Independence County, Arkansas Building Permit Guide

Independence County has no county building permit for land outside its towns; Batesville, Southside and Cave City issue their own building permits, and the county’s role on rural lots is its road system, 911 Coordinator and emergency management.

Outside its towns, Independence County issues no building permit and publishes no building code or inspection program of its own. For a rural build, the county’s offices are the County Judge, who runs the road system (870-793-8800), and the 911 Coordinator (870-805-0340). Inside Batesville, the Code Enforcement department permits building and trade work; Southside issues a Certificate of Zoning Compliance and Permit to Build, and Cave City issues building permits under its zoning code.

Who issues permits in Independence County?

The County Judge runs the county roads and carries out the ordinances the Quorum Court passes; the office is in the County Courthouse at 192 E. Main Street, Batesville. The county’s department list has no planning, zoning or building office. Populations below are Census Bureau Vintage 2025 estimates.

Roads, addresses and flood maps in Independence County

  • County road right-of-way: the right-of-way on county roads runs 25 ft from the centerline, and the Road and Bridge Department asks that no trees, shrubs or other plantings go inside it. The department builds and resurfaces county roads and cleans culverts and ditches; its office is on 870-793-8862.
  • Driveways in Southside: Southside sends driveway questions to Independence County, and driveways or culverts on a state highway inside the city to the Arkansas Department of Transportation District 5 office (870-251-2374).
  • Addresses: the county’s 911 Coordinator is on 870-805-0340; ask that office about the address for a new building. The Office of Emergency Management is on 870-307-8917.
  • Flood maps: FEMA lists Independence County as a National Flood Insurance Program participant, with a current map dated March 15, 2012. The county’s website names no floodplain administrator; the County Judge’s office runs county administration. Batesville, Cave City, Moorefield, Newark, Oil Trough and Sulphur Rock also take part, and Batesville requires a Floodplain Development Permit for development in its flood hazard areas. Cushman, Magness and Pleasant Plains are listed as not participating, and Southside is not listed.
  • Septic: where there is no sewer, the onsite wastewater permit comes from the Arkansas Department of Health through its local Environmental Specialist.

Southside’s rules: the City’s Zoning Code, revised May 18, 2026, makes the Mayor or the Mayor’s designee its Code Enforcement Official and records zoning compliance on every permit the City issues. The permit form commits the applicant to the Arkansas Energy Code and the 2021 Arkansas Fire Prevention Code, and a building may not be occupied until it meets City and State codes. Violating the zoning code is a misdemeanor: after the deadline in a notice of violation, a conviction brings a fine of up to $250 plus the costs of the case, and each further day counts as a separate offense.

Newark fences: under Ordinance 2025-06, anyone erecting, replacing or significantly altering a fence in Newark needs a fence permit from the City’s Zoning Department, with a plan showing height, material and location. Fences are limited to 6 ft unless the zoning commission approves more, and fines run $200, $300 and $500 for first, second and third offences.

Steps for building in Independence County

1. Find the jurisdiction

Check whether the lot is inside Batesville, Southside or another town; a Batesville mailing address does not mean the lot is in the city.

2. City lots

In Batesville, apply to Code Enforcement; in Southside, file the Certificate of Zoning Compliance and Permit to Build with City Hall.

3. Rural lots

No county building permit is needed; ask the county’s 911 Coordinator about the address before you build.

4. Driveway and road

Keep trees and other plantings out of the 25 ft county right-of-way, and call the Road Department about work at a county road.

5. Septic

Without sewer, apply to the Arkansas Department of Health for the onsite wastewater permit.
