final inspection.

Banks County inspections

Call the office (706-677-4272) before 4:00 p.m. for a next-day inspection; time slots are not guaranteed. A $75 reinspection fee may be charged if you fail the same inspection twice, are not ready, or the inspector cannot get onto the site. Have a portable toilet on site before the first inspection.

Pools need inspections for plumbing pressure and electrical bonding on in-ground pools, and a final covering the pool, fence and locking gate. No new home, mobile home or commercial building may be occupied until the building official issues a certificate of occupancy, which takes about 24 to 48 hours after the final inspection and is never issued the same day. A new business moving into an existing commercial building needs a safety and occupancy inspection before it opens. The building official may exempt bona fide agricultural buildings from inspection, but not from any required zoning inspection.

Local Banks County rules that affect building

Lots and setbacks: only one residence (house or manufactured home) is allowed per parcel. In the ARR zone, lots must be at least 2 acres unless the Planning Office approves otherwise, stick-built homes at least 1,000 sq ft, and buildings at least 70 feet from the centre of the road and 30 feet from side and rear lines. In R-1, homes must be at least 2,000 sq ft with at least 1,500 sq ft on the main floor.

Other site rules: no land disturbance within 25 feet of a natural body of water; no addition, driveway, garage, deck or outbuilding over the septic tank, drain field or replacement area; RV camping is limited to 90 days and RVs get no power pole; accessory buildings cannot be used as homes; a metal building used as a house shell needs approval for residential use and an engineer-stamped plan set; sawmilled lumber needs a grade mark or grading-agency certificate.

Driveways: the pipe must meet GA DOT standard 1030D, at least 20 feet long and 18 inches in diameter with 1 foot of cover, with flared end sections and no headwalls. Driveways are 10 to 25 feet wide, and a construction entrance needs at least 4 inches of stone.

Addresses: the County does not issue addresses for vacant lots; the 911 address is requested during permit review. Post it within 30 days in reflective numbers at least 3 inches high on both sides of the mailbox, or on a roadside sign.
