The City of New Britain's Department of Licenses, Permits and Inspections, in Room 404 of City Hall at 27 West Main Street, issues building, electrical, plumbing, mechanical and sprinkler permits for the Hardware City, a compact industrial city of around seventy-six thousand people nine miles south-west of the capital. What requires a building permit in New Britain?

Connecticut has one building code and no town may amend it. The State Building Inspector and the Codes and Standards Committee adopt the Connecticut State Building Code jointly under section 29-252 of the General Statutes, with the approval of the Commissioner of Administrative Services, and section 29-253 makes it the building code of every town, city and borough in the state. The edition in force is the twenty twenty-two Connecticut State Building Code, which has governed every permit applied for since the first of October twenty twenty-two and is built on the twenty twenty-one international building, residential, existing building, mechanical, plumbing, energy and swimming pool codes with Connecticut amendments, together with the twenty twenty National Electrical Code. A twenty twenty-six edition built on the twenty twenty-four model codes was drafted to take effect in July twenty twenty-six, but the legislature's Regulation Review Committee declined to approve it that April and its effective date is delayed; the twenty twenty-two code governs until a new one is approved, and when the change comes it will turn on the date of the permit application. So New Britain neither adopts nor amends the code — it enforces it through a building official licensed by the state — and the practical questions are the local process, the zoning and wetlands approvals that come before a building permit, and the zoning application that goes in before the building permit.

The code itself draws the permit line, and it draws it in the same place in every town. Section 29-263 requires a permit before any building or structure is constructed or altered, and the code's own exemptions — ordinary repairs, small detached accessory structures, fences and retaining walls below its stated sizes, finish work and the like — are the state's exemptions rather than a local list. A town cannot add exemptions or take them away. What it can do is set its own fees, run its own portal, and sequence its own zoning, wetlands and health sign-offs ahead of the building permit.

What the town decides and what the state holds

Every town appoints a building official under section 29-260, and that official must hold a licence from the State Building Inspector under section 29-262, kept current through state-run continuing education funded by the education fee charged on every permit. The town sets the fee schedule, chooses the portal, decides how plans are submitted and runs its own Board of Appeals under section 29-266 for disputes with the building official, whose decisions go on to the Codes and Standards Committee. What the town does not hold is the code: variations from it are granted by the State Building Inspector on an application routed through the local official, historic buildings can be exempted only under section 29-259, and state-owned buildings are permitted by the state itself under section 29-252a. There is no county layer either — Connecticut abolished county government in nineteen sixty, so nothing sits between the town and the state. Beyond that, the zoning application that precedes the building permit, the demolition code the same department administers, and the factory conversions along the busway that raise change-of-use questions.
