Apply on paper at 200 Municipal Plaza or through the City’s online form; residential jobs from $2,001 to $1 million fall in the $5-per-$1,000 band of the fee schedule, and a permit lapses if work does not start within 60 days.

What requires a building permit in Weirton?

City code bars construction, enlargement, alteration, repair, remodeling or moving of a building, part of a building or any equipment until the Inspections Department has issued a permit. The City’s own list of common projects that need one:

Building and alterations

  • New buildings and additions
  • Decks, porches, patios and garages
  • Fences, walls and retaining walls
  • Fireplaces
  • Re-roofing and window replacement
  • Garage conversions, finished basements and kitchen expansions
  • Kitchen and bathroom remodels

Systems and equipment

  • Electrical systems, including new outlets
  • Plumbing systems and water heaters
  • Heating, ventilating and air conditioning
  • Swimming pools, spas and hot tubs
  • Demolition, on its own application
  • Signs, on the sign application

Under the Unified Development Ordinance, every fence and wall needs a permit before it goes up. If the scope changes after a permit is issued, amended plans and a supplementary permit are needed, except for changes costing $50 or less.

Who issues building permits in Weirton?

The City’s Department of Building Inspections & Code Enforcement reviews plans, issues building, zoning and demolition permits and inspects work in every part of Weirton, including the neighborhoods in Brooke County. It enforces the State Building Code, the City’s property maintenance code and the Unified Development Ordinance. Nick Stewart is the Code Official and department head; the department sits under the Planning and Development Director.

Weirton applications and online filing

Applications go to the Inspections Department at 200 Municipal Plaza on paper, or through the City’s online forms, which the City describes as a beta test. After an online submission, staff contact the applicant within 24 business hours about the application and the permit fee.

  • Zoning and Building Permit Application: the main form for new buildings, additions, remodels, repairs, foundations, roofs, grading and fill, fences, decks, garages, sheds, pools and signs, with a site plan page for setbacks.
  • Replace Existing Building Permit Application: a shorter form for like-for-like replacements, revised in November 2025, with statements on asbestos, power company meter locations, pool barriers and calling 811 before digging.
  • Demolition Application: names the landfill and confirms asbestos inspections; if nothing will be rebuilt, utilities are shut off and re-connecting later costs $350 per city utility.
  • Permit Extension Application: for more time on an issued permit, filed before the permit expires.
  • Sign, variance, conditional use, subdivision and rezoning applications for planning approvals.

Contractors list their West Virginia licence number and their City of Weirton licence number on the application, with every subcontractor on a separate page.

Building permit fees in Weirton

Section 1705.02 of the codified ordinances sets building permit fees from the estimated cost of labor and materials. The application form asks applicants to call the Inspections Office for the fee, and staff contact online applicants about it within 24 business hours.

Weirton building permit fees (Codified Ordinances 1705.02)
Estimated costResidentialCommercial and industrial
$0–$1,000No fee$5
$1,001–$2,000$10$10
$2,001–$1,000,000$5 per $1,000 or fraction$5 per $1,000 or fraction
$1,000,001–$5,000,000$2.50 per $1,000 or fraction$4 per $1,000 or fraction
Over $5,000,000$2.50 per $1,000 or fraction$3 per $1,000 or fraction

When no estimate is given, or the estimate is in doubt, the department values the work at $55 per square foot for living space, $25 for garages, porches, decks and accessory buildings, and $20 for unfinished basements, and the fee is then worked out from that value. Starting work before the permit is issued leaves the owner and contractor liable to fines of $50 to $500.

Electrical, plumbing and HVAC permits

Electrical and plumbing work regulated by the building code needs its own permit from the City before it starts, and plans may be required. The code prices electrical permits by the number of outlets, fixtures, services and motors, and plumbing permits at $2 per fixture or water-discharging device, with a $3 minimum. Simple faucet and valve repairs, clearing stoppages and fixing leaks need no plumbing permit if the piping is not changed. HVAC systems are on the City’s list of permit work, and the main application form has boxes for electrical, mechanical and plumbing jobs.

What to submit

  • Completed Zoning and Building Permit Application, or the Replace Existing form for like-for-like work
  • Street address, tax map and parcel number
  • Owner and general contractor details with state and city licence numbers, and a list of subcontractors
  • Total project cost

  • A site plan sketch with the size and height of the new work and setbacks to every property line; for a garage, the driveway width as well

The department routes applications to Public Works, the Sanitary Board, the Water Department and the Fire Department as needed, and the Building Plans Examiner must approve the plans before a structural permit is issued.

Inspections in Weirton

The permit holder must contact the City to arrange the required inspections; the department’s inspectors check work against the State Building Code and city ordinances. A permit lapses if work does not start within 60 days or stops for 90 consecutive days, and it is otherwise valid for one year. A lapsed permit must be reissued with full fees, and any time limit can be extended for good cause if the extension is asked for before it runs out.

Fences: in residential districts a fence in the front yard may be up to 4 feet high and elsewhere up to 8 feet, and no fence may sit closer than 3 feet to a neighboring house.

Rentals and businesses: the department also runs the City’s rental registration and business license programs.
