Harrison County Building Permit — Filed & Tracked For You

Harrison County's planning commission sits at Clarksburg while the county's development pressure sits at Bridgeport — and as everywhere in West Virginia, whether a building code applies at all depends on which authority holds the parcel.

Harrison County's Planning Commission works from 301 West Main Street in Clarksburg, the county seat, in north-central West Virginia. The county's growth and commercial development have concentrated at Bridgeport rather than Clarksburg — the airport, the federal facilities and the newer commercial and residential development are there — so the county's economic centre and its administrative one are different places.

The planning commission handles land use; whether a building code applies to a given parcel is a separate question. Adoption of the State Building Code is optional for both counties and municipalities in West Virginia, so a project should confirm the position with the authority holding the site before assuming a permit process exists. Where none has been adopted, floodplain, sewage and fire requirements may still apply through their own authorities.

This guide covers Harrison County. Clarksburg, Bridgeport, Shinnston and Salem run their own arrangements and should be confirmed individually.

Planning and building are different questions. A county planning commission handles land use. Whether a building code applies is separate, and in West Virginia it turns on whether the authority holding the parcel has adopted the State Building Code by ordinance. A planning answer does not tell you whether a building permit is required.

What requires a building permit in Harrison County?

West Virginia offers its local governments one building code or none. The State Fire Commission adopts the West Virginia State Building Code at 87 CSR 4, incorporating the international building, residential, existing building, mechanical, plumbing, fuel gas, energy, swimming pool, property maintenance and related codes. A county or municipality may adopt it by ordinance — and if it does, it must notify the State Fire Marshal, employ or contract certified building code officials, inspectors and plans examiners, and take on enforcement itself under West Virginia Code 7-1-3n and 8-12-13. What it may not do is adopt something else: no other code provisions pertaining to building construction, repair or maintenance may be enforced in West Virginia. So Harrison County either enforces the state code or has no general building code at all, and the practical questions are which it is, what discretionary provisions and appendices it has completed, and the county's land use process and the adoption position.

Where Harrison County has adopted the code, the adopted code draws the exemption line and the local jurisdiction completes the discretionary provisions. Ordinary repairs generally need no permit; construction, alteration, repair, demolition and any change of occupancy generally do. The appendices are not part of the code and are enforceable only where the local jurisdiction has separately adopted them, so an appendix requirement assumed from the model book may not apply here at all.

Typically permit required

  • Where a jurisdiction has adopted: construction, alteration, repair, demolition and change of occupancy
  • Land use and subdivision approval through the county planning commission
  • Floodplain permitting and on-site sewage approval through their own authorities
  • New buildings, additions and structural work on an existing building, where the code has been adopted
  • Alterations, repairs and renovations, and any change of occupancy
  • Decks, accessory structures above the adopted threshold, retaining walls and swimming pools

Often exempt

  • Buildings used for agricultural purposes, under the rule's own exemption
  • Appendices the adopting jurisdiction has not separately adopted
  • Ordinary repairs that do not alter structure, egress or systems
  • Buildings used for agricultural purposes, exempted under the rule's own provision
  • Appendices the local jurisdiction has not adopted, which are not enforceable

Adoption, certification and what the state still holds

Adoption is a deliberate act with obligations attached. A jurisdiction adopting the State Building Code notifies the State Fire Marshal, completes the discretionary provisions and appendices it wants by order or ordinance, and staffs enforcement with officials certified under the Fire Commission's own standards for building code officials, inspectors and plans examiners. Counties and municipalities may share that capacity by agreement with one another. Where a local ordinance is more stringent than the State Building Code it governs, and the State Fire Commission determines the relative priority in any question. Beyond that, the split between the county seat and the county's development centre, and the adoption question.

Who handles permitting in Harrison County?

The Harrison County Planning Commission handles land use and subdivision for the county, while the building code position depends on adoption by the authority holding the parcel. Clarksburg, Bridgeport and the other municipalities run their own arrangements, the State Fire Marshal certifies code officials and retains fire jurisdiction, and the Division of Labor licenses contractors.

