Windham County, Vermont Building Permit Guide

To get a building permit in Windham County, confirm which office issues permits for the property’s address, then submit the application with your plans and required documents, pay the permit fees, and pass inspections before final approval. Alliance Permitting can prepare, file and track the permit for you and schedule the inspections.

Windham County has no permit office of its own: 15 of its 23 towns issue zoning permits, seven have no zoning bylaw, and Somerset has no town government.

Windham County permits come from the town: Brattleboro’s Planning Services Department (802-251-8154), Rockingham’s zoning office for Bellows Falls and Saxtons River, and a zoning administrator in most other towns. No Windham County town issues a local building permit for a house; rentals, shops and other public buildings get their construction permit from the Division of Fire Safety’s Springfield Regional Office (802-216-0500). A new house in Brattleboro pays $80 plus $0.40 per square foot.

What needs a permit in Windham County?

In the zoning towns, almost any new structure, addition, change of use or subdivision needs a zoning permit, and the triggers are set town by town:

  • Stratton: any construction footprint over 100 square feet, including turning a garage or porch into living space.
  • Brattleboro: new construction that changes use or adds floor area; in the mapped flood hazard area any improvement to an existing building, interior work included; signs and banners; and exterior work in a historic district may need design review.
  • Dummerston: all land development, while ordinary repairs that change neither the exterior nor the use are exempt; farm buildings need written notice and a site plan.
  • Grafton: no zoning permit, but owners are asked to file a Building Notification Form before any construction costing more than $500, and building in the flood hazard area must follow the town’s flood rules.

State permits

  • Construction permit for a public building, including rental housing and short-term rentals
  • Wastewater and potable water supply permit for a new septic system, well or extra bedrooms
  • Act 250 land use permit above the district thresholds
  • RBES certificate for new homes and for additions, alterations and repairs to homes of three stories or less

Local exemptions and reductions

  • Brattleboro accessory buildings under 300 sq ft carry no improvement fee
  • Stratton structures of 100 sq ft or less (setbacks still apply)
  • Dummerston repairs with no exterior change or change of use

Windham County building department: who handles permitting

There is no county government to apply to. The towns issue zoning permits through a zoning administrator, with a Development Review Board or Zoning Board of Adjustment for hearings; the incorporated villages of Bellows Falls, Saxtons River, Newfane, Westminster and Jacksonville sit inside their towns. Rockingham’s office describes itself as permitting all development in the town and administers districts for both the town and Bellows Falls.

The seven towns without zoning are Athens, Brookline, Grafton, Guilford, Jamaica, Townshend and Vernon, as the Windham Regional Commission’s town profiles also record. Somerset is unorganized; a supervisor appointed by the Governor acts as its selectboard for planning and bylaws. Jamaica’s Zoning Board of Adjustment page shows the administrative officer post as vacant and gives a Thursday line for flood permits (802-874-4908).

The DEC application fee for a design flow of up to 560 gallons a day is $306.25 from July 1, 2026. Act 250 reaches small sites in much of Windham County: 16 of its 23 towns are 1-acre towns on the Land Use Review Board’s September 24, 2026 list, including Dover, Wilmington, Whitingham and Londonderry, so commercial or industrial development on a tract of more than one acre there needs an Act 250 permit. Only Brattleboro, Marlboro, Newfane, Putney, Rockingham, Stratton and Westminster are 10-acre towns.

Zoning permit fees in Windham County

Towns adopt their own fee schedules, and several charge by floor area. These are the posted figures for houses and smaller projects:

Posted zoning permit fees
TownNew houseOther work
Brattleboro (effective April 15, 2025)$80 application + $0.40 per sq ft + $15 recordingAccessory building over 300 sq ft $0.10 per sq ft; hearing $200
Wilmington (effective November 7, 2023)$100 base + construction fee by size + $18 filing1,001–2,000 sq ft construction fee $200
Dummerston$165 including recordingLiving-space addition $90; deck or porch $40
Halifax (May 2017)$150 up to 2,000 sq ft; $200 aboveStarting without a permit: $450 or $600 instead
Marlboro$315 for a single- or two-family dwellingAccessory structure or addition $80
Whitingham (October 20, 2021)$100 + $0.05 per sq ft + $30 recordingAdditions and accessory buildings $25 + $0.05 per sq ft

Wilmington’s schedule gives a clear worked example. Its construction area counts any space with a ceiling over 4 feet and any basement that could typically be finished, so an 1,800-square-foot house falls in the 1,001 to 2,000 square foot band: $100 base plus $200 construction fee plus the $18 filing fee, $318 in all. Dover’s new zoning application and fees took effect February 1, 2025.

Electrical, plumbing and fire safety work

Two municipalities share code enforcement with the Division of Fire Safety. Brattleboro enforces the state code on existing public buildings (802-254-4831), and the town sends new public-building projects and building inspection questions to the Division’s Windham County staff at 802-798-6143. Bellows Falls handles existing apartment buildings, lodging and rooming houses for 16 or fewer people, and one- and two-family dwellings (802-376-5561), while the Division keeps plan review, permits and electrical, plumbing and building inspections. Everywhere else, public-building permits, electrical and plumbing work notices and alarm or sprinkler permits go to the Springfield Regional Office before work begins. In Stratton, a town regulation effective September 11, 2026 governs private fire alarms and requires a Knox Box keyed for the Stratton Mountain Volunteer Fire Company.

How to get a permit in Windham County

1. Identify the town

Bellows Falls and Saxtons River addresses go to Rockingham’s zoning office; Jacksonville goes to Whitingham.

2. Ask the zoning administrator first

Wilmington asks for a scale site plan with every application and a signed owner authorization for any agent.

3. Apply and wait out the appeal period

Dummerston, for example, has up to 30 days to decide and the permit must be displayed for 15 days before work starts.

4. Get the state permits

Wilmington’s zoning permits are conditional on any state wastewater permit, which the owner files with the town clerk.

5. Screen for Act 250 early

In the 16 one-acre towns, small commercial sites can fall under District 2 review.

6. Register rentals

Brattleboro requires existing and new rental units to be registered every year.

Inspections and flood rules

Town offices check zoning compliance, not construction; Brattleboro issues zoning compliance letters on request, and Rockingham’s zoning coordinator also assigns E911 addresses. State inspections of public buildings come from the Springfield Regional Office. Of the Windham County towns in FEMA’s Community Status Book, all take part in the National Flood Insurance Program except Athens, which is in the not-participating section; the participating towns’ flood maps are dated September 28, 2007, and Somerset has no entry.

⚠️ Brattleboro interim bylaws. The Selectboard adopted an interim bylaw expanding the Residential Neighborhood district on March 20, 2025, and another on social assistance and charitable services on December 22, 2025 that runs until December 22, 2027. Both apply alongside the 2023 regulations.