Permit types

Residential permits

A Harrison County house project clears the county's land use requirements, and separately establishes whether the authority holding the parcel enforces the State Building Code. Inside Bridgeport or Clarksburg the municipal position applies; in unincorporated territory confirm with the county. On-site sewage approval applies through the health department where the parcel is unserved.

How West Virginia contractor licensing works

West Virginia licenses contractors at state level through the Division of Labor under the Contractor Licensing Act, in classifications covering general building, general engineering, residential, electrical, plumbing, heating and air conditioning and specialty trades. A licence is required above the statutory value threshold and is valid throughout the state. Electricians and plumbers hold their own state credentials as well. Harrison County may require local registration on top of the state licence, and a jurisdiction enforcing the building code will check the state licence at permit issue.

Commercial permits

Commercial work in Harrison County concentrates around Bridgeport — the airport, the federal and aerospace facilities and the commercial corridors serving them — and is permitted by the municipality holding the site, with the State Fire Marshal reviewing fire and life safety regardless of building code adoption.

Establishing whether the code applies at all

The first question on a West Virginia project is whether the jurisdiction has adopted the State Building Code. Adoption is optional, a minority of the state's counties have done it, and many smaller municipalities have not — so a rural parcel may carry no general building permit requirement whatever. That does not mean nothing applies: floodplain regulation, on-site sewage permitting through the health department, electrical requirements and the State Fire Marshal's own jurisdiction can all reach a site where no building code does. The position is confirmed with the county or municipality rather than assumed. In Harrison County the West Fork River corridor brings floodplain review into the file, the north-central hill terrain constrains access and foundations on rural parcels, and development pressure is concentrated around Bridgeport rather than spread across the county.

Harrison County permit costs and fees

Fees follow the schedule of whichever authority holds and permits the site, with land use charged by the planning commission.

⚠️

Ask two questions, not one. Applicants in West Virginia frequently ask a county whether they need a permit and take a single answer away. Ask the land use question and the building code question separately — a county may administer subdivision and zoning while enforcing no building code at all, and the two answers are given by different processes.

Trade permits and who may pull them

Trade work is permitted separately where the jurisdiction enforces the code, and carried out by contractors holding the state licence their classification requires.

Permit required

  • Any parcel — establish both the land use requirement and the building code adoption position
  • Electrical — separate permit where the code is enforced, by a state-licensed electrical contractor
  • Plumbing — separate permit, by a state-licensed plumbing contractor
  • Mechanical — separate permit under the adopted mechanical and fuel gas codes
  • Fire protection — under the State Fire Code and the State Fire Marshal's jurisdiction

Typically exempt

  • Work below the statutory value threshold for contractor licensing
  • Like-for-like replacement the adopted code places below the permit threshold

How to apply for a Harrison County building permit

1. Establish whether the code has been adopted

Adoption is optional; confirm with the county or municipality rather than assuming.

2. Check which appendices and discretionary provisions apply

Appendices are not part of the code unless the jurisdiction has separately adopted them.

3. Settle floodplain, sewage and access

These can apply where no building code does, through other authorities entirely.

4. Confirm the contractor's state licence

Division of Labor licensing above the statutory threshold, valid statewide.

5. File the application with construction documents

Reviewed against the State Building Code as adopted and completed locally.

6. Call inspections in sequence and close out

Footing to final, with the trades on their own permits, then the certificate of occupancy.

Review, corrections and what actually causes delay

Harrison County reviews land use through the planning commission; building review depends on adoption by the holding authority. What delays a project here is conflating the two questions.

Inspections in Harrison County

Where the code is enforced, inspections follow its sequence — footing, foundation, framing, rough trades, insulation and final — requested from the local building official by permit number, with the trades inspected on their own permits. Work that passes final receives a certificate of occupancy for new buildings and changes of occupancy. Where a code is enforced, inspections follow its sequence through the adopting authority's certified officials; sewage and floodplain inspections apply through their own authorities regardless.
